star this property answer text <p>Most often, a deputy is a close relative or friend of the person or a local authority which is working with them rather than a private sector deputy. Additionally, in cases where the assets are low, the Court of Protection may decide that a full deputyship is not even required and may grant a one-off order.</p><p>Professional private sector deputies are of course aware when they take up the role that costs are payable out of an estate and will be proportionate to the value of the assets to be managed. The role of a panel deputy is to take on cases where no other person is willing or able to act, including cases with low assets.</p><p>The Department is not aware of any impact on access to justice for vulnerable people who lack capacity due to the inability of the court to appoint a family member, friend, professional private sector deputy or panel deputy to manage their affairs. Consequently, no specific assessment has been made.</p><p>Legal aid is available for advice and assistance under the Mental Capacity Act 2005 subject to the applicant passing the legal aid means and merits tests. Legal Aid is not available for the ongoing costs of a professional private sector deputy.</p>

star this property answer text <p>HMCTS and the MOJ have been working together to pilot new, digital ways of working in the Court of Protection that could streamline processes and remove both administrative and procedural delay. Emphasis has also been placed on increased digital working, to increase efficiency and facilitate remote working for both Court users and Court staff. These pilots are still in their early stages.</p><p>A digital upload pilot that commenced in April enables professional users to submit their Property and Affairs deputyship applications online. Over 200 applications have now been issued through this pilot, which has enabled orders, in non-contentious cases, to be made within weeks of the application being received.</p><p>A second pilot is being developed to encourage applicants to notify parties upfront. This will remove delays in waiting for responses and enable non-contentious cases to be dealt with in a more timely and efficient manner.</p><p>In addition, this month a new centralised team will be created at the Court of Protection, called the ‘Orders Hub’, to focus specifically on orders and process them more efficiently. Staff will be provided with targeted training to increase their expertise, tasks will be completed in tandem to reduce the time taken and areas of improvement will be identified to allow changes to be implemented. This will enable court orders to be issued quicker, and some within days of receipt</p>

star this property answer text <p>Whilst there are no plans to publish anything further on this, the ongoing improvements of the online property and affairs applications process at the Court of Protection are iterative and include ongoing development of the online applications process, user testing, reviewing and revising the court forms and supporting guidance and clearer information on Gov.UK. Forms required for paper applications are also under review and revision.</p><p> </p><p>Initial improvements were rolled out for all court users in February 2023, resulting in application waiting times being reduced from 24 weeks to 8 weeks.</p> more like this

In cases of emergency the court is able to provide a decision within 24 hours.</p><p>The online process for property and affairs applications was made available to all court users in February. We continue to review and revise the process and the court will continue to identify areas to simplify and remove duplication on court forms, including uploading to the online process many of the forms required for a property and affairs applications. To date, there have been no discussions between the Secretary of State and other Cabinet colleagues on allowing access to Child Trust Funds using DWP Appointee status as a proxy for approval as discussions have remained at policy official level.</p> more like this

star this property answer text <p>The Government is committed to addressing barriers to provide better support to all individuals who lack mental capacity.</p><p>For example, the Court of Protection has reviewed its application processes, and at the beginning of the year launched a new, simpler online system which has reduced wating times from 24 weeks to 8 weeks following the results of a successful pilot. We have also recently published new guidance for families on how to make financial decisions on behalf of a young person who lacks mental capacity, which includes a guide to the Court of Protection application process. Families may also now be eligible for a fee remission for their applications, even after their child has turned 18.</p><p>We will continue to review and revise the process and the court will continue to identify areas for improvement.</p> more like this
