unstar this property answer text <p>Since 2010, the Coalition Government has made a series of reforms which have decentralised power down to local government and down to local communities below it.</p><p> </p><p>This has included strengthening the governance structures in London at a variety of levels: by devolving power and funding over housing, economic development and the Olympic legacy to the Mayor and Assembly through the Localism Act 2011; by abolishing unelected bodies such as the Government Office for London and London Development Agency; supporting the creation of a London-wide economic partnership; and delivering a broader set of reforms to local government transparency, accountability, housing finance and local government finance which the London Boroughs in particular have benefited from.</p><p> </p><p>The London Enterprise Panel was established by the Mayor in 2012 in response to the Government’s invitation to areas to form Local Enterprise Partnerships. It provides a forum which enables the Mayor, London Boroughs and the private sector to work together to take a strategic view of regeneration, employment and skills in the capital. The Panel has successfully negotiated a growth deal which includes delivering £120 million of investment in London’s Further Education colleges and work to develop new ways to help those furthest from the labour market into work.</p><p> </p><p>As set out in the Government response to the Communities and Local Government Select Committee Report: <em>Post-Legislative Scrutiny of the Greater London Authority Act 2007 and the London Assembly</em> (Cm 8761), the Government believes there is scope for governance reform in the relation to the London Fire and Emergency Planning Authority.</p><p> </p><p>Ministers have serious concerns about the governance in the London Borough of Tower Hamlets following an independent inspection report, and are consulting the council on the report and a proposed package of interventions as outlined in the Oral Statement of 4 November 2014, <em>Official Report</em>, House of Commons, Column 663.</p><p> </p><p>The Coalition Government considers that power should be devolved to the lowest appropriate level including to communities and individuals. For instance, we have introduced powers for local communities in London to establish neighbourhood forums to take forward neighbourhood planning and introduced a range of ‘community rights’ such as the Community Right to Challenge and the Community Right to Bid for Assets of Community Value.</p><p> </p><p>Parish councils can also provide communities with a democratically accountable voice and a structure for taking community action. London saw its first parish council in decades have its first elections in May 2014, in Queens Park, Westminster. A number of other local communities in London are now campaigning for parish councils to be set up. The Government is also making it easier to set up new town and parish councils where they do not currently exist and is seeking to amend legislation to do so.</p><p> </p><p> </p><p> </p>

unstar this property answer text <p>We encourage local authorities to work closely with their communities to look at the range of options open to them. This may include forming community led groups, such as co-operatives, Community Land Trusts or Tenant Management Organisations. My officials continue to discuss issues affecting co-operative housing more generally with the co-operative sector.</p><p> </p><p> </p><p> </p><p>Council tenants have the Right to Manage, which enables them to set up a Tenant Management Organisation (a management co-operative) to manage the homes in their area, with a management allowance from the Council. The Tenant Empowerment Programme, £2 million in 2014/15 and £1 million in 2015/16, supports social housing tenants to engage in, manage and/or take control of their housing services. This includes training, support and funding to enable tenant groups to take up their Right to Manage. There are currently over 200 Tenant Management Organisations across England, managing around 80,000 homes.</p><p> </p><p> </p><p> </p><p>In October 2012, we funded the Co-operatives UK to establish and run the Community Shares Unit to grow a sustainable market and promote the long term success of the community shares model, as a means to raising equity finance and increasing participation in community enterprises and projects. Community-led housing is one of the areas identified as requiring development.</p><p> </p><p> </p><p> </p><p>We are also encouraging community led organisations, including co-operatives, to apply for funding through the 2015-18 Affordable Homes Programme. The Homes and Communities Agency has held back over 25% of their £1.7 billion budget, for which it is now inviting bids. This should be of particular help to smaller community-led organisations.</p><p> </p>

unstar this property answer text <p>There is no requirement that a councillor who is subject of, or mentioned in, a complaint to the Local Government Ombudsman be informed of the nature of the complaint or the identity of the complainant. However, the Local Government Ombudsman’s practice is to request that local authorities ensure all interested parties within the local authority are aware of the investigation and are able to comment before the Ombudsman comes to a final decision.</p> more like this

unstar this property answer text <p>Local Plans play a critical role in determining what development is appropriate and where, and it is therefore essential that plan-making is as simple, quick and accessible a process as possible. On 15 September, my hon. Friend, the Minister for Housing and Planning (Brandon Lewis), announced that we have brought together a panel of experts drawn from across the built-environment sector to help look at ways in which we could radically improve plan-making in practice (see attached). The group will consider all elements of plan-making from policy and procedural requirements of plans to how plan-making is practically undertaken. Their work will conclude in early 2016, after which I will set out to Parliament how we intend to proceed to reform plan-making.</p> more like this

unstar this property answer text <p>Starter Homes will be sold at a minimum of 80% of the full market price and offered to first time buyers under the age of 40. The discounted Starter Homes price will be capped at £450,000 in London.</p><p>The cap is not an expectation of the going price for a Starter Home. Most first time buyers are not buying average-priced properties, but those at the lower quartile of values in an area. This is the first time buyers market that exists, and this is where we anticipate developers pricing starter homes</p><p>Starter homes will reduce deposit requirements for first time buyers. The average price paid by a first time buyer in London in Q2 2015 was £376,000 (Office for National Statistics data). The discount achieved through the Starter Home initiative would reduce the price of such a property to £301,000 and also reduce the deposit.</p><br /> more like this

unstar this property answer text <p>The Government has acted to protect tenants against unfair and excessive letting agency fees by requiring agents to publish a full breakdown of all charges prominently in their offices and on their website. A fine of up to £5,000 can be levied against agents who fail to comply.</p><p>Transparency is the key to keeping fees low, giving tenants the necessary information to make informed decisions and compare prices and, therefore, creating effective competition that should force agents to keep fees fair.</p><p>The Government has also made it a legal requirement, since 1 October 2014, for letting and managing agents in England to belong to one of the three Government approved redress schemes, offering a clear route for landlords and tenants to pursue complaints and, therefore, driving up standards.</p><p>We will continue to monitor the impact of these new requirements.</p> more like this

unstar this property answer text <p>This Government is committed to protecting the most vulnerable in society. One person without a home is one too many. That is why since 2010 we’ve invested more than £500 million to prevent and tackle homelessness in England. In London, we have given the Mayor £34 million to deliver pan-London rough sleeping services, with an extra £8.5 million for this work in 2015/16.</p><p>DCLG publishes regular statistics on rough sleeping. These are available at: https://www.gov.uk/government/collections/homelessness-statistics. The latest figures, for 2014, are attached.</p><p>More rough sleepers are being found and helped thanks to our investment. Our measures include supporting the roll-out of No Second Night Out across England through the Homelessness Transition Fund. In London, two-thirds of rough sleepers come off the streets after a single night. We have also commissioned the pioneering StreetLink service, which since its launch has helped over 14,500 rough sleepers by connecting them to local support services and avoid becoming entrenched in a life on the streets.</p><p>We are committed to do more to improve services for homeless people with complex needs. Our investment includes £5 million for the world’s first homelessness Social Impact Bond, which is reaching 830 entrenched rough sleepers in London.</p><br />

This responsibility can pass to a Right to Manage Company where leaseholders have exercised and acquired that right, allowing them to exercise direct control over how their block is maintained.</p><p>Landlords, or those who have acquired the Right to Manage, have a contractual obligation under the terms of the leases to carry out necessary works to the properties that they are responsible for maintaining. Where works are suggested by a majority of leaseholders that are not essential to the repair or maintenance of the property, we would expect landlords to engage with their leaseholders to discuss the feasibility of the suggested works, but there are no plans to legislate to obligate landlords to carry out such work.</p><p>There are also no plans to legislate to provide a limited time within which non-resident leaseholders who fail to respond to a proposal for qualifying works, are deemed to have agreed to the proposed works. The statutory consultation process (known as section 20) gives leaseholders the ability to have a greater say on proposed works to their property by making observations. It does not require leaseholders to make observations, but any observations that are made must be made within a specified time limit. The landlord (or Right to Manage Company) is therefore in the knowledge that subject to observations made, they are able to proceed with necessary works.</p><br />

The Government has not made an assessment of the effects of turning off street lights in the early hours of the morning by some local authorities.</p><p>However, a research study - <em>The effect of reduced street lighting on road casualties and crime in England and Wales : controlled interrupted time series analysis</em> - by R Steinbach et al, in the Journal of Epidemiology and Community Health published in July 2015 on the effects of street lighting on road safety and crime in England and Wales (attached) found little evidence of harmful effects of switch off, part-night lighting, dimming, or changes to white light/LEDs on road collisions or crime.</p> more like this

This provides the best support to local shops, local jobs and tourism by increasing footfall.</p><p>The Government has brought forward a range of measures to help motorists, including banning CCTV ‘spy cars’, introducing 10 minutes grace periods and a new guidance to challenge parking policies.</p> more like this

unstar this property answer text <p>The starting gross income threshold of £30,000 nationally is above the median average household income figure, which is just over £26,000 based on evidence from the Family Resources Survey - this figure represents gross income of the ‘household reference person’ plus a partner. It is only fair that social tenants who can pay more should pay more. There are more than 40,000 tenants in social housing who benefit from subsidised rents but where the annual household income is over £50,000. The Government consulted in October 2015 on a proposal for a taper which, if introduced. would ensure that rent rises are affordable for those households above the thresholds and protect the incentive to find and keep work.</p> more like this

unstar this property answer text <p>The consultation on the provisional local government finance settlement ran from 17 December 2015 to 15 January 2016. During this period, the Government received 278 responses, including 89 from shire districts, 36 from unitary authorities, 28 from metropolitan districts, 26 from shire counties, and 25 from London boroughs. A detailed summary of all responses (attached) are available at: <a href="https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/499283/Summary_of_responses_to_provisional_LGFS_consultation.pdf" target="_blank">https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/499283/Summary_of_responses_to_provisional_LGFS_consultation.pdf</a></p><p>The Government listened closely to concerns raised and considered all representations carefully when determining the final settlement. For the financial year ahead, the final settlement provides councils with at least the resources allocated to them by the provisional settlement. In addition, transitional funding will be provided for the first two years of the Spending Review period.</p>

The Local Government Finance Report (England) 2016/2017 sets out the basis of this distribution and the results can be found (attached) on the government website at <a href="https://www.gov.uk/government/collections/final-local-government-finance-settlement-england-2016-to-2017" target="_blank">https://www.gov.uk/government/collections/final-local-government-finance-settlement-england-2016-to-2017</a>.</p><p>Transition Grant is for places that did not benefit from these changes in the formula. I refer the noble Lord to the debate on the Local Government Finance (England) on 10 February 2016, <em>Official Report, Columns 1643 and 1645</em> (attached). The fund will be applied in direct proportion to the difference in the revenue support grant that would have been experienced and so it will ease the change from a system based on central Government grant to one in which local sources determine a council’s revenue.</p>

This is a real opportunity to reshape the role of local government and a major step forward in our plans to boost growth and give local people more control over how their money is spent.</p><p>We have announced that we will conduct a review of what the needs assessment formula should be in a world in which all local government spending is funded by local resources not central grant, and use it to determine the transition to 100 per cent business rates retention. They have powers to require households to pay reasonable costs towards both the accommodation that it secures for them and property storage costs, however they cannot require households to pay actual costs where these are more than those determined to be reasonable. Authorities determine what constitutes a reasonable cost by taking account of a household’s personal circumstances, its finances and the nature of the accommodation.</p> more like this

unstar this property answer text <p>We are making available £1.2 billion through the Starter Home Land Fund to prepare suitable brownfield sites to support at least 30,000 Starter Homes. A prospectus about the Starter Home Land Fund was published at the Budget in March 2016. £9 million has already been invested since the Fund’s establishment in April 2016.</p><p>We announced at Spending Review that £2 billion in loans will be made available to invest in infrastructure needed for major housing developments. We would expect at least 50 per cent of this funding to support housing on brownfield sites. Full bidding guidance will be available when the fund is launched.</p> more like this

The Inspector had regard to all the evidence put to the inquiry, this may have included information about other trolley bus schemes in the world, however the Inspector's remit was to look at the scheme for Leeds specifically put forward by the Applicant, having regard to the evidence submitted by all parties to the case.</p> more like this

Many of our existing measures will help to achieve those aims.</p><p>The government has already doubled the housing budget to help deliver a million homes and double the number of first time buyers. We have allocated £8 billion to deliver 400,000 affordable homes, including shared ownership, starter homes and homes for affordable rent. unstar this property answer text <p>The referendum threshold is not a cap - councils can set any council tax increase they like provided they obtain the consent of their local electorate in a referendum. Including levying bodies in the council tax referendum legislation increases the transparency and accountability of public bodies for their tax-raising and spending decisions. Local authorities and their levying bodies had shown that they can work together to cut costs and improve services, and this measure placed all local authorities on a common footing when setting council tax.</p> more like this

unstar this property answer text <p>Councils account for around a quarter of all public spending and have an important role to play in tackling the deficit. The 2015 Spending Review looked across all local government spending and as a result the Government provided a £3.5 billion package to tackle the pressures of adult social care. This included giving councils the additional freedom to introduce an adult social care precept worth 2 per cent, which could raise nearly £2billion by 2019-20. The Government remains committed to working with local authorities to keep council tax low for hard-working families and set out its proposals for council tax referendum principles for 2017-18 in the Local Government Finance Settlement Technical Consultation, published on 15 September 2016.</p> more like this

unstar this property answer text <p>The government is committed to developing a 25 year plan to improve the environment and this will include the importance of green infrastructure as a key underpinning of both the economy and well being.</p><p>The government is spending more than £600 million by 2020 to support the development, manufacture and uptake of electric ultra low emission vehicles in the UK. Part of this includes assisting local authorities by providing grant funding through the On Street Residential Scheme and Workplace Chargepoint Scheme to help meet the cost of installing electric vehicle chargepoints on streets in residential areas without access to off-street parking. Under the Go Ultra Low City Scheme the government is supporting a variety of infrastructure programmes for both public and domestic chargepoints across eight cities/regions of Bristol/West of England, London, Nottingham, Milton Keynes, York, Dundee, Oxford and the North East.</p><p>The government has made £1.5 million available to communities to create 'Pocket Parks', turning unused spaces into sensory gardens, wildlife habitats and food growing areas. The government has also submitted written evidence to the Select Committee inquiry on the future of public parks and will respond to any recommendations made as a result of this inquiry in due course.</p>

unstar this property answer text <p>We are keen to drive up delivery of new housing once permission has been granted and we are actively taking steps to tackle some of the factors which can delay a start to development. We are taking forward measures through the Neighbourhood Planning Bill, which was introduced on 7 September, to improve the use of planning conditions to avoid unnecessary delays to development. We have also, through the Housing and Planning Act 2016, introduced a provision for a section 106 dispute resolution process. This will assist in speeding up negotiations on the content of section 106 planning obligations, where developers and local authorities have failed to reach an agreement. Secondary legislation is required to implement the provision. We also expect the members of the Home Builders Federation to adhere to their commitments in May to provide local authorities with transparent annual returns on build-out rates. And we will be setting out further measures in the forthcoming Housing White Paper.</p>

unstar this property answer text <p>On 4 July 2016, the three West of England Councils published a scheme, in accordance with the legislation, setting out their proposals for a mayoral combined authority, on which they undertook a consultation ending on 15 August 2016. Subsequently, as statute requires, the councils submitted a summary of the consultation responses to the Secretary of State. The next step in the statutory process is for the Secretary of State to seek the consent of the three councils to the making of an Order, which subject to Parliament’s approval, will establish the West of England Combined Authority and confer new powers on it.</p> more like this
