star this property answer text <p>Section 3 of the Road Traffic Act 1988 creates the offence of driving a mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration for other persons using the road or public place. The Crown Prosecution Service (CPS) does not maintain a central record of the number of defendants charged with, or prosecuted for these offences. This information could only be obtained by examining CPS case files, which would incur disproportionate cost.</p><p>As Section 3 of the Road Traffic Act 1988 is a specified offence large numbers of careless driving offences are charged and prosecuted by the police with no involvement from the CPS. The CPS only become involved if the defendant pleads not guilty to the offence after which, CPS prosecutors take responsibility for reviewing the case and preparing the trial. Figures on the number of people prosecuted and the outcome of the prosecution of careless or inconsiderate driving offences may be obtained from the official statistics held by the Ministry of Justice.</p><p>The CPS does however maintain records of the number of offences in which a CPS prosecution commenced, including offences of careless or inconsiderate driving. star this property answer text <p>The Government believes that any form of anti-social, dangerous or inconsiderate driving behaviour is a serious road safety issue.</p><p>Enforcement of road traffic law and how available resources are deployed is the responsibility of individual Chief Officers and Police and Crime Commissioners, taking into account the specific local problems and demands with which they are faced.</p><p>The Government will continue to support the police to ensure they have the tools needed to enforce road traffic legislation, including in relation to the offence of driving through red lights and other forms of dangerous driving.</p> more like this

star this property answer text <p>In accordance with the principle of open justice, defendants in criminal cases are not granted automatic anonymity, for any offence, if they are over the age of 18. The court has the power to grant discretionary reporting restrictions to prevent the name of the defendant being published in exceptional circumstances; this would be considered if revealing the identity of the defendant would pose a real risk to the administration of justice. The Government is not considering granting defendants automatic anonymity.</p><p> </p><p>However, suspects who have not yet been charged with a criminal offence should not be routinely named. The identity of a suspect should only be released if there is a compelling reason to do so, for example if they pose a risk to the public.</p><p> </p><p>The majority of support services for victims of crime are provided or commissioned by Police and Crime Commissioners through grant funding provided by the Ministry of Justice. This includes services to support the bereaved families of victims of road crime.</p>

The Department has also responded to one petition and Ministers have held one meeting with the family of a victim and their Member of Parliament.</p><p>If you write to Baroness Vere, the Minister responsible for this policy area, she would be happy to consider meeting with you to discuss this issue.</p> more like this
