unstar this property answer text <p>Local authorities must secure accommodation within their own district so far as is reasonably practicable. Where it is not possible to secure accommodation within their district and an authority has secured accommodation outside their district, the authority is required to take into account the distance of that accommodation from the district of the authority. Authorities should try to secure accommodation that is as close as possible to where an applicant was previously living. Councils must also take into account the impact a change in location would have on a household, including the possible disruption to peoples’ jobs and children’s schooling.</p><p>The Department collects data on the number of out of district placements, by local authority, under the interim duty to accommodate whilst making enquiries etc. and under the duty to secure temporary accommodation whilst awaiting settled accommodation. unstar this property answer text <p>Once a hate crime has been reported it is for the police to investigate whether a hate crime has been committed, in line with the relevant legislation, and to refer cases to the Crown Prosecution Service to decide whether there should be a charge.</p><p>In order for a crime to be charged and prosecuted as a hate crime, the Crown Prosecution Service (CPS) uses the legal definitions contained in the Crime and Disorder Act 1998 (CDA 1998) and the Criminal Justice Act 2003 (CJA 2003).</p><p>The CPS assesses each case on its individual facts and circumstances. Prosecutions can only be brought in line with legislation and in accordance with the Code for Crown Prosecutors.</p><p>The CPS legal guidance on hate crime recognises the right to freedom of expression set out in Article 10 of the European Convention on Human Rights. The legal guidance makes it clear that it is not only speech which is well-received and popular that is protected but also speech which is potentially offensive, shocking or disturbing. The CPS seeks to balance the right to freedom of speech and expression against the duty of the state to act proportionately.</p>

People in buildings or other places not designed for habitation (such as stairwells, barns, sheds, car parks, cars, derelict boats, stations, or “bashes” which are makeshift shelters, often comprised of cardboard boxes).<em><em> <br></em></em><br>Nobody should ever have to sleep rough. We have already allocated £30 million of funding specifically to support rough sleepers, including people at risk of sleeping rough, new rough sleepers and those with the most complex needs - our ambition is to halve rough sleeping by 2022, eliminating it by 2027.</p> more like this

We expect all housing developers to deliver good quality housing, deliver it on time and to treat house buyers fairly, resolving any problems quickly. All new homes are also subject to supervision by Building Control – local authorities and approved inspectors. DCLG Minsters will continue to raise the issue of quality regularly when they meet with the industry.</p> more like this

unstar this property answer text <p>The National Planning Policy Framework is clear that councils should plan for a mix of housing, based on the needs of different groups in the community, including disabled people. All new homes must have minimum levels of accessibility and local authorities are able to require higher levels of accessibility where it is properly justified, taking account of local need and viability. Through the Housing White Paper we set out proposals to reinforce these expectations, and have introduced a new statutory duty on the Secretary of State to produce guidance for local planning authorities on how their development documents should meet the housing needs of older and disabled people.</p> more like this

unstar this property answer text <p>A crime that is motivated by hostility on the grounds of race, religion, sexual orientation, disability or transgender identity can be classed as a hate crime. Our hate crime laws recognise everyone's right to believe and practice their chosen religion, free from targeted abuse. unstar this property answer text <p>While the Government does not have immediate plans to review the rights of social housing tenants, in light of the terrible tragedy of the Grenfell Tower fire, we have been clear in that more attention must be focused on social housing and listening to its tenants. We are determined to do all that we can to make sure that something like this never happens again.</p><p>Our immediate priority is to support the victims, to find homes for those made homeless by the fire, and to make sure the country's housing stock is safe. The Secretary of State also announced on 5 July that an independent Recovery Taskforce will be appointed to advise the Council on the longer term recovery needs, and will answer directly to the Secretary of State. The Taskforce will remain in place for as long as is required.</p> more like this
