star this property answer text <p>United Kingdom legislation only recognises two legal sexes or genders; male and female. There is no legal recognition of a third gender. Her Majesty’s Passport Office can therefore only issue passports indicating ‘male’ or ‘female’.</p><p>The Government is aware of an increasing number of people who identify as neither exclusively male nor female. We have committed to carrying out a call for evidence on the experiences of people who have a non-binary gender identity. The evidence gathered from this exercise will inform the Government’s next steps in this area.</p> more like this

star this property answer text <p>The Home Office is unable to report on how many applications for asylum from Chinese Uighurs it has received since 2015; and what proportion of those applications have been successful, as to obtain this information would require a manual trawl of records and could only be obtained at disproportionate cost. We do, however, publish data on those who have been granted asylum in the UK, with main applicants broken down by country of nationality. The latest release, published 24th May 2019, can be found in tab as_01 at volume 1 of the quarterly Immigration Statistics release:<br><a href="https://www.gov.uk/government/publications/immigration-statistics-year-ending-march-2019/list-of-tables#asylum" target="_blank">https://www.gov.uk/government/publications/immigration-statistics-year-ending-march-2019/list-of-tables#asylum</a></p><p>The UK has a proud history of providing protection to those who need it, in accordance with our international obligations under the Refugee Convention and European Convention on Human Rights (ECHR). <br>Where someone establishes a well-founded fear of persecution or serious harm in their country they are normally granted protection and are not expected to return there.</p><p>Our assessment of the situation for Uighurs in China is set out in the relevant country policy and information note, which is available on the Gov.uk website</p><p>All asylum and human rights claims from Chinese nationals are carefully considered on their individual merits in accordance with our international obligations. Each individual assessment is made against the background of the latest available country of origin information and any relevant caselaw.</p>

star this property answer text <p>The Upper Tribunal concluded, in the case of Aydogdu, that there was no legal basis under the Ankara Agreement for the previous route to indefinite leave to remain (ILR) for Turkish nationals who have set up businesses in the UK.</p><p><br>The Home Office therefore closed the route in March 2018 and, though not obliged to do so, introduced a route via the domestic Immigration Rules to enable Turkish business persons and their family members to obtain ILR where certain criteria are met.</p> more like this

I have every sympathy with their victims. Once we are in a position to do so, we will also be in contact with the victims to provide them with an update.</p><p><br>This Government puts the rights of the British public before those of criminals, and we are clear that foreign criminals should be deported from the UK wherever it is legal and practical to do so.</p> more like this

star this property answer text <p>The UK Government remains focussed on ensuring a smooth and orderly withdrawal from the EU with a deal as soon as possible</p><p>However, as a responsible government, we’ve been preparing to minimise any disruption in the event of no deal for nearly three years. The Home Office has been planning and preparing for a no deal scenario ensuring we have contingency plans in place across areas including law enforcement, passport operations and the border. <br> <br>We have taken extensive steps to provide businesses and citizens with advice on helping them mitigate the potential impacts of a no deal exit. When necessary we will continue to update our advice on gov.uk/euexit on how people should prepare</p><p>During the extension period, to underpin our ability to respond in a no deal scenario, we are working closely with operational partners to develop our response to a range of theoretical scenarios</p><p>The Treasury has allocated over £4.2 billion of additional funding to departments and Devolved Administrations for EU exit preparations so far. This breaks down as £412m over the spending review period for the Department for Exiting the European Union, Department for International Trade and the Foreign &amp; Commonwealth Office (Autumn Statement 2016); £286m of additional funding for 2017/18 (a full breakdown of which can be found in Supplementary Estimates 2017/18); over £1.5 billion for 2018/19 (Supplementary Estimates 2018/19); and over £2 billion for 2019/20 (Main Estimates 2019/20). This funding is to cover all exit scenarios and is in addition to departmental efforts to reprioritise from business as usual toward preparations for the UK’s departure from the EU. Work on no-deal exit preparations cannot be readily separated from other EU exit work, given the significant overlap in plans in many cases.</p>

The MAC is due to report by January 2020.</p><p>We recognise the vital contribution that scientists make to the UK. In his spring statement, my Rt Hon Friend, the Chancellor of the Exchequer, confirmed that PhD level occupations would be exempt from the Tier 2 cap. Additionally, researchers applying for settlement are exempt from the rule which states that, there should be no absence from the UK for 180 days if the absence from the UK is for the purpose carrying out research. A number of research roles also appear on the Shortage Occupation List which also exempts them from the settlement salary threshold</p><p>The Tier 1 (Exceptional Talent) route is also available for internationally recognised leaders and promising future leaders, including in the science and research sector.</p>

star this property answer text <p>The Government ended the routine detention of children in immigration removal centres in 2010. Individuals under the age of 18 are not detained for consideration of their asylum claim.</p><p>In cases where new information comes to light or concerns are raised, which indicate that a person who has been detained as an adult may be a child, we would seek to release them into the care of local authority children’s services at the earliest safe opportunity for an age assessment.</p><p>Section 55 of the Borders, Citizenship and Immigration Act 2009 and published guidance in the form of Detention Services Order (DSO) 19/2012 “Safeguarding Children Policy” and DSO 14/2012 “Care and Management of Age Dispute Cases” set out the legal duties and guidance for staff in the immigration removal estate. This ensures that the welfare of children and their safeguarding is at the forefront of every interaction and decision.</p> more like this

To obtain this information would require detailed reporting against multiple cost centres and could only be obtained at disproportionate costs.</p><p><br>Decisions on asylum claims are made by decision makers in Asylum Operations. There are recruitment strategies in place to maintain staffing at the required levels to allow us to manage asylum intake and reduce the overall time to make initial asylum decisions.</p><p>All asylum claims lodged in the UK are carefully considered on their individual merits against a background of relevant case law and up to date country information.</p> more like this

star this property answer text <p>In the year ending March 2019 24,333 individuals entered the detention estate which is the lowest level since comparable records began in 2009. In the same period 71% of detainees were held for 28 days or less and 93% for less than four months.</p><p>The Government expects that changes in policy and operational approaches will lead to a reduction in the number of those detained, and the duration of detention before removal, in turn improving the welfare of those detained.</p><p>The Government is committed to using detention sparingly and only when necessary. The Home Office has taken a systematic approach to modernising and rationalising the immigration detention estate, ensuring the geographical footprint and resilience required to meet our future needs. By this summer the estate will be almost 40% smaller than it was four years ago and of significantly higher quality.</p> more like this

star this property answer text <p>In the year ending March 2019 24,333 individuals entered the detention estate which is the lowest level since comparable records began in 2009. In the same period 71% of detainees were held for 28 days or less and 93% for less than four months.</p><p>The Government expects that changes in policy and operational approaches will lead to a reduction in the number of those detained, and the duration of detention before removal, in turn improving the welfare of those detained.</p><p>The Government is committed to using detention sparingly and only when necessary. The Home Office has taken a systematic approach to modernising and rationalising the immigration detention estate, ensuring the geographical footprint and resilience required to meet our future needs. By this summer the estate will be almost 40% smaller than it was four years ago and of significantly higher quality.</p> more like this

This data will continue to be published on an annual basis each August.</p><p><br>At the same time, the Home Office published data on pregnant women in detention and further breakdowns of data on reports made by a medical practitioner under Rule 35 for the first time in the <a href="https://www.gov.uk/government/publications/immigration-enforcement-data-november-2018" target="_blank">Immigration Enforcement Transparency</a> data. This data will continue to be published on a quarterly basis.</p><p><br>In February 2019, the Home Office also announced its intention to undertake a more extensive review of the published enforcement data and has invited initial user feedback on the current and future publication of enforcement data. The review will include a formal consultation, which will be launched this summer and will be used to inform any future publication plans.</p>

star this property answer text <p>The Home Office is unable to report on how many people have been deported who applied for asylum in the UK based either in part or wholly on their sexuality or gender identity and fear of persecution in their home countries in each year since 2010 by country of origin, as the Home Office do not publish data on asylum claims based on gender identity or expression. This information could only be obtained at disproportionate costs.</p><p>The Home Office remains committed to publishing information on the number of people claiming asylum on the basis of sexual orientation broken down by nationality.</p><p>On 29 November 2018, the Home Office published experimental statistics on Asylum claims made on the basis of sexual orientation, covering the period 2015 to 2017.</p><p>These experimental statistics provide data on asylum claims from 2015-2017, by year of application, initial decision, appeal receipt, or appeal decision</p><p>Data on the number of asylum claims on the basis of sexual orientation can be found in tabs SOC_00 in the experimental statistics in the link provided below:</p><p><a href="https://www.gov.uk/government/publications/immigration-statistics-year-ending-march-2019/list-of-tables#asylum-on-the-basis-of-sexual-orientation" target="_blank">https://www.gov.uk/government/publications/immigration-statistics-year-ending-march-2019/list-of-tables#asylum-on-the-basis-of-sexual-orientation</a></p><p>These are the latest data available, and the next planned update to these statistics is in August 2019.</p><p><br>Deportations are a subset of enforced returns. They may occur either following a criminal conviction, or when it is judged that a person’s removal from the UK is conducive to the public good. Information on those deported who have made an asylum claim on the basis above is not separately available. The published statistics refer to enforced returns, which include deportations as well as cases where a person has breached UK immigration laws, and those removed under other administrative and illegal entry powers who have declined to leave voluntarily. The Regulation provides that unaccompanied asylum-seeking children are given information on the Dublin procedure by the State in which the child has lodged his or her application, the State in which they are present.</p><p>The Commission’s Regulation implementing Dublin III contains a specific leaflet with information for unaccompanied children pursuant to Article 4 of the Dublin III Regulation EU 604/2013, including that the authorities where the application has been lodged should be told as soon as possible if the child thinks they have family in another Dublin State.</p><p>As part of the Sandhurst Treaty, signed by the UK and France in January 2018, we have allocated £3.6 million to fund the development of the Dublin process to support transfers of eligible children to the UK (including training for those working with unaccompanied children, family tracing and targeted information campaigns). We are also funding access to the French asylum accommodation service, the provision of health services, psychological and legal support as well as the cost of transporting asylum seekers from reception centres to locations where their asylum claims are considered.</p>

star this property answer text <p>The licence which allowed TOEIC English language testing to be used for immigration purposes was awarded following a tendering process. As part of this process the Home Office assessed both the equivalence of each tester's English test to a recognised European Standard and security arrangements around testing.</p><p>Details of the security requirements which ETS Global BV were bound to adhere to were provided to the HASC in August 2016. star this property answer text <p>The focus of our criminal investigations was on the organised criminal groups operating at a number of colleges or test centres where intelligence supported widespread criminal abuse of the TOEIC test.</p><p>Inevitably this led to investigators interviewing students and other people who had allegedly cheated the TOEIC test. Of these 3 have been charged with offences relating to the cheating of the TOEIC test and await trial. One other person is due to be charged but that person’s whereabouts is currently unknown. In addition, 5 other test takers admitted cheating the TOEIC test and were deemed suitable for, and accepted, a criminal caution.</p> more like this
