star this property answer text <p /> <p>From April 2010 Local Criminal Justice Boards (LCJBs) took responsibility for the governance and performance management of the 143 accredited Specialist Domestic Violence Courts (SDVCs) across England and Wales. As of March 2014 there were 137 accredited SDVCs. However, the closure of SDVCs in some areas does not necessarily mean that provision in that area has ceased, as many of the SDVC systems cover a number of courthouses. Closure of an SDVC in one courthouse would simply mean that the case would be heard in another accredited courthouse within the Local Justice Area.</p><p> </p><p>HMCTS remains committed to a partnership approach to supporting domestic violence victims going through the Criminal Justice Process.</p> more like this

star this property answer text <p /> <p>Question 213688 was answered on 8 January 2015 but I have reproduced it here, for ease.</p><p> </p><p>Without incurring disproportionate cost it is not readily possible to distinguish those judicial review cases which were successfully brought against specific policies or measures from the total number of judicial review cases which were successfully brought against the Ministry of Justice.</p><p> </p><p>My letter dated 7 January 2015 answering Question 211301 (which can also be found in the Libraries of the Houses and on www.parliament.uk) sets out the numbers of judicial review cases successfully brought against the Ministry of Justice in each year from 2010 to 2012.</p> more like this

star this property answer text <p /> <p>(a) Expenditure for external contractors is aligned within the Ministry of Justice to that of Cabinet Office Controls. Contractors are sourced via Pan Government contractual arrangements and rates are set by the contract in line with contractors experience and the job role required. Contractors are not able to charge more for their services than the initial price agreed at time of appointment. Pan Government arrangements date back to 1/4/11 and no information prior to this date is available.</p><p> </p><p>(b) Since May 2010 there have been around 70 contracts awarded by The Ministry of Justice to provide the provision of consultancy.</p><p> </p><p>To establish whether a consultancy company have charged more than the initial price agreed for their services we would need to interrogate both the files and companies to obtain the information required and then review and collate that information. By doing so we would incur disproportionate costs in answering this question.</p><p> </p><p>Temporary staff and consultants are only used to fill business critical posts and provide essential services where they can provide a fast, flexible and efficient way to obtain necessary skills that are not currently available in house.</p>

star this property answer text <p /> <p>A bank may permit an executor to withdraw money from the deceased’s bank account before probate is granted. However, the bank in question will be liable to the deceased’s estate if it releases funds to the wrong person. star this property answer text <p /> <p>Bail and remand decisions are quite rightly for the courts to make, based on the facts of the particular case.</p><p> </p><p>In making remand decisions, courts must balance the risk that release on bail might pose to the public or to the administration of justice, against the detention of a person who may prove to be innocent. star this property answer text <p /> <p>Civil legal aid is available to help victims of human trafficking in relation to applications for leave to enter or remain in the UK, and also for claims for damages or under employment law brought by victims of human trafficking arising in connection with their exploitation. These services are set out in paragraph 32 of Schedule 1 to the Legal Aid, Sentencing and Punishment of Offenders Act 2012. Victims of human trafficking are also able to apply for any other civil legal aid service for which they are eligible.</p><p> </p><p>The Legal Aid Agency does not routinely collect information on the circumstances of applicants for legal aid, except where this is directly relevant to the application. This includes whether or not applicants are victims of human trafficking, which was not relevant to any legal aid applications before the introduction of LASPO or for services other than those described under paragraph 32 of Schedule 1 to LASPO since. Data is being collected on services provided under paragraph 32, but due to the length of time it takes for cases to conclude, we do not have a clear picture of funding since implementation of LASPO. As a result, it is not possible accurately to estimate the total cost of enabling victims of human trafficking to access legal aid for the period requested.</p>

Analysis across the department is currently underway which is seeking to improve data quality and establish a robust methodology to identify parties at court without legal representation.</p><p> </p><p>I expect to be able to write to the Rt Honourable Member in the New Year.
