answer	answer is ministerial correction date of answer 28/11/2018 answer text <p>All decisions to prosecute made by the Crown Prosecution Service must meet the Full Code Test set out in the Code for Crown Prosecutors. The Code makes it clear that there is a balance to be struck between the public interest in diverting a defendant with significant mental illness such as dementia from the criminal justice system and other public interest factors in favour of prosecution, including the need to safeguard the public.</p><p>The eighth edition of the Code for Crown Prosecutors was published in October 2018. Prosecutors are asked to “have regard to whether the suspect is, or was at the time of the offence, affected by any significant mental or physical ill health or disability, as in some circumstances this may mean that it is less likely that a prosecution is required. However, prosecutors will also need to consider how serious the offence was, whether the suspect is likely to re-offend and the need to safeguard the public or those providing care to such persons.”</p><p>The existing CPS legal guidance on prosecuting ‘Mentally Disordered Offenders’ is currently being revised to include specific guidance on prosecuting cases where the suspect suffers from a condition such as dementia. I refer the Hon Member to the Department’s previous answer of 2 July 2018 to Question UIN <a href="https://www.parliament.uk/business/publications/written-questions-answers-statements/written-question/Commons/2018-06-26/157784/" target="_blank">157784</a>. All registered SLPs are eligible under the terms of the Scottish Partnerships (Register of People with Significant Control) Regulations 2017.</p><p> </p><p>The above regulations also require a Scottish qualifying partnership (SQP) to register with Companies House and deliver information concerning its People with Significant Control (PSC). An SQP is a general partnership constituted under the law of Scotland that is a qualifying partnership under the Partnership (Accounts) Regulations 2008. As part of the permit application, the operator will need to describe the management of fugitive emissions in an ‘emissions management plan’.</p><p>During operations the operator will be required to undertake environmental monitoring, including emissions monitoring, to demonstrate compliance with their permits. In some cases, depending on the risks presented by a site or community concerns, the Environment Agency may carry out extra monitoring themselves.</p><p>As a further safeguard, the Infrastructure Act 2015 makes it clear that hydraulic fracturing activities cannot take place unless appropriate arrangements have been made for monitoring emissions of methane into the air.</p><p>In addition, the Government is grant funding an environmental monitoring programme led by the British Geological Survey (BGS) in the Fylde (Lancashire) and Kirby Misperton (North Yorkshire), where applications for shale gas wells have been made.</p> answering member constituency Devizes answering member printed Claire Perry question first answered 29/11/2018 14:22:57 answering member 3974 label Biography information for Claire Perry

answer	answer is ministerial correction date of answer 04/12/2018 answer text <p>No Scottish Limited Partnerships (SLPs) have been fined since the People with Significant Control register came into force.</p><p> </p><p>I refer the hon. Member to the answer given to her on 2nd July 2018 to Question 157783. Compliance is Companies House’s primary aim, rather than prosecution. It is taking action to ensure that all SLPs report their PSC information. Companies House is actively engaged with SLPs and their representatives to make them aware of their responsibilities, and in addition, it has issued reminder letters to all SLPs who have failed to file PSC information. Failure to comply with the requirement to report PSC information does not incur a civil penalty but it is an offence and may lead to a fine or imprisonment upon prosecution. Companies House is not a prosecuting body and will refer cases to a relevant prosecutor when all other avenues have been exhausted and an SLP has not complied with their obligations.</p><p>In April the Government consulted on a package of reforms which would limit the misuse of limited partnerships, including in their Scottish form.
