There are no categories of statutory excuse.</p><p>The civil penalty regime and right to work checks are set out in the Immigration, Asylum and Nationality Act 2006, secondary legislation and published statutory codes of practice and guidance.</p> more like this

star this property answer text <p>There are currently no plans to change the way data is collected that would allow information about compensation awarded to victims of modern slavery to be identified. As explained in my earlier response of 17 September the Criminal Injuries Compensation Authority (CICA) cannot provide data on the compensation it has awarded to victims of a particular crime type. This is because it awards compensation in line with the Criminal Injuries Compensation Scheme tariff of injuries rather than the type of incident that led to those injuries. The Modern Slavery Act 2015 makes both modern slavery offences - slavery, servitude and forced labour and human trafficking - “criminal lifestyle” offences, making perpetrators subject to the most robust confiscation regime available under the Proceeds of Crime Act 2002 (POCA).</p> more like this

star this property answer text <p>The information is not readily available and could only be obtained at disproportionate cost.</p><p>For the future, the Government intends that Tier 2 should be restricted to roles where there are genuine skills shortages or which require highly-specialised experts. We asked the Migration Advisory Committee (MAC) to advise on how to achieve this, but with sufficient flexibility to include high value roles and key public service workers. The MAC has now submitted its advice and the Government is considering the report carefully.</p> more like this

star this property answer text <p>The Government’s position on the Stephen Shaw review was set out in the Written Ministerial Statement laid on 14 January 2016.</p><p>The Government accepts the broad thrust of Mr Shaw’s recommendations. In particular the Government accepts Mr Shaw’s recommendations to adopt a wider definition of those at risk, including victims of sexual violence, individuals with mental health issues, pregnant women, those with learning difficulties, post-traumatic stress disorder and elderly people, and to recognise the dynamic nature of vulnerabilities. We will introduce a new “adult at risk” concept into decision-making on immigration detention with a clear presumption that people who are at risk should not be detained, building on the existing legal framework.</p><p>A more detailed mental health needs assessment in immigration removal centres, using the expertise of the Centre for Mental Health, will be carried out and is expected to report in March 2016. NHS commissioners will use that assessment to consider and revisit current provision to ensure healthcare needs are being met appropriately. The Government will also publish a joint Department of Health, NHS and Home Office mental health action plan in April 2016.</p><p>We will also be considering a number of operational recommendations made by Mr Shaw, on a case by case basis, taking account of available resources.</p>
