answer text <table><tbody><tr><td><p> </p></td></tr></tbody></table><p>No requests for information, made by the Criminal Cases Review Commission (CCRC) under Section 17 of the Criminal Appeal Act 1995 ’the Act’, were refused by public bodies in 2017.</p><p>Since 2010, the CCRC has never brought a judicial review against a public body because of its refusal to agree to a request for information under Section 17 of the Act.</p><p>The CCRC has never obtained any Crown Court Orders under Section 18A since this provision was enacted by an amendment to the Act in 2016.</p> more like this

answer text <p>Section 23 of the Criminal Appeals Act 1995 prevents the Criminal Cases Review Commission (CCRC) from disclosing any information obtained by the Commission in the exercise of any of their functions (specified exceptions do apply).</p><p> </p><p>In line with legislation, following a Case Review the CCRC will provide all applicants with a Statement of Reasons, as to why the case was referred or not referred to the Court of Appeal.</p><p> </p><p>The Ministry of Justice is not aware of any other reviews undertaken by other public authorities that concerned Mr McCafferty. Mr McCafferty previously worked for the Forensic Science Service (FSS). The FSS was a government owned company, sponsored by the Home Office, which was dissolved in 2012.</p> more like this

answer text <p>We are aware that the Westminster Commission on Miscarriages of Justice, set up by the All-Party Parliamentary Group on Miscarriages of Justice, has made recommendations regarding the funding of the Criminal Cases Review Commission (CCRC).</p><p>The funding allocation the CCRC is reviewed each year internally within MoJ – and in consultation with the CCRC itself – as part of setting budgets. At each Spending Review the overall MoJ budget is reviewed with HM Treasury. Annual budgets for departments and their Arm’s Length Bodies are part of the Main Estimate, which is laid before Parliament each year by HM Treasury.</p> more like this

answer text <p>The Criminal Cases Review Commission, funded by the Ministry of Justice, functions as an independent body, making decisions autonomously and without ministerial influence.</p><p>Under Section 13 of the Criminal Appeal Act 1995, the Court of Appeal may only quash a conviction where they consider it ‘unsafe’. The Criminal Cases Review Commission can only refer a case to the Court of Appeal, where it is satisfied there is a ‘real possibility’ that the conviction would be quashed as ‘unsafe’, or the sentence would be changed.</p><p>Existing legislation allows for cases to be referred by the CCRC in exceptional circumstances where there is no fresh evidence, fresh legal argument or where the person has not exhausted appeal routes. However, the CCRC still has to consider whether there is a real possibility that the Court of Appeal will consider it unsafe.</p> more like this
