	answer	answer is ministerial correction date of answer 21/04/2021 answer text <p>There are already several potential penalties available to deal with dog owners who do not keep their animals under control.</p><p> </p><p>It is an offence under section 3(1) of the Dangerous Dogs Act 1991 to allow a dog to be dangerously out of control. Under section 2 of the Dogs Act 1871 a magistrates' court may make any Order they consider appropriate to require an owner to ensure that their dog is kept under proper control. The Anti-social Behaviour, Crime and Policing Act 2014 also includes specific measures to enable the police and local authorities to tackle irresponsible dog ownership.</p><p> </p><p>Defra has also commissioned research in collaboration with Middlesex University to consider the effectiveness of current dog control measures. The report is currently being peer reviewed and will be finalised in light of peer review comments. The penalties for allowing a dog to be dangerously out of control were increased in 2014.</p><p> </p><p>In 2017, Defra reviewed the way the police and local authorities have used the powers available to them to tackle dog control and welfare issues. This resulted in further Defra guidance for these enforcement authorities emphasising their respective responsibilities and encouraging the use of good practice such as application of the LEAD initiative (Local Environmental Awareness on Dogs).</p><p> </p><p>Defra commissioned Middlesex University to examine measures to reduce dog attacks and promote responsible ownership. The report was submitted to Defra in March this year. The report is currently being peer reviewed and will be finalised in light of peer review comments. 	answer	answer is ministerial correction date of answer 06/09/2021 answer text <p>Section 1 of the Dangerous Dogs Act 1991 prohibits the owning or keeping of four types of dog: the Pit Bull terrier, the Dogo Argentino, the Fila Brasileiro and the Japanese Tosa.</p><p> </p><p>Despite the general prohibitions on these types of dog, an individual prohibited dog can be kept by its owner or by the person for the time being in charge of the dog if a court judges that the dog is not a danger to public safety. In its assessment, the court must consider the temperament of the dog and its past behaviour, whether the proposed keeper is a fit and proper person, and may consider any other relevant circumstances, such as whether the dog can be kept in a suitable environment. If the court considers these criteria to be met, the dog can be listed on the Index of Exempted Dogs and must be kept under strict conditions, including being on a lead and muzzled in public.</p><p> </p><p>The Dangerous Dogs Exemption Schemes (England and Wales) Order 2015 sets out the circumstances where an exempted prohibited dog may be transferred to a new keeper should the current keeper become seriously ill or die.
