star this property answer text <p /> <p>Decisions about legal aid funding in civil cases are a matter for the Director of Legal Aid Casework and his staff at the Legal Aid Agency (LAA), which is responsible for administering the legal aid scheme. Ministers cannot intervene in decisions made about the grant of funding in individual cases.</p><p> </p><p>The LAA refused an application for funding from the High Speed 2 Action Alliance (“HS2AA”) in relation to the Bill procedure, as it did not meet the statutory criteria to receive public funding in respect of either means or exceptional funding. A review of the refusal of the application was sought and the LAA has upheld its decision.</p> more like this

star this property answer text <p /> <p>From April 2010 Local Criminal Justice Boards (LCJBs) took responsibility for the governance and performance management of the 143 accredited Specialist Domestic Violence Courts (SDVCs) across England and Wales. As of March 2014 there were 137 accredited SDVCs. However, the closure of SDVCs in some areas does not necessarily mean that provision in that area has ceased, as many of the SDVC systems cover a number of courthouses. Closure of an SDVC in one courthouse would simply mean that the case would be heard in another accredited courthouse within the Local Justice Area.</p><p> </p><p>HMCTS remains committed to a partnership approach to supporting domestic violence victims going through the Criminal Justice Process.</p> more like this

star this property answer text <p /> <p>Her Majesty’s Courts and Tribunals Service administrative staff provide help to courts and tribunals users directly at court buildings and hearing centres. Help is also provided by staff at call centres and through guidance provided on-line. While HMCTS staff cannot provide any legal advice, they are able to provide general help on procedure, including, where appropriate, guidance on the completion of court documents. Depending on the circumstances staff will also signpost users to appropriate advice agencies for this purpose. Through its budgeting and workforce planning processes HMCTS endeavours to ensure all activities are resourced to meet the demands of the service.</p><p>Where a party appears unrepresented in the Magistrates’ Court, the Legal Adviser has a general duty to assist and this includes providing assistance with the completion of court forms.</p> more like this

star this property answer text <p /> <p>I have interpreted ‘Local magistrate advisory boards’ to mean Advisory Committees on Justices of the Peace, the bodies responsible for recruiting and selecting magistrates in England and Wales.</p><p> </p><p>To enable their work to be informed by a range of knowledge and experience, Advisory Committees are composed of both magistrates and non-magistrates. At least one third of each Committee’s members should be non-magistrates.</p><p> </p><p>The attached table contains the names of each Committee’s members and indicates which of those members are magistrates.</p> more like this

This service provides broadcast programming that is aimed at reducing reoffending and cascading general health information to prisoners and visitors.</p> more like this

star this property answer text <p /> <p>Legal aid in England and Wales is available to victims of domestic violence where they need it to help break free from the abusive relationship. Access to legal aid for protective injunctions to prevent domestic violence remains identical to that prior to the legal aid reforms. These matters continue to be funded without the need for evidence. In private family law cases (such as child or financial arrangements) legal aid continues to be available where there is evidence of domestic violence or child abuse - the list of acceptable evidence is wide and comprehensive.</p><p> </p><p>In a recent judgment, the High Court found that the domestic violence evidential requirements are lawful and reflect the intention of Parliament in providing legal aid for those victims of domestic violence who require assistance because they will be intimidated or materially disadvantaged by having to face their abuser in court.</p> more like this

star this property answer text <p /> <p>Question 213688 was answered on 8 January 2015 but I have reproduced it here, for ease.</p><p> </p><p>Without incurring disproportionate cost it is not readily possible to distinguish those judicial review cases which were successfully brought against specific policies or measures from the total number of judicial review cases which were successfully brought against the Ministry of Justice.</p><p> </p><p>My letter dated 7 January 2015 answering Question 211301 (which can also be found in the Libraries of the Houses and on www.parliament.uk) sets out the numbers of judicial review cases successfully brought against the Ministry of Justice in each year from 2010 to 2012.</p> more like this
