star this property answer text <p>The table below shows the approximate full time equivalent (FTE) staff in Operational Appeals and Reviews Unit on 31 March for each financial year since 2010.</p><p> </p><p>Before April 2016, appeals and reviews were carried out in a number of teams across HMRC. The figures for 2012/13 to 2015/16 are in respect of the Appeals and Review Unit attached to our Compliance Business. HMRC does not have numbers for the other teams that carried out appeals and reviews. From April 2016 HMRC took the decision to brigade all appeals and reviews work and bring them into its Solicitors Office and Legal Services. star this property answer text <p>The purpose of penalties is to encourage taxpayers to comply with their obligations, act as a sanction for those who do not and to reassure those who do comply that they will not be disadvantaged by those who do not. Penalties are not used as a revenue-raising mechanism.</p><p> </p><p>Parliament determines the laws relating to tax and to whom they apply. HMRC apply those laws fairly and do not discriminate between different taxpayers or size of business.</p><p> </p><p>HMRC can apply a large number of different penalties, but they break down into three broad areas:</p><p> </p><p>• Automatic penalties for failure to meet a time-bound obligation, such as submitting returns or making payments by a specified deadline;</p><p> </p><p>• Penalties for failure to meet a regulatory obligation, such as the requirement to keep certain records; and</p><p> </p><p>• Behaviour-based penalties for inaccurate returns and documents and failure to notify taxable status.</p><p> </p><p>A penalty is not payable if a person had a reasonable excuse for failing to meet an obligation or took reasonable care to avoid submitting an inaccurate return.</p><p> </p><p>HMRC does not record data on penalties issued by size of business.</p>

Before a GAAR penalty can be charged, HMRC must first enquire into tax returns once they are received and gather all relevant facts.</p><p> </p><p> </p><p>Whilst no penalties have been charged to date, HMRC is actively using the GAAR to tackle tax avoidance. To date, all cases referred to the GAAR Advisory Panel have resulted in a Panel opinion in HMRC’s favour.
