star this property answer text <p>The National Crime Agency publishes statistics on referrals into the National Referral Mechanism on a quarterly basis. This report presents a summary of the number of potential victims of modern slavery and human trafficking referred into the National Referral Mechanism (NRM) in 2018 and is the final annual report in this format, prior to the transfer of the NRM to the new Home Office Single Competent Authority in April 2019 as part of a wide-reaching NRM Reform Programme.</p><p>Further analysis is contained within the 2018 UK Annual Report on Modern Slavery. star this property answer text <p>The Home Secretary has noted that Justice and Care UK and the Centre for Social Justice’s report contains important findings on modern slavery. The Home Office will be looking at the report closely.</p><p> </p><p>The Modern Slavery Act 2015 was ground-breaking, but the Government is committed to strengthening its approach. In July 2018, the Government commissioned an Independent Review of the Modern Slavery Act 2015. star this property answer text <p>This year we marked Anti-Slavery Day by publishing the UK Modern Slavery Annual Report 2020, which provides an update on work undertaken over the last year to tackle the scourge of modern slavery. Minister Atkins hosted a virtual roundtable event with First Responder organisations to hear about best practice and the key challenges First Responders face. A wide range of stakeholder events around October 18 raised awareness of modern slavery, and the work underway to tackle it.</p><p><strong>Modern Slavery (Victim Support) Bill:</strong></p><p>The Government is committed to identifying and supporting victims of modern slavery and has recently established an ambitious programme to transform our system of victim identification and support. As part of this, we are looking closely at the legislative framework in this area.</p><p>The Government does not, however, support the Modern Slavery (Victim Support) Bill in its current form and has different proposals for supporting victims based on a more individualised understanding of their cases and needs. Specifically, the Government does not agree that:</p><p>a. confirmed victims should be automatically granted leave to remain for 12 months. Immigration decisions for victims of modern slavery are made on a case-by-case basis, considering the individual circumstances of the case; nor</p><p>b. that entitling all confirmed victims to 12 months’ worth of support is the best approach. In 2019 the Government introduced a needs-based support system for confirmed victims of modern slavery. The Government recognises that all victims are individuals with their own personal recovery needs arising from their modern slavery experiences. The new needs-based assessment system has been developed to ensure that individual needs are considered and supported with a tailored move-on plan, rather than a blanket approach to victim support.</p>

star this property answer text <p>The police have taken significant steps to improve the response to modern slavery over the last few years and all police forces in England and Wales now have specialist resources to tackle modern slavery. These can include specialist-led triage processes to oversee investigations, specialist investigative units and specialist research and analytical capabilities.</p><p>The Home Office supported this activity by providing £13.6m funding from the Police Transformation Programme between 2016/17 and 2019/20 and a further £2m in 2020/21 to the new Modern Slavery and Organised Immigration Crime Programme. star this property answer text <p>The UK Government is committed to tackling all forms of modern slavery and achieving Sustainable Development Goal (SDG) 8.7. We are taking active steps to identify and prevent modern slavery in government and partners' supply chains. In March 2020, we published the world's first Government Modern Slavery Statement, setting out steps taken to eradicate modern slavery from our supply chains.</p><p>The FCDO's Supply Partner Code of Conduct requires ODA-funded commercially contracted supply partners to go through a comprehensive code compliance process. This process considers supply chain risk and requires compliance with the Modern Slavery Act 2015. The FCDO is exploring applying the Code more broadly to other funded partners, such as accountable grants and Memorandum of Understandings. The FCDO encourages supply partners to use the Her Majesty's Government Modern Slavery Assessment Tool, which provides tailored recommendations to improve anti-slavery management and due diligence activity in their supply chains, including conducting risk assessments to reduce the risk of exploitation. From 2021, all Ministerial government departments, including the FCDO, will publish annual modern slavery statements, reporting on specific steps taken to tackle modern slavery in commercial supply chains.</p>

star this property answer text <p>Many British Embassies and High Commissions already have a focus on modern slavery including supply chain aspects where appropriate. This Government is committed to eliminating modern slavery from our communities and the global economy, and in 2019 appointed the UK's first International Modern Slavery and Migration Envoy to help drive forwards our efforts in partnership with other Governments and multilateral organisations. Section 54 of the Modern Slavery Act 2015 requires businesses to report on how they are tackling modern slavery in their operations and supply chains. Section 54 was designed to empower consumers, investors, civil society and others to scrutinise the action that businesses are taking to identify and address modern slavery in their supply chains.</p><p>The Government has committed to strengthening the legislation. Our response to the transparency in supply chains consultation, published on 22 September 2020, announced an ambitious package of changes to Section 54, including introducing specific reporting topics and requiring statements to be published by a single reporting deadline on a central Government-run registry, to enable the Government and others to continuously monitor compliance. In addition, the Government announced in the week of 11 January that it will introduce financial penalties for organisations that do not comply with the reporting requirements under the Modern Slavery Act. These measures require primary legislation and will be introduced when parliamentary time allows.</p>

star this property answer text <p>The UK is regarded as a world-leader for its response to modern slavery. The UK response is underpinned by the Modern Slavery Strategy 2014 and the Modern Slavery Act 2015, the first legislation of its kind. The Modern Slavery Strategy 2014 is structured around a ‘four Ps’ framework including a strategic pillar on prevent.</p><p>The Home Office continues to work with a range of partners to identify and deliver effective prevention activity. This included successful awareness raising initiatives such as the Government’s ‘Hidden in Plain Sight’ campaign, as well as training for frontline responders to better prevent and spot the signs of modern slavery. We also have a dedicated <a href="https://www.gov.uk/government/publications/modern-slavery-training-resource-page/modern-slavery-training-resource-page" target="_blank">GOV.UK</a> (<a href="https://www.gov.uk/government/publications/modern-slavery-training-resource-page/modern-slavery-training-resource-page" target="_blank">https://www.gov.uk/government/publications/modern-slavery-training-resource-page/modern-slavery-training-resource-page</a>) resources page that provides up-to-date information on how to spot the signs of modern slavery and report concerns.</p><p>In addition, HMG is investing £10m to fund Modern Slavery Policy and Evidence Centre to bring together and commission innovative research to enhance the evidence base on modern slavery, including on strengthening prevention initiatives.</p>

star this property answer text <p>The UK government is committed to tackling the heinous crime of modern slavery and is working in a number of ways, both in the UK and upstream, to prevent re-trafficking.</p><p>Support provided through the National Referral Mechanism for potential and confirmed victims of modern slavery identified in the UK aims to protect individuals from further harm and prevent possible re-trafficking.</p><p>In addition, the UK has strong relationships with a number of countries from where many victims originate and is working with them to provide a range of support for victims, including reintegration, as well as awareness raising and operational capacity building activity to prevent trafficking from occurring. star this property answer text <p>The Modern Slavery Act 2015 (Transparency in Supply Chains) Regulations set out the amount of total turnover for the purposes of making a commercial organisation subject to the Act’s Transparency in Supply Chains Provisions. The Regulations set the turnover threshold for commercial organisations required to report at £36m.</p><p>Under section 4 of the Regulations, the Secretary of State is required to carry out a review of the Regulations every five years.</p><p>The Government published a review of the current turnover threshold as part of the Government response to the Transparency in Supply Chains consultation, published on 22 September 2020.The review concluded that the £36m threshold remains appropriate and proportionate and also noted that the Independent Review of the Modern Slavery Act did not advise lowering the existing threshold, and instead recommended that Government focus on improving compliance, quality of reporting and enforcement at the current threshold.</p><p>The new Government modern slavery registry, which is due to launch this year, will enable Government to more effectively drive compliance, as well as incentivising more transparent and detailed reporting, by providing a dedicated platform for investors, consumers and civil society to view and compare statements published under the Act.</p>

star this property answer text <p>We have introduced a series of reforms to the National Referral Mechanism (NRM) since 2017 to improve the identification and support of potential victims of modern slavery.</p><p>To achieve quicker and more certain decision-making a new Single Competent Authority (SCA) was launched in April 2019 to handle all NRM cases and provide high quality, timely decisions for victims. Independent Multi-Agency Assurance Panels were also set up to review all negative conclusive grounds decisions on cases referred directly to the SCA, adding an additional level of scrutiny to such cases.</p><p>A new digital referral system was also launched in 2019 to support the NRM process, making it easier for those on the front line to refer victims into support by providing a single point for referrals across the UK.</p><p>In July 2020, the Home Office produced an e-learning module to help First Responders identify potential victims of modern slavery and make referrals into the NRM when appropriate to do so. We are committed to working with First Responder Organisations to ensure they have the right training and tools to identify potential victims.</p><p>Building on the successes of this work, we are now taking a fresh look at the system to ensure it delivers on its objectives through the NRM Transformation Programme. This Programme will introduce a series of changes to ensure victims have their cases settled promptly, receive support tailored to their recovery needs from the outset, and are empowered to move on with their lives. We also intend to streamline the decision-making process through operational improvements so that victims are identified at the earliest stage and receive the right kind of support at the right time, ensuring decisions taken are robust, effective and meaningful.</p><p>Additionally, we are seeking to test an alternative decision-making model for children, to empower local authorities with responsibility for children’s social care to make decisions about whether children are victims of modern slavery in conjunction with local safeguarding partners.</p>

star this property answer text <p>The landmark transparency provisions contained in section 54 of the Modern Slavery Act 2015 made the UK the first country in the world to require businesses with a turnover of £36m or more to report annually on the steps they have taken to prevent modern slavery in their operations and supply chains.</p><p>To enhance the impact of transparency and accelerate action to prevent modern slavery, the Government has committed to strengthening the reporting requirements contained in section 54, including by introducing financial penalties for those that fail to meet their statutory obligation to publish modern slavery statements. These measures require primary legislation and will be introduced when parliamentary time allows. The Government will publish guidance in line with the legislative timescales to help organisations prepare for the new reporting requirements.</p><p>In January 2021, the Foreign Secretary announced a package of cross-Government policy measures seeking to ensure that UK private and public bodies are not complicit in, nor profiting from, the human rights violations in Xinjiang. This included a review of export controls, to ensure we are doing all we can to prevent the export of goods that may contribute to human rights violations in Xinjiang. This review is ongoing and we will report its outcome to Parliament in due course.</p><p>The Government’s reasons for not taking forward the recommendation made by the Business, Energy and Industrial Strategy Committee were set out in our response to the Committee’s report, available at: https://committees.parliament.uk/committee/365/business-energy-and-industrial-strategy-committee/publications.</p>

star this property answer text <p>Section 54 of the Modern Slavery Act 2015 established the UK as the first country in the world to require businesses to report annually on steps taken to prevent modern slavery in their operations and supply chains.</p><p>In March 2021, the Government launched the modern slavery statement registry to radically enhance transparency by bringing together modern slavery statements on a single platform. So far, over 6,740 modern slavery statements covering over 22,400 organisations have been submitted to the registry on a voluntary basis.</p><p>In 2019, the Home Office contracted the Business &amp; Human Rights Resource Centre (BHRRC) to undertake an audit of compliance with Section 54 of the Modern Slavery Act 2015. The high-level findings of this audit were published on 17 September 2020 in the Independent Anti-Slavery Commissioner’s annual report (available on gov.uk)</p><p>To improve the quality of reporting and compliance even further, the Government has committed to introduce a package of measures to strengthen section 54. This includes the introduction of financial penalties for non-compliance and a requirement for organisations to publish their statements on the Government’s modern slavery statement registry which will enable Government to monitor and drive compliance with the legislation.</p><p>Businesses’ response so far is demonstrating the registry’s positive impact by providing greater visibility of the steps organisations are taking to prevent modern slavery in their global supply chains and empowering investors, consumers and civil society to scrutinise the action organisations are taking to prevent modern slavery.</p>

The Home Office publishes quarterly statistics regarding the National Referral Mechanism (NRM) which can be found at gov.uk.</p><p>The 2021 UK Annual Report on Modern Slavery has recently been published and contains an overview of key RNA trends for the year up to 31 July 2021. This report can also be found on gov.uk. The RNA process is kept under continual internal review. Our approach to victim support will be considered further as part of the 2014 Modern Slavery Strategy review which will be published next year.</p><p>There are 251.75 FTE decision makers working in the Single Competent Authority. There are 26.26 decision makers working within the Immigration Enforcement Competent Authority. Both Competent Authorities carry a number of vacancies being filled through recruitment activity.</p><p>All decision makers across both Competent Authorities will receive consistent training on NRM decisions, Modern Slavery Discretionary leave decisions (as relevant) and on current statutory guidance. star this property answer text <p>The Immigration Enforcement Competent Authority (IECA) will streamline decision-making and ensure, wherever possible, that the various factors which may be pertinent to decisions about an individual are taken by those who can consider their circumstances most fully.  IECA decision makers will receive the same training as the Single Competent Authority (SCA) on National Referral Mechanism (NRM) decision making.</p><p> </p><p>Both competent authorities will be held to account through existing quality assurance processes and the Multi-Agency Assurance Panels will continue to quality assure all negative conclusive decisions. Decisions will continue to be made in line with the definitions and standards of proof in the published Modern Slavery Statutory Guidance.</p><p> </p><p>The data on decisions taken by the IECA will be set out in the quarterly publication of NRM statistics and a breakdown by competent authority will be published once there is sufficient data to ensure individuals are not identifiable. Naturally, we will regularly review this data to understand the impact of the change and ensure polices are being applied consistently.</p><p> </p><p>This Government remains committed to identifying victims quickly, enhancing the support they receive and improving the training given to First Responders, who are responsible for referring potential victims into the NRM.</p><p> </p><p>The Home Office has produced e-learning to help First Responders to identify potential victims of modern slavery and make referrals into the NRM when appropriate to do so. The e-learning is available through the Modern Slavery Organised Immigration Crime (MSOIC) website.</p>

star this property answer text <p>At present there are no plans to introduce a Modern Slavery Risk Register. However, on 24 March 2021, the Government announced a review of the 2014 Modern Slavery Strategy. The review will consider all aspects of the 2014 strategy and the Government’s response, including our approach to supply chains.</p><p>In the meantime, to further enhance transparency, the Government launched an online GOV.UK registry for modern slavery statements. This service enables investors, consumers, NGOs and others to scrutinise the effectiveness of the actions being taken and monitor progress across sectors over time. Since launch, over 6,900 statements have been submitted covering over 23,000 organisations on a voluntary basis. In future, it will be mandatory for in scope organisations to submit their statement to the registry, as part of the planned changes to strengthen section 54 of the Modern Slavery Act.</p> more like this

The Government encourages companies to monitor their supply chains with rigour to uncover and remedy any associations they may find with forced labour or other labour abuses.</p><p>The Government has already committed to take forward an ambitious package of changes to strengthen the Act’s transparency legislation, including mandating the specific reporting topics that statements must cover and introducing financial penalties for organisations that fail to comply.</p><p>To further bolster our approach to modern slavery, on 24 March 2021, the Government announced a review of the 2014 Modern Slavery Strategy. As part of the strategy review we will consider how to strengthen our approach to transparency in supply chains, including in relation to financial institutions. A revised strategy will allow us to build on the considerable progress we have made to date, adapt our approach to the evolving nature of these terrible crimes, and continue our international leadership in tackling modern slavery.</p>

star this property answer text <p>It is a priority for this government to increase prosecutions of perpetrators of modern slavery and the measures included within the Nationality and Borders Bill are designed to support these aims.</p><p> </p><p>Through the Public Order Disqualification, we want to ensure the protection from removal and provision of support are not afforded to serious criminals and those who pose a national security threat, in line with our international obligations. Each decision is discretionary and will be taken on a case by case basis. This will mean that we do not lose the ability to provide a recovery period and/or make a conclusive grounds decision when it is beneficial to support prosecutions.</p><p> </p><p>The Slavery or Trafficking Information Notice under Clause 57 supports our aim to identify victims early and ensure they receive appropriate support, and therefore better able to assist with investigative and enforcement activities. All referrals will be appropriately considered regardless of when they are brought to make sure that those who need protection are afforded it.</p><p> </p><p>We are clear, that across both these measures, First Responders should still always refer victims into the National Referral Mechanism in line with Modern Slavery Statutory Guidance, using the online form even where the individual has had a previous recovery period or has a criminal conviction. In operationalising these clauses we will ensure this is abundantly clear.</p><p> </p><p>This Government’s commitment to supporting victims is precisely why the Nationality and Borders Bill also makes clear that, where a public authority is pursuing an investigation or criminal proceedings, confirmed victims who are co-operating in this activity and need to remain in the UK in order to do so, will be granted a form of temporary leave to support this crucial endeavour. These measures build upon support and investment to strengthen the police response to modern slavery, including initiatives to help victims engage in the criminal justice system so more offenders can face justice.</p>

star this property answer text <p>The landmark transparency provisions contained in section 54 of the Modern Slavery Act 2015 made the UK the first country in the world to require businesses with a turnover of £36m or more to report annually on the steps they have taken to prevent modern slavery in their operations and supply chains.</p><p>To enhance the impact of transparency and accelerate action to prevent modern slavery, the Government committed to strengthening the reporting requirements contained in section 54 and introduce new measures including financial penalties for organisations that fail to meet their statutory obligation to publish modern slavery statements. These measures require primary legislation and will be introduced when parliamentary time allows. The Government will publish guidance to help organisations prepare for the new reporting requirements when timings of legislation is clear.</p> more like this

star this property answer text <p>The Government is committed to delivering tailored, needs-based support to assist victims of modern slavery in their recovery.</p><p>The Recovery Needs Assessment (RNA) was introduced on 27 September 2019. Throughout the design and implementation of the Recovery Needs Assessment we engaged with our primary support provider, The Salvation Army, and our network of specialist support providers who work closely with victims on a daily basis.</p><p>We are committed to embedding survivor voice in our policy development. In 2020 we undertook work engaging with survivors directly, to better understand their recovery needs and their experiences of the National Referral Mechanism.</p><p>We are engaging with survivors, as well as the broader sector, on a new government strategy to tackle modern slavery, alongside ongoing work to improve the victim journey through the RNA process.</p> more like this

star this property answer text <p>The Government remains committed to tackling the scourge of modern slavery.</p><p>Directive 2011/36/EU on preventing and combatting trafficking in human beings and protecting its victims (the “EU Trafficking Directive”) was adopted on 5 April 2011.</p><p>The Nationality and Borders Act provides legislative clarity to victims and decision makers on victims’ rights, including the entitlement to a recovery period and the circumstances in which confirmed victims may be granted permission to stay.</p><p>Section 68 of the Nationality and Borders Act 2022 disapplied the EU Trafficking Directive insofar as it was incompatible with provisions made by that Act.</p><p> </p><p>The provisions in Section 68 aim to ensure that if there is any provision within the EU Directive that operates on the same subject as the Nationality and Borders Act 2022, whether support for victims or otherwise, there is no confusion as to which applies.</p><p>The Government believes that that if there is any provision within the Directive that operates on the same subject as the 2022 Act, whether support for victims or otherwise, it is right that people are not confused as to which applies. More broadly, the Government does not believe that any of the Directive’s provisions have been given direct effect by a domestic court and so does not have effect as retained EU law.</p><p>This provision does not result in a diminution below the standards laid down in the EU Trafficking Directive, nor does section 68 remove any entitlements from victims. This legal clarification will not have an impact on victim identification, protection and support provided through the National Referral Mechanism.</p>

star this property answer text <p>Section 65 of the Nationality and Borders Act confirms in primary legislation the provision of temporary permission to stay for confirmed victims of modern slavery where it is necessary, and unless relevant exemptions apply, to assist in their recovery from physical or psychological harm related to their exploitation, to enable them to claim compensation or to enable their co-operation in bringing their exploiters to justice. This will bring clarity to both victims and decision makers on when victims will and won’t be eligible for permission to stay.</p><p>We will keep the implementation of reforms in the Nationality and Borders Act 2022 under close review.</p><p>The government has completed a full economic and equalities impact assessment and we will review the impact of section 65 going forward where necessary.</p> more like this

star this property answer text <p>The hidden nature of modern slavery makes producing an accurate measure of its scale difficult.</p><p>In March 2020 the Office for National Statistics noted that there is no definitive source of data or suitable method available to accurately quantify the number of potential victims of modern slavery in the UK.</p><p> </p><p>The Government is, however, committed to improving its understanding of the nature and scale of this complex crime. Since 2019, the Government has invested £10 million in the creation of the Policy and Evidence Centre for Modern Slavery and Human Rights to transform our understanding of modern slavery. The Home Office will continue working with the Centre and other partners to strengthen the evidence base underpinning our policy and operational response to modern slavery and to develop more robust ways to assess prevalence.</p> more like this

star this property answer text <p>The Modern Slavery Unit has consulted with key stakeholders and modern slavery first responders throughout the development process for the updated Reasonable Grounds Statutory Guidance update.</p><p> </p><p>The updated Reasonable Grounds Guidance was published on 30 January 2023 as part of the Modern Slavery: Statutory Guidance for England and Wales (under s49 of the Modern Slavery Act 2015) and Non-Statutory Guidance for Scotland and Northern Ireland.</p><p> </p><p>This change in guidance builds on and simplifies much of the current guidance to ensure decision making at the Reasonable Grounds stage is robust and consistent while still providing scope to consider instances where a referral may be received with very little additional information.</p> more like this

star this property answer text <p>We are committed to ensuring that the National Referral Mechanism effectively supports genuine victims to recover from their modern slavery experience and to support the prosecution of their exploiters.</p><p> </p><p>Following a positive Conclusive Grounds decision, if a victim is being supported by the Modern Slavery Victim Care Contract, they will receive accommodation, financial support, and access to a support worker where necessary, until they no longer have a recovery need for this support, or until their recovery needs are met by alternative services.</p><p> </p><p>It is also a government priority to increase prosecutions of perpetrators of modern slavery. That is why we have made clear, for the first time in legislation, that where a public authority, such as the police, is pursuing an investigation or criminal proceedings, confirmed victims who are co-operating in this activity and need to remain in the UK in order to do so, will be granted temporary permission to stay if it is necessary for them to be in the UK to support the investigation.</p>

star this property answer text <p>The Government is committed to tackling modern slavery to ensure that victims are provided with the support they need to begin rebuilding their lives and that those responsible are prosecuted.</p><p>The Home Office continues to fund specialist support for adult victims of modern slavery in England and Wales through the £379 million Modern Slavery Victim Care Contract and for children, who receive support through local authority safeguarding structures, we are also continuing to work with Barnardo’s to provide additional and tailored support through the Independent Child Trafficking Guardian service.</p><p>Since 2016, in addition to core police funding, we have invested £17.8 million in the Modern Slavery and Organised Immigration Crime Unit, a specialist police unit which supports all police forces in England and Wales to improve their response to modern slavery.</p><p>In addition, between 2016 and March 2023, the Home Office spent over £40.4 million through the Modern Slavery Fund to combat modern slavery overseas and reduce the threat of human trafficking to the UK. We continue to work across operational partners and the sector to deliver on modern slavery.</p>

star this property answer text <p>The prevalence of modern slavery and complexity of global supply chains means that it is highly unlikely that any sector or company is immune from the risks of modern slavery. The Government encourages companies to report transparently about how they are mitigating modern slavery risks and to use their modern slavery statements to demonstrate year on year progress.</p><p> </p><p>Section 54 of the The Modern Slavery Act 2015 requires certain businesses in all sectors with a turnover of £36m or more (including within the arts, culture, entertainment industry) to report annually on the steps they have taken to prevent modern slavery in their operations and supply chains.</p><p>The transparency legislation was designed to enable consumers, investors and civil society to scrutinise business action. To improve the quality and detail of reporting and accelerate action to prevent modern slavery, the Government announced an ambitious package of changes to strengthen the reporting requirements on businesses and has committed to introduce financial penalties for those that fail to meet their obligations under section 54.</p><p> </p><p>In March 2021, the Government launched a digital registry for modern slavery statements which will enhance transparency by making statements available in one place for the first time. It will provide greater visibility of the steps organisations are taking to prevent modern slavery in their global supply chains and empowering investors, consumers and civil society to scrutinise action and monitor progress.</p><p> </p><p>These measures, including requiring organisations to publish their statement on the Government modern slavery registry, require primary legislation and will be introduced when parliamentary time allows.</p><p> </p><p>DCMS, along with other government departments, will be publishing its own Modern Slavery statement in September 2021. This will extend to our Arms Length Bodies that have a budget of at least £36m.</p><p> </p>

A First Responder Organisation (FRO) is an authority that is authorised to refer a potential victim of modern slavery into the NRM. Members of staff at those FROs have a responsibility for discharging one or more of the functions of the FRO, including recognising the indicators of modern slavery and identifying potential victims of modern slavery, and subsequently referring those potential victims into the NRM.</p><p>Decisions about who is then recognised and confirmed as a victim of modern slavery are made by trained specialists in one of the Home Office competent authorities (Single Competent Authority (SCA) and the Immigration Enforcement Competent Authority (IECA)).</p><p>The competent authorities’ assessment of whether an individual is a victim of modern slavery is two-stage process. A competent authority will first make a decision as to whether there is enough evidence available such that it ‘suspects but cannot prove’ that the individual is a victim of modern slavery. This is the reasonable grounds (RG) decision. Where a positive decision is issued the competent authority will then go on to gather further information about the case and then make a second decision on ‘the balance of probabilities’ whether that individual is a victim of modern slavery; this is the conclusive grounds (CG) decision.</p>

star this property answer text <p>The Home Office publishes quarterly and annual statistics regarding the National Referral Mechanism (NRM). These include the average time taken to make a Conclusive Grounds Decision. The latest published NRM statistics can be found here:</p><p><a href="https://www.gov.uk/government/collections/national-referral-mechanism-statistics" target="_blank">National Referral Mechanism statistics - GOV.UK (www.gov.uk)</a>.</p><p>As outlined in the Modern Slavery: Statutory Guidance for England and Wales (under s49 of the Modern Slavery Act 2015) and Non-Statutory Guidance for Scotland and Northern Ireland, the expectation is that the Competent Authority will make a Reasonable Grounds decision within five working days, where possible, of the NRM referral being received. There is no target to make a Conclusive Grounds decision within a specific timeframe. A decision can only be made fairly and reasonably once sufficient information has been made available to the Competent Authority for it to complete the decision. When the relevant Competent Authority has received sufficient information for it to complete a decision it should seek to do so as soon as possible but only once a minimum Recovery and Reflection Period has passed, unless the relevant Competent Authority has received a request to delay the decision.
