star this property answer text <p>I recognise the international importance of the HS1 network in allowing high-speed rail services from London to reach Europe, whilst noting that no international services currently serve Stratford International station.</p><br /><p>Eurostar, in which the government recently sold its 40% stake, accesses the HS1 network on an open access basis and is not subject to the terms of a franchise agreement or a contract let by government. Government has no power to direct or specify that Eurostar stops at Stratford International station. A decision made by Eurostar not to serve Stratford International would be as a result of commercial imperatives and priorities, for example, the potential revenue derived from customers using the station or the increased journey time which a further stop would involve. It would not be appropriate for government to interfere with that decision-making process.</p> more like this

star this property answer text <p>It is vital that the police reflect the communities they serve and I am determined to improve Black and Minority Ethnic (BME) representation in all 43 forces in England and Wales.</p><p>A number of police forces are currently recruiting officers. Decisions on when and how to recruit individuals are for the chief officer of a police force. It is important that they use equalities legislation, including positive action provisions, to make better progress in terms of recruitment of under-represented groups.</p><p>This Government's reforms have already made improvements, for example we set up the College of Policing which has embarked on a major programme of work, BME Progression 2018, looking at recruitment, retention and progression of black and minority ethnic officers, including the development of an evidence base of successful approaches used by forces.</p><p>As part of this programme the College recently published Positive Action Practical Advice, which advises forces on the use of lawful positive action to support the recruitment, retention and progression of officers from under-represented groups.</p><p>Also, under this Government innovative schemes such as Direct Entry and Police Now are increasing the number of BME recruits to the police, showing that you can achieve better representation while attracting the best and the brightest into policing.</p><p>Of the nine direct entry superintendents who began their superintendent training four (44%) are women and two (22%) are from an ethnic minority background. This is significantly more representative than the current make up of the superintendent rank which is comprised of 17% women and 4% from an ethnic minority background.</p><p>Police Now, an innovative graduate scheme implemented in the Metropolitan Police, received such a high calibre of applicants that it made provisional offers to 79 individuals, up from an anticipated 50. Of these, 16% per cent are from a BME background as compared to the Metropolitan Police’s current BME officer make up of 11%, and the national police BME proportion of 5.2%.</p><p>The Metropolitan Police also introduced its London residency criteria for recruits in August 2014 since when the proportion of BME applicants has risen to approximately 40%, a percentage which now matches the BME population of London.</p><p> </p>

star this property answer text <p>We are testing the Airports Commission’s work on air quality further against the Government’s new air quality plan, as recommended by the Environmental Audit Committee. This is additional work to test compliance, and build confidence that expansion can take place within legal limits. The further work on air quality is only one element of a wider package of further work.</p><p> </p><p>We are dealing with concerns about noise to get the best outcome for residents, and doing more work on carbon to address concerns on sustainability, particularly during construction. We want to make sure that communities get the best possible mitigation deal.</p><p> </p><p>In addition, we are doing due diligence on the plans for surface access to the airports by talking to both the promoters and the key delivery bodies.</p><p> </p><p>We are also carrying out extra assurance to assess the runways’ potential both locally and nationally so it can deliver more jobs, more growth and more apprenticeships.</p><p> </p><p>On funding and financing, the Airports Commission has provided an extensive examination of the costs, financing, and commercial viability of airport expansion. The Airports Commission and the scheme promoters have made it clear that new runway capacity will be privately delivered and financed.</p><p> </p><p>We anticipate that all this further work will conclude over the summer.</p><p> </p>

star this property answer text <p>The deadline for 2015 Basic Payment Scheme (BPS) payments remains 30 June 2016 and as stated in the response of 17 June, this is the deadline the Rural Payments Agency was working towards for the remaining top up BPS payments. On 8 June, Commissioner Hogan confirmed his intention to extend the date by which Member States may make CAP direct payments without the usual reductions in the rate of reimbursement from the EU to the Member States concerned. This does not constitute an extension to the payment window. It means that, subject to a successful request, payments can continue to be made after 30 June without the application of the usual reductions for late payments on the Member State.</p><p> </p><p>We are currently assessing the UK position in terms of the value of payments made by 30 June and the expected value of payments to be made before 15 October for each of the four UK paying agencies. Once this assessment has been completed we will be in a position to decide whether the UK needs to submit a request to the Commission for such penalties to be waived.</p><p> </p>

It is therefore not always possible to compare smoking prevalence rates directly between countries. In contrast, Joossens and Raws’s Tobacco Control Scale in Europe, which ranks the United Kingdom as number one in tobacco control activity of 34 European countries, uses a set criteria to assess the implementation of tobacco control policies across European countries, enabling a direct comparison to be made between the countries of tobacco control measures.</p><p><strong> </strong></p> more like this

star this property answer text <p>The Department assesses the impact of tobacco control measures on an ongoing basis as it develops policy and considers new measures.</p><p> </p><p>In September 2013, the Department published <em>An Audit of the impact of the Department of Health’s Regulations upon business</em>. A copy of the report is attached. The Audit report covered all regulations for which the Department has responsibility believed to have a potential cost to business, including those relating to tobacco control.</p><p> </p><p>Costs and benefits were estimated where possible using standard government methodology and the impacts to society were estimated based on economic costs and benefits. As advised in the report, there is a robust cost-benefit case for the tobacco control regulations considered and experience shows that initiatives to reduce smoking prevalence work best in combination, with cumulative effects over time.</p><p> </p> more like this

star this property answer text <p>The Rural Payments Agency (RPA) achieved the target of making the majority of BPS payments in December 2015, paying 44,408 (50.9%) of eligible claims by the end of December. The agency also delivered on its target of making the vast majority of payments by end of January, paying 66,800 (77%) of eligible claims with a value of around £1bn.</p><p> </p><p>The Government understands the importance of BPS payments for farmers. The targets, ‘majority’ and ‘vast majority’, were established in line with the RPA’s priority to pay as many farmers as possible, as quickly as possible, from the opening of the payment window back in December.</p><p> </p> more like this

star this property answer text <p>In March 2012, my Department received initial expressions of interest from 151 lead local authorities, which resulted in bids from 113 local authorities. Some local authorities submitted multiple expressions of interest which were consolidated before final bid stage. The final bids were then assessed in line with the published criteria, and recipients then awarded funding.</p><p>A detailed table listing the schemes that are being supported is attached and on my Department’s website.</p><p> </p><p>It may be helpful to the noble Lord to outline what this Government has delivered since 2010:</p><p> </p><ul><li>Safeguarded weekly collections for 6 million households through the Weekly Collection Support Scheme as well as championing innovation and best practice; the answer of 14 May 2014, <em>Official Report</em>, House of Commons 646W, outlined how 14 million households in England have some form of weekly collection of smelly rubbish.</li></ul><p> </p><p> </p><ul><li>Issued the first ever Whitehall guidance on weekly bin collections, demolishing the myths that fortnightly bin collections are needed to save money or increase recycling. This best practice was directly informed by the Weekly Collections Support Scheme;</li></ul><p> </p><p> </p><ul><li>Supported over 40 innovative reward schemes to back recycling through the Weekly Collection Support Scheme (as pledged in the Coalition Agreement); the winning bids for a further Recycling Rewards Scheme for 2015-16 will be announced shortly;</li></ul><p> </p><p> </p><ul><li>Stopped the Audit Commission inspections which marked down councils who do not adopt fortnightly rubbish collections, and rejected the Audit Commission guidance which advocated fortnightly collections (“Waste Management: The Strategic Challenge and Waste Management Quick Guide”);</li></ul><p> </p><p> </p><ul><li>Abolished the Local Area Agreements and National Indicator 191 imposed by Whitehall which created perverse incentives to downgrade waste collection services;</li></ul><p> </p><p> </p><p> </p><ul><li>Scrapped the Whitehall requirement for municipal Annual Efficiency Statements, which allowed a reduction in the frequency of a household rubbish collection service to qualify as a “valid efficiency” and allowed revenue from bin fines to classed as a “cashable efficiency gain”;</li></ul><p> </p><p> </p><p> </p><ul><li>Scrapped the imposition of eco-towns which would have had fortnightly bin collections and/or bin taxes as part of the “eco-standards”;</li></ul><p> </p><p> </p><p> </p><ul><li>Through the Localism Act, revoked the 2008 legislation that allowed for the imposition of new bin taxes;</li></ul><p> </p><p> </p><p> </p><ul><li>Issued guidance to stop the imposition of illegal ‘backdoor bin charging’ on households bins;</li></ul><p> </p><p> </p><p> </p><ul><li>Stopped funding the ‘Waste Improvement Network’ which told councils to adopt fortnightly collections as best practice;</li></ul><p> </p><p> </p><p> </p><ul><li>Challenged the incorrect interpretation by some bodies that European Union directives require fortnightly collections, and resisted the imposition of bin taxes by the European Union;</li></ul><p> </p><p> </p><p> </p><ul><li>Removing powers of entry and snooping powers from bin inspectors and scrapped guidance telling councils to rifle through families’ bins;</li></ul><p> </p><p> </p><p> </p><ul><li>Changed building regulations and planning guidance to tackle ‘bin blight’, and worked with the NHBC Foundation to produce new best practice guidance for house builders;</li></ul><p> </p><p> </p><p> </p><ul><li>Changing the law through the Deregulation Bill to scrap unfair bin fines.</li></ul><p> </p><p> </p><p> </p><p>Without our active support, Ministers are clear that weekly collections would have disappeared across England. This Government’s approach can be contrasted with the devolved Labour-led Administration in Wales, where fortnightly bin collections are official policy, and pilots of monthly bin collections are being actively encouraged.</p>

star this property answer text <p>As part of the mental health parity of esteem requirement for 2015-16, clinical commissioning groups (CCGs) were asked to plan for an increase in spend on mental health services at least in line with the increase in their overall funding allocation for the year, which set a higher bar than achieving a real terms increase in spending, though not all CCGs were able to achieve this target. 192 of the 209 CCGs achieved a real terms growth in mental health planned spend measured against the 1.4% Gross Domestic Product (GDP) deflator for 2015-16.</p><br /><p>The list attached shows which CCGs have achieved real terms increases in spending on mental health in 2015-16.</p><br /><p>The final data for CCGs’ spending on mental health in 2015-16 will be submitted to NHS England by commissioners in May 2016, and it is anticipated NHS England may be in a position to provide final spend information by around the end of the first quarter of 2016-17.</p><br /><p>NHS England has not yet published CCG planning guidance for 2016-17. Consideration will be given to holding commissioners to account for spending on mental health.</p><br /><p>CCG and NHS England mental health spending information is now routinely collected as party of NHS England’s monthly financial reporting regime. Monthly financial reports by CCGs are scrutinised and quality assessed by NHS England’s regional teams. The monthly reports also form part of the CCG assurance process. NHS England is also in the process of setting up the financial plan assurance process for 2016-17, which will incorporate the review of planned spending on mental health services for future years.</p>

Late claims submitted within the next 25 days are subject to a penalty of 1% of the claim for each working day’s delay. Claims already submitted by 15 May can be adjusted after that in some circumstances. We expect that the Rural Payments system, and our provision of support to those who may face any difficulty in applying online, will ensure that all farmers have every opportunity to claim their direct payments by 15 May. Emerging figures for police forces for 2014-15 appear to be continuing this downward trend.</p><p> </p><p> </p><p> </p><p>The police have told us that between the six months of April and September this year there have been 2,282 such cases – which, if maintained over the rest of the year, would result in a further 24% decrease in use of cells over last year. At the same time the use of health-based places of safety increased by 3,019 uses between 2012-13 and 2013-14.</p><p> </p><p> </p><p> </p><p>This puts us well on track to achieve our aim of reducing the 2011-12 figure of 8,667 uses of police cells by half in 2014-15.</p><p> </p><p> </p><p> </p><p>In February, we published a Crisis Care Concordat to make sure people in crisis get the help they need. All localities are working to complete local crisis declarations agreed by all the local relevant agencies, by the end of the year.</p><p> </p><p> </p><p> </p><p>In conjunction with the Home Office, the Department of Health has conducted a review of section 135 and section 136 of the Mental Health Act 1983. This is due to report shortly.</p><p> </p><p> </p><p> </p><p>The new Children and Young People's Mental Health and Well-Being Taskforce will also be looking at the issue of under 18s being detained in police custody as part of its Access and Prevention work.</p><p> </p>

star this property answer text <p>The maintenance and repair of a block of flats containing leasehold properties is normally the responsibility of the landlord and will be set out under the terms of the lease. This responsibility can pass to a Right to Manage Company where leaseholders have exercised and acquired that right, allowing them to exercise direct control over how their block is maintained.</p><p>Landlords, or those who have acquired the Right to Manage, have a contractual obligation under the terms of the leases to carry out necessary works to the properties that they are responsible for maintaining. Where works are suggested by a majority of leaseholders that are not essential to the repair or maintenance of the property, we would expect landlords to engage with their leaseholders to discuss the feasibility of the suggested works, but there are no plans to legislate to obligate landlords to carry out such work.</p><p>There are also no plans to legislate to provide a limited time within which non-resident leaseholders who fail to respond to a proposal for qualifying works, are deemed to have agreed to the proposed works. The statutory consultation process (known as section 20) gives leaseholders the ability to have a greater say on proposed works to their property by making observations. It does not require leaseholders to make observations, but any observations that are made must be made within a specified time limit. The landlord (or Right to Manage Company) is therefore in the knowledge that subject to observations made, they are able to proceed with necessary works.</p><br />

This is supported by our intention to create a £1 billion Brownfield Fund to unlock homes on brownfield land. Where works are suggested by a majority of leaseholders that are not essential to the repair or maintenance of the property, we would expect landlords to engage with their leaseholders to discuss the feasibility of the suggested works, but there are no plans to legislate to obligate landlords to carry out such work.</p><p>There are also no plans to legislate to provide a limited time within which non-resident leaseholders who fail to respond to a proposal for qualifying works, are deemed to have agreed to the proposed works. The statutory consultation process (known as section 20) gives leaseholders the ability to have a greater say on proposed works to their property by making observations. It does not require leaseholders to make observations, but any observations that are made must be made within a specified time limit. The landlord (or Right to Manage Company) is therefore in the knowledge that subject to observations made, they are able to proceed with necessary works.</p><br />

This includes training on sexual violence and gender issues.</p><p>UK trainers have also delivered training to coalition partners' training teams within the Building Partner Capacity site at Erbil. This includes German, Norwegian, and Italian trainers. All UK trainers deployed to Iraq are now trained to deliver PoC training prior to leaving the UK.</p> more like this

star this property answer text <p>Communications between Her Majesty’s Government and Lancashire County Council have been carried out in accordance with the “Guidance on Planning Propriety Issues” published by the Department for Communities and Local Government in February 2012. The merits of the planning applications at Roseacre Wood and Little Plumpton have not been discussed.</p><p>Officials from the Department for Communities and Local Government communicated with officials from Lancashire County Council by telephone and by e-mail in September and October 2014 to obtain factual information on the total number of representations received in relation to, and the local authority’s intended timescales for decisions on, both planning applications. Two communications were held on 20 January between officials from the Department and the local authority. One, by telephone between the Chief Executive of the local authority and the Permanent Secretary, was to inform the department of the officer recommendations that would be in the reports to be published at 9.00am the following day. The other was an e-mail from Lancashire County Council to advise when the reports would be published and where they would be made available on their website.</p><p>In developing part of the £5 million Government shale support package that was announced in the Autumn Statement 2014, there were also telephone conversations between officials, one in December 2014 and one in January 2015, to try and identify areas where local authority resources come under most pressure when processing these type of applications.</p><p>On 3 November 2014, Department of Energy and Climate Change (DECC) officials wrote to Lancashire County Council to provide comments on the relevant aspects of DECC’s regulatory role that might be helpful in considering the applications. On 17 November 2014, 19 January 2015 and 26 January 2015, DECC officials wrote two letters and an email in response to specific requests from Lancashire County Council officials, seeking views from DECC on certain comments received in the public consultation on the planning applications. DECC’s responses addressed only matters which fall under DECC’s regulatory responsibilities.</p><p>The Minister of State, Matt Hancock, met with the deputy leader of Lancashire County Council on 12 November 2014, as part of a regional visit. This meeting did not discuss the merits of the planning applications. A meeting with officials to follow up was arranged (by email and telephone) for 14 January but after further consideration was postponed until after the planning decisions.</p><p>A DECC official was invited to attend the meetings of the development control committee considering the planning applications on 28 and 29 January, to advise if necessary on DECC’s regulatory responsibilities. After due consideration of this request, DECC officials confirmed on 27 January that they would not attend.</p><p>The Director of Public Health at Lancashire County Council wrote to DECC in January asking for comments on the Health Impact Assessment, and DECC officials replied on 20 January to say they could not respond ahead of the Council’s decisions.</p>

However, young drivers are disproportionately involved in collisions.</p><p> </p><p>There is a difficult balance to strike between promoting young drivers safety and their freedom to access work and education.</p><p> </p><p>We won’t rule out further measures, but at present we are focussing our efforts on technological solutions.</p><p> </p><p>We commissioned research into how telematics can reduce accident rates among young drivers and the findings will help to shape future road safety policy. A description of the research requirement has been placed in the Libraries of both Houses.</p><p> </p><p>We expect phase one to be completed in April 2015. The Secretary of State is required to meet the reasonable fluoridation capital and operating costs incurred by water undertakers in England and has the power to require local authorities to make payments to the Secretary of State to meet any such costs he has incurred. There are no proposed changes to the legislation affecting these arrangements.</p><br /><p>Funding arrangements for the capital costs of new fluoridation schemes in England will need to be agreed between local authorities and PHE, on behalf of the Secretary of State, as part of the preparatory work before the scheme can commence.</p> more like this

star this property answer text <p>As part of the mental health parity of esteem requirement for 2015-16, clinical commissioning groups (CCGs) were asked to plan for an increase in spend on mental health services at least in line with the increase in their overall funding allocation for the year, which set a higher bar than achieving a real terms increase in spending, though not all CCGs were able to achieve this target. 192 of the 209 CCGs achieved a real terms growth in mental health planned spend measured against the 1.4% Gross Domestic Product (GDP) deflator for 2015-16.</p><br /><p>The list attached shows which CCGs have achieved real terms increases in spending on mental health in 2015-16.</p><br /><p>The final data for CCGs’ spending on mental health in 2015-16 will be submitted to NHS England by commissioners in May 2016, and it is anticipated NHS England may be in a position to provide final spend information by around the end of the first quarter of 2016-17.</p><br /><p>NHS England has not yet published CCG planning guidance for 2016-17. Consideration will be given to holding commissioners to account for spending on mental health.</p><br /><p>CCG and NHS England mental health spending information is now routinely collected as party of NHS England’s monthly financial reporting regime. Monthly financial reports by CCGs are scrutinised and quality assessed by NHS England’s regional teams. The monthly reports also form part of the CCG assurance process. NHS England is also in the process of setting up the financial plan assurance process for 2016-17, which will incorporate the review of planned spending on mental health services for future years.</p>
