	answer	answer is ministerial correction date of answer 28/10/2019 answer text <p>Regardless of age, all asylum claims lodged in the UK are carefully considered on their individual merits, in accordance with our obligations under the Refugee Convention.</p><p>Where clear and credible documentary evidence of age is not available, criteria including physical appearance and demeanour are used as part of the process to assess whether a person is under 18. The Home Office will treat a person claiming to be a child as an adult only where their physical appearance and demeanour very strongly suggest they are 25 years of age or over. When there is doubt about an individual’s claim to be a child, Home Office policy is to refer them to the relevant local authority to carry out a careful “Merton compliant” age assessment, which must be carried out by two social workers and must adhere to guidelines set out by the Courts. Whilst this assessment is ongoing, the individual will be treated as a child with full access to the safeguards available to any child in the system, and the local authority or Health and Social Care Trust looking after the individual remains responsible for their care arrangements and the safeguarding of other children in their care.</p><p>The Home Office keeps its policies and processes under review, and we remain committed to striking the right balance between ensuring that children who claim asylum are appropriately supported and maintaining the integrity of the asylum system by preventing adults being treated as children.</p> answering member constituency Louth and Horncastle answering member printed Victoria Atkins question first answered 28/10/2019 17:06:22 answering member 4399 label Biography information for Victoria Atkins

In such circumstances we would seek to release them into the care of local authority children’s services at the earliest safe opportunity for an age assessment.</p><p>Information on the number of occurrences of people leaving detention by nationality, age, sex, reason for leaving detention and length of detention can be found in table Det_D03 of the detention data tables, which can be found in the latest release of ‘Immigration Statistics’, available from GOV.UK at: <a href="https://www.gov.uk/government/statistical-data-sets/returns-and-detention-datasets" target="_blank">https://www.gov.uk/government/statistical-data-sets/returns-and-detention-datasets</a>. Clause 37 of the Withdrawal Agreement Bill does not represent a change of government policy in that regard. This means that the ability of unaccompanied children under Dublin to reunite with family will end, unless a replacement agreement is negotiated. The Government has been clear that it is committed to seeking such an agreement with the EU, thereby ensuring these children can continue to reunite with family once we are out of Dublin. 	answer	answer is ministerial correction date of answer 25/02/2020 answer text <p>We recognise local authorities undertake incredibly valuable work in looking after vulnerable young asylum seekers and the Home Office is committed to supporting this.</p><p>The Home Office provides funding to local authorities as a contribution to the costs they incur when supporting unaccompanied asylum-seeking children (UASC), which is in addition to the money provided through the local government finance settlement.</p><p>The UASC funding review gathered evidence from over 50 local authorities and concluded in May 2019 with a significant increase in the funding: from 1 April 2019, local authorities now receive £114 per UASC per night for each UASC in their care, regardless of their age or when they entered the UK. This represents a 61% increase to the lowest rate that was previously paid.
