The Department has not conducted or commissioned research on life experiences for people with Down’s Syndrome in the 21<sup>st</sup> Century.</p><p> </p><p>Equal rights for disabled people, including people with Down’s Syndrome, are provided for under the reasonable adjustments provisions in the Equality Act and the Public Sector Equality duty. Each Government Department and public authority is under a duty to make adequate provision for disabled people including people with Down’s Syndrome.</p><p> </p><p>Disability in the UK is mainstreamed. Carer’s Allowance provides a measure of replacement income where the duties of caring for a severely disabled person limit the prospect of full-time work and the earnings it would yield. State Pension provides a replacement income in retirement.</p><p>It is a long-standing and basic principle of the social security system that only one benefit at a time can be paid for the same purpose. Even though the circumstances which give rise to entitlement to Carer’s Allowance and State Pension are different, they are both designed to provide a degree of replacement for lost or foregone income.</p><p>The overlapping benefits rules, which prevent both benefits being paid, were established to reflect the general principle that flat-rate benefits designed to help with income maintenance e.g. Carer’s Allowance and State Pension, should not be added together and paid in full, even though a person may qualify for both. People who receive contribution-based benefits are not eligible for Cold Weather Payments. This is because the scheme was specifically designed to target the additional heating costs of the most vulnerable people in society. The scheme is subject to financial constraints and to ensure that limited public funds are used in the most effective way possible, the Government believes that the fairest way of managing this is by linking eligibility to income-related benefits.</p><p>To put this into context, during the 2010/11 Cold Weather Payment season over £435 million was paid to eligible claimants.
