star this property answer text <p>The Department was made aware of the immigration status difficulties of individual cases, as flagged by members of the House and the media. The wider issue around the immigration status difficulties affecting some of the Windrush generation has come to the fore, and the attention of Ministers, in recent months. On the 16 April we set up a Taskforce to help those affected get documents they need and on 30 May, the Windrush Scheme came into force. This Scheme is designed to ensure that members of this generation, their children born in the UK and those who arrived in the UK as minors will be able to apply for citizenship, or various other immigration products, free of charge.</p> more like this

The number of staff deployed to the team will be driven by the number of people that contact the Department for help. star this property answer text <p>The department has been reviewing the cases of all Caribbean Commonwealth nationals, born before 1 January 1973, who have been removed and/or detained by the Home Office since 2002 (when the Casework Information Database (CID) was available across the immigration system) to identify any individuals where there was an indication in the record that the individual could have been in the UK before 1973.</p><p>The Home Secretary wrote to the Chair of the Home Affairs Select Committee on 21 August to provide an update on this work. Letters of apology are being sent from the Home Secretary to the eighteen individuals who we consider are most likely to have suffered detriment because their right to be in the UK was not recognised and where the Department is most likely to have acted wrongfully in removing and / or detaining them. A copy of this letter has been deposited in the House Library.</p><p>This work is ongoing and the Home Secretary committed to regularly updating the Home Affairs Select Committee on this work, as well as the review into proactive compliant environment sanctions.</p><p>Children of the Windrush generation who were born in the United Kingdom will generally consider themselves to be British. However, in some cases they may need a document to confirm that status. Others will have the right to register as British. This is being facilitated through the Windrush taskforce. Additionally, any child of a member of the Windrush generation who was born abroad and who came to live in the UK before they were 18 and has been continuously resident and meets the good character requirements may apply to obtain citizenship.</p>

star this property answer text <p>The Compliant Environment is not a new concept; successive Governments have brought forward policies to protect the UK taxpayer from the misuse of public services and benefits and to tackle illegal migration.</p><p>Compliant Environment measures were never intended to impact on people with lawful immigration status in the UK, such as the Windrush generation.</p><p>We are fully committed to helping those affected to evidence their status in the UK and are making that process as straightforward as possible. A taskforce and helpline has been set up in the Home Office to help those concerned to prove their residence. The taskforce is taking a proactive approach so individuals can easily establish their rights.</p><p>We have also put in place additional protection for landlords, employers and others conducting checks in order to ensure we are not denying work, housing, benefits and services to Commonwealth migrants who have been long-term residents of the UK.</p><p> </p> more like this

The new team set up will help the applicants to demonstrate that they are entitled to live in the UK and will aim to resolve cases within two weeks when the evidence has been provided.</p><p> </p><p>The Home Office will also be setting up a new compensation scheme. star this property answer text <p>Appropriate safeguarding processes are built into compliant environment measures, including the right to redress, but clearly there is more to be done here. We are reviewing compliant environment measures and taking immediate action to introduce additional safeguards to protect Windrush generation cases. These cases will be dealt with quickly and sensitively.</p><p> </p><p>The Home Office has also sent out communications urging other government departments and public authorities to exercise particular care when responding to applications for benefits and services from the Windrush generation. Guidance has also been added to the <a href="http://www.gov.uk" target="_blank">www.gov.uk</a> website advising landlords on what they should do - <a href="https://www.gov.uk/government/collections/landlords-immigration-right-to-rent-checks" target="_blank">https://www.gov.uk/government/collections/landlords-immigration-right-to-rent-checks</a></p><p> </p><p>Individuals who are unable to access housing in the UK as a result of not provide the appropriate documentation to show that they are entitled to live in the UK should contact the Home Office, by telephone on 0800 678 1925 or by emailing <a href="mailto:commonwealthtaskforce@homeoffice.gsi.gov.uk" target="_blank">commonwealthtaskforce@homeoffice.gsi.gov.uk</a>. The team will help the applicants to demonstrate that they are entitled to live in the UK and will aim to resolve cases within two weeks when the evidence has been provided.</p>
