star this property answer text <p>The Immigration Act 2016 creates a new Director of Labour Market Enforcement. They will be responsible for overseeing and setting priorities for the Employment Agency Standards Inspectorate, National Minimum Wage enforcement and the Gangmasters and Labour Abuse Authority. This will strengthen efforts to identify businesses that engage in labour exploitation.</p><p> </p><p>To enable more effective enforcement, we are creating:</p><ul><li>A new intelligence hub so that enforcement is targeted at areas of risk; and</li><li>A new regime of Labour Market Enforcement undertakings and orders, backed up by a criminal offence and custodial sentence, to allow us to tackle repeat labour market offenders and rogue businesses.</li></ul><p> </p><p>We have already reformed the Gangmasters Licensing Authority into the Gangmasters and Labour Abuse Authority with the ability to tackle labour exploitation.</p><p><strong> </strong></p> more like this

star this property answer text <p>The Government is committed to increasing compliance with National Minimum Wage (NMW) legislation and the effective enforcement of it. HM Revenue and Customs (HMRC) respond to every complaint they receive and conducts risk-based enforcement in sectors or areas where there is perceived to be a higher risk of workers not being paid the legal minimum wage.</p><p> </p><p>In 2015/16 HMRC identified £10.3m or arrears owed to over 58,000 workers, and this year we have increased the NMW enforcement budget to £20m, up from £13m in 2015/16. We have also made penalties tougher, so that non-compliant employers now face a penalty equivalent to 200% of the arrears they owe, up to a maximum penalty of £20,000 per worker.</p><p> </p><p>Employers are named publically under the Government’s NMW naming scheme for non-payment. To date, 687 employers have been named and shamed, owing combined arrears of more than £3.5 million.</p><p> </p><p> </p><p> </p> more like this

This is relevant to all new parents, including those who have had a premature child, and their employers. The Acas guidance includes an on-line tool for employers which, for example, helps them manage their employees return to work.</p><p> </p><p>The Acas website also includes guidance for employers on good practice in managing absence, including circumstances in which staff need time off to care for premature or sick babies.</p> more like this

Employment contracts and contractual changes are a matter for the individual and the employer to agree, but they must comply with the legal framework.</p><p>Guidance on the GOV.UK website reflects the legal requirements employers must follow when asking individuals to consider contractual changes. star this property answer text <p>The availability of atypical employment provides a number of benefits for workers who cannot or do not want to commit to ‘standard’ full-time employment. This results in high participation rates among groups which might otherwise be excluded from work altogether, like mothers returning to work.</p><p>The UK’s flexible labour market means those who work in flexible arrangements continue to be entitled to employment protections regardless of the contract type. But we recognise that there are instances where the UK labour market is not working fairly for everyone and is why we asked Matthew Taylor to carry out his independent Review of Working Practices. star this property answer text <p>I made an oral statement to the House on 11 July 2017 to announce the publication of the Matthew Taylor Review of Modern Working Practices.</p><p> </p><p>The Review looked at ways to ensure that the regulatory framework surrounding employment, and the support Government provides to businesses and workers, was keeping pace with changes in the labour market and the economy.</p><p> </p><p>The report is comprehensive and detailed and will require detailed, careful thought and further consultation. star this property answer text <p>New EU legislation that provides workers’ rights which member states are obliged to confer will be covered by the proposed clauses. Workers’ rights include labour protections regarding health and safety at work. The Government will be required to report on those new rights, whether they go further than current domestic rights, and if so the action the Government proposes to take. Air and water quality standards are only in scope to the extent that they fall within the definition of workers’ rights.</p><p> </p><p>The Government has been clear that the UK will maintain and enhance environmental protections as it leaves the EU. As part of the 25 Year Environment Plan, the Government has set an ambition to be the first generation to leave the environment in a better state than it found it – and has already put in train a number of policies to achieve this.</p><p> </p><p>The Environment Bill will be introduced early in the second Session of this Parliament, and will include ambitious legislative measures to take direct action to address the biggest environmental priorities of our age: air quality, nature recovery, waste and resource efficiency, and water resource management. In the Environment Bill the Government will legislate to ensure there is a robust framework for the maintenance and strengthening of environmental standards as the UK leaves the EU.</p>

star this property answer text <p>On 17 December 2018 we published the Good Work Plan, which sets out our vision for the future of the labour market and our ambitious plan for implementing the recommendations arising from the Taylor Review. This important package represents the biggest upgrade to workers’ rights in over 20 years and demonstrates how we are leading the way internationally to ensure workers have access to the rights and protections they deserve in the context of a changing world of work.</p><p> </p><p>Successive governments have introduced a legal framework which ensures that employers should always treat their employees fairly.</p><p> </p><p>In general, the terms and conditions of employment are for negotiation and agreement between employers and employees (or their representatives). Once agreed, however, they form a legally binding contract of employment. While it is always open to either party to seek to renegotiate the terms of the contract, if the employer changes any of the terms without the employee’s agreement, the employee may be entitled to seek legal redress.</p><p> </p><p>Additionally, employees who consider that their dismissal was unfair can complain to an employment tribunal, generally subject to a qualifying period of continuous service.</p><p> </p><p>Both employers and employees are strongly encouraged to follow the guidance available on GOV.UK at https://www.gov.uk/your-employment-contract-how-it-can-be-changed when considering changing their terms and conditions of employment.</p>

star this property answer text <p>On 17 December 2018 we published the Good Work Plan, which sets out our vision for the future of the labour market and our ambitious plan for implementing the recommendations arising from the Taylor Review of Modern Working Practices.</p><p> </p><p>Since publishing the Good Work Plan, we have passed legislation that means:</p><ul><li>All workers receive a day one statement of rights setting out leave entitlements and pay;</li><li>An maximum additional penalty that Employment Tribunals can use quadrupling from £5,000 to £20,000, helping ensure workers are protected from employers who show malice, spite or gross oversight;</li><li>The ending of the Swedish Derogation, the legal loophole that enables some firms to pay agency workers on less than permanent staff, which will benefit up to 120,000 agency workers;</li><li>New agency workers will receive a key facts page before signing up with an agency, providing them with greater clarity, particularly around their pay; and</li><li>The threshold for an information and consultation request being reduced from 10% to 2% of employees, meaning a stronger voice in the workplace.</li></ul><p> </p><p>In delivering the Good Work Plan. we will also:</p><ul><li>Legislate to make improvements to the clarity of employment status tests to reflect the reality of modern working relationships;</li><li>Bring forward proposals for consultation on creating a new, single labour market enforcement agency to better ensure that vulnerable workers are more aware of and can exercise their rights, and that businesses are more supported to comply with the law;</li><li>Enforce holiday pay for vulnerable workers;</li><li>Introduce a right to request a more predictable and stable contract;</li><li>Launch a new scheme to name and shame, for the first time, employers who fail to pay employment tribunal awards.</li></ul>

star this property answer text <p>The Immigration Act 2016 introduced the provision for three labour market enforcement bodies to serve labour market enforcement undertakings (LMEU) and orders (LMEO): the Employment Agency Standards (EAS) Inspectorate, the Gangmasters and Labour Abuse Authority (GLAA) and Her Majesty’s Revenue and Customs – National Minimum Wage Team (HMRC – NMW).</p><p> </p><p>To date, no prosecution has resulted from breaching a labour market enforcement undertaking or order.</p><p> </p><p>Each enforcement body has a different legal framework for the disclosure of information related to LMEUs. Both EAS and HMRC – NMW cannot disclose the name of the employers or the nature of the offences without informed consent from the employers involved as this would be in breach of their respective customer confidentiality clauses. Section 9 of the Employment Agency Act precludes EAS from publishing the name or details of enforcement action without the permission of the employment business or agencies involved. Section 18 of the Commissioners for Revenue and Customs Act (CRCA) 2005 precludes HMRC from disclosing/sharing information about an individual or taxpayer to a third party.</p><p> </p><p>The GLAA routinely discloses the dates and the type of trigger offences for which its LMEUs are served. Whilst the Gangmasters (Licensing) Act 2004 does not preclude the GLAA from disclosing the names of the recipients of LMEUs, the GLAA does not deem appropriate to release their identity. star this property answer text <p>As part of his annual strategy 2018/19, the former Director of Labour Market Enforcement - Sir David Metcalf – recommended that the Government introduce joint responsibility to encourage the top of the chain to take an active role to tackle labour market breaches through their supply chain. Sir David also recommended that provisions should be made to enable the temporary embargo of “hot goods” to disrupt supply chain activity where significant non-compliance is found.</p><p> </p><p>The Government consulted on these recommendations as part of a wider consultation on the creation of a new Single Enforcement Body for employment rights. During the consultation period, officials from the Department discussed labour market breaches in supply chains with a range of representatives of trade unions and civil society groups. This included a dedicated roundtable to discuss non-compliance in supply chains, and a meeting with members of the Modern Slavery Strategy Implementation Group to further discuss the topic. These discussions have been of great value and the Government response to the consultation will be published in due course.</p>

star this property answer text <p>The Government is committed to cracking down on employers who fail to pay the National Minimum Wage. We are clear that anyone entitled to be paid the minimum wage should receive it. All businesses – irrespective of their size or business sector – are responsible for paying the correct minimum wage to their staff.</p><p>Individuals can contact the Advisory, Conciliation and Arbitration Service (ACAS) on 0300 123 1100 or at www.acas.org.uk for confidential, impartial, and free advice if they think they are being underpaid. They can also complain to HMRC, which is responsible for enforcing National Minimum Wage legislation. HMRC will consider every complaint it receives.</p><p>The Government has more than doubled the budget for National Minimum Wage compliance and enforcement to £27.5 million for 2020/21, up from £13.2 million in 2015/16. Increasing the budget allows HMRC to focus on tackling the most serious cases of non-compliance. It also increases the number of compliance officers available to investigate minimum wage complaints and conduct risk-based enforcement in sectors where non-compliance is most likely.</p><p>The safer workplaces guidance does not change existing obligations relating to health and safety, employment, or equalities. If the enforcing authority finds that an employer is not taking action to properly manage workplace risk, a range of actions are open to them including specific advice or issuing enforcement notices.</p>

star this property answer text <p>Exploiting vulnerable workers for commercial gain is despicable and we expect businesses to do all they can to tackle abuse and exploitation in their supply chains. The findings of this review are concerning and we expect Boohoo to continue to fully cooperate with law enforcement agencies in their ongoing investigations in Leicester.</p><p> </p><p>In response to the allegations of labour market non-compliance in Leicester garment factories, a taskforce led by the Gangmasters and Labour Abuse Authority has been set up. The taskforce coordinates a multi-agency approach to enforcement activity, the gathering and sharing of intelligence and wider community engagement aimed at encouraging reporting and helping raise awareness of workers’ rights. It includes: HMRC National Minimum Wage; Employment Agencies Standards Inspectorate; Leicestershire Police; National Crime Agency; Leicester City Council; Department for Work and Pensions and Immigration Enforcement. Where evidence of non-compliance is found, the enforcement bodies will take appropriate enforcement activity.</p><p> </p><p>The Government is committed to improving enforcement of employment rights and following a consultation, we have announced our intention to create a single enforcement body. The single enforcement body will provide a clearer route for workers to raise a complaint and get support, enabling more coordinated enforcement action and the use of pooled intelligence to better target proactive enforcement.</p>
