star this property answer text <p>The Government has recently strengthened the National Planning Policy Framework (NPPF) to improve consideration of cycling and walking within local development plans. The revised NPPF recommends that planning policies should provide for high quality walking and cycling networks and supporting facilities such as cycle parking, drawing on Local Cycling and Walking Infrastructure Plans (LCWIPs).</p><p> </p><p>The NPPF also states that the environmental impacts of traffic and transport infrastructure should be identified, assessed and taken into account from the earliest stages of plan-making, including appropriate opportunities for avoiding and mitigating any adverse effects, which might include, for example, ensuring that new roads make adequate provision for those who cycle and walk.</p><p> </p> more like this

star this property answer text <p>It is right that developers are required to mitigate the impacts of development, and pay for the cumulative impacts of development on the infrastructure in their area.</p><p>Section 106 planning obligations (s278 in the case of highway requirements) are negotiated legal agreements between developers and local authorities. They are used to make development acceptable through delivery of affordable housing or infrastructure, or requiring development to be used in a particular way, and can be used to specify at what point in the development the infrastructure must be completed.</p><p>The planning reform package, which includes the revised draft National Planning Policy Framework (NPPF) and the reforms to developer contributions, are fundamental to delivering the homes we need and set out a comprehensive approach to ensure that we get the right homes built in the right places of the right quality.</p><p>The reforms to developer contributions could provide a springboard for going further, and the Government will continue to explore options to create a clearer and more robust developer contribution system that really delivers for prospective homeowners and communities accommodating new development.</p>

star this property answer text <p>This scheme was procured through a one-off Design and Build contract and Highways England has taken the lessons learnt into all such future schemes to ensure that such difficulties are not replicated.</p><p> </p><p>A pain-gain share mechanism was part of this contract, so the contractor suffered significant losses as a result. Highways England did not issue a ‘Consult Notice’ to the contractor following this scheme, meaning that they did not terminate any forthcoming contracts as a direct result of the contractor’s performance.</p> more like this

star this property answer text <p>Highways England who is responsible for the strategic road network do not hold the information centrally of how many buried bodes have been removed in the last five years from their lawful place of burial to facilitate the development of highway work and collating it would incur disproportionate cost. For local roads, the Department for Transport does not hold any records as this is a matter for each local highway authority.</p><p> </p><p>When dealing with human remains, highway contractors are required to comply with their legal obligations, including provisions through the 1857 Burial Act (as amended) and relevant requirements under ecclesiastical law.</p><p> </p><p>Where any remains are located in consecrated ground, the contractor must ensure that permissions to undertake the works are granted under ecclesiastical law through either a Faculty or a Pastoral Scheme.</p><p> </p><p>For non-consecrated ground, the contractor must have a licence issued through the Ministry of Justice. Specific requirements or directions issued under any such permission must be adhered to by the contractor, including any measures required by the local Environmental Health Officer or Public Health England for the protection of site workers or the public.  Prior consultation with the relevant authorities (e.g. church/Diocese, Ministry of Justice) is required prior to application for any permission, including details on the proposed extent and exhumation methodology; treatment of remains and artefacts; and planned reburial of remains.</p><p> </p>
