However, due to small numbers of defendants pleading not guilty to sexual offences at magistrates’ court, we are unable to supply the average time between first listing and trial start date – basing an average on such small numbers can skew the mean and result in the figures being unrepresentative<em>.</em></p><p> </p><p>The overall median waiting time in Crown Courts for defendants in sexual offence cases tends to be higher than that for other offences due to a lower guilty plea rate for these cases. However, from a peak of 25.9 weeks in Quarter three 2018, the average waiting time has fallen by 12% to 22.7 weeks in Quarter one 2019.</p><p> </p><p>Performance, demand and waiting times in the courts are constantly reviewed to balance sitting days with waiting times, disposals and receipts. Resources are adjusted when required. Demand has been falling in recent years and sitting days have been reduced accordingly. Under the LAA’s contracting regime, an organisation may be contracted to deliver services from one or multiple offices. Contracts may be ended by either party; providers may choose to withdraw from the whole contract, an office or a category of law or the LAA may take action should a provider breach its contract obligations. All contracted providers make their own commercial decisions and withdrawal from a legal aid contract may not be as a result of a closure. For example, NfPs may withdraw from a legal aid contract but continue to operate reliant on other funding, or may choose to consolidate offices but continue to deliver larger volumes of work across a wider area. The table below shows the number of NfP providers (at office level) holding a legal aid contract in any given year. While NfP organisations play a role in helping people access justice, they are not the sole means. We have 1,439 organisations delivering legal aid contracts across the England and Wales – 1,356 of which are with legal firms rather than the not-for-profit sector which includes law centres. These organisations are directly involved in the delivery of vital frontline probation services. Further to the Direction, we have worked with the Permitted Subcontractors to agree the monies that are owed, after undertaking extensive assurance checks against their Proof of Debt applications. We are now in the process of signing the Grant Agreements with each of the Permitted Subcontractors and validating their payment details in order to expedite payment of the monies owed.</p></td></tr></tbody></table><p>We have been very clear that this is a unique response to a unique and specific set of circumstances. Furthermore, the listing of appeals, including consideration of whether a hearing should be expedited, is a function of the Tribunal’s judiciary. There are also no targets for staffing levels for medical members, disability qualified members or judges in the SSCS jurisdiction. Levels are set based on forecast receipts to the SSCS jurisdiction, outstanding workload, and venue capacity.</p><p> </p><p>HM Courts and Tribunals Service (HCMTS) is taking positive steps to reduce the waiting time for appeals to be heard in the SSCS jurisdiction. In 2018, 232 medical members and 118 disability-qualified members were additionally appointed to the SSCS jurisdiction and an extra 129 fee-paid judges have recently been appointed. The SSCS jurisdiction will also benefit from 100 salaried judges and 170 fee-paid judges being recruited across tribunals more widely. In addition, HMCTS is developing a new digital system with a view to enabling speedier processing of appeals and a better service for all parties to the proceedings. The department is due to release the next estimate in October 2019.</p><p> </p><p>This new analysis indicated that as at 30 June 2018, 2032 prisoners had declared as ‘ex-service personnel’ when they were first received into custody between January 2015 and June 2018. New and enhanced technology as well as dedicated search teams have contributed to that fall in the smuggling of weapons.</p><p> </p><p>The new Crime in Prison Agreement between HMPPS, the Crown Prosecution Service (CPS) and the police has also resulted in crimes committed whilst in prison or in smuggling in illicit items being consistently referred for prosecution to the police. This sends a clear message to those who commit crimes that they will be punished through the courts and face the consequences of their actions</p><p> </p><p>Data on weapons held in prison has been collectively systematically since 2015 and is enclosed. Safeguarding referrals from the youth secure estate to Local Authorities are handled by secure estate establishment staff, as are the maintenance of supporting records. Data provided in this response is therefore the amalgamation of bespoke local records, and is not based with a single methodology. Furthermore, different local authorities have varying protocols in place. For example, in some potential referrals can be ‘triaged’ or reviewed by an on-site social worker before a formal referral is made; in other cases there may be no such arrangement in place and all cases are formally referred to the local authority. 	answer	answer is ministerial correction date of answer 22/07/2019 answer text <p>HMPPS has a duty of care to its staff to ensure they are provided immediate and specialist advice following suspected and actual Bodily Fluid Exposure (BFE) incidents. 	answer	answer is ministerial correction date of answer 22/07/2019 answer text <p>HMPPS value the contribution made by external partners to HMPPS and work collaboratively with suppliers to ensure the health and safety of non-directly employed staff in prison and probation sites</p><p>Prison staff not directly employed by HMPPS can have access to the Employee Assistance Programme, trauma support services and personal well-being zones. These arrangements are agreed by officials in consultation with our external partners. However, it is normal practice for most of our external partners to have their own support arrangements in place for their staff.</p><p> </p><p>Prison staff not directly employed by HMPPS do not have access to all occupational health services because occupational health is the responsibility of their employer.</p><p> </p><p>However, contractors and third party supplier staff do have access to a 24 hour body fluid exposure and sharps injury help line, which gives non-directly employed prison staff access to immediate and specialist advice and guidance from a nurse following a suspected and actual body fluid exposure incident. 	answer	answer is ministerial correction date of answer 22/07/2019 answer text <p>The health and safety of our staff and those in our care remains our top priority. Risks to staff are continually assessed, and suitable controls are implemented accordingly. The effectiveness of those controls is monitored at local and national level, and through joint audit work with prison unions.</p><p> </p><p>HMPPS recognises that the physical, emotional and social wellbeing of employees is paramount. All HMPPS staff have access to an occupational health service and employee assistance programme. This includes 24 hour, 365 days a year access to signposting and counselling, and trauma support services.</p><p> </p><p>It is a priority to ensure that prisons are places of safety and reform and the government has invested an additional £70 million investment in safety, security and decency. 	answer	answer is ministerial correction date of answer 22/07/2019 answer text <p>On 31<sup>st</sup> March 2019 there were 24 prison staff who were signed off from work due to work related illnesses.
