answer text <p>All businesses – irrespective of their size or business sector – are responsible for paying the correct minimum wage to their staff. The government is clear that anyone entitled to be paid the minimum wage should receive it and takes robust enforcement action against employers who do not pay their staff correctly. HMRC enforces minimum wage regulations on behalf of DBT. <br></p><p>Table 1: National Minimum Wage arrears, workers identified, and penalties issued from 2015/16 – 2021/22. answer text <p>In 2021/22, HM Revenue and Customs (HMRC) concluded over 2,800 minimum wage investigations and returned more than £16.3m in arrears to over 120,000 workers. HMRC issued 696 fines totalling £13.2m to businesses who had failed to pay the minimum wage. Where there has been an underpayment, HMRC will instruct the employer to pay workers the arrears owed, and a penalty of up to 200% of arrears.</p><p>HMRC’s Promote team issued 7.8 million advisory notices to workers, employers, and their agents increasing awareness of the rules. Since 2015, the Government has ordered employers to repay over £100 million to over 1 million workers.</p> more like this

answer text <p>In the latest naming round, 208 employers were named for failing to pay £1.2m to around 12,000 workers. The employers were also ordered to pay nearly £2m in penalties.</p><p> </p><p>Unpaid working time, which can include unpaid trial shifts, was a factor in 29% of these cases. answer text <p>HM Revenue and Customs already effectively enforces the minimum wage. Since 2015, HMRC has ordered employers to return £100m to 1 million workers who had been underpaid.</p><p> </p><p>The Government have been unequivocal in our commitment to protect and enhance workers’ rights as build back better from the pandemic and to bring forward legislative proposals to better protect vulnerable workers and create a level playing-field for the majority of employers complying with the law.</p><p> </p><p>As laid out in our manifesto, legislating to establish a Single Enforcement Body for employment rights will be a central part of our efforts to achieve this ambition.</p><p> </p><p>We have already made good progress on this by publishing our response to the consultation, which sets out high level proposals for the body. As laid out in our response, this new single enforcement body will bring together three existing bodies: the Gangmasters and Labour Abuse Authority, the Employment Agency Standards Inspectorate, and HMRC’s National Minimum Wage Enforcement.</p><p> </p><p>We will bring forward further detailed proposals in due course, and in the meantime continue to work with stakeholders to take necessary action to support businesses and protect jobs.</p>

answer text <p>HMRC may open an investigation into an employer’s compliance with National Minimum Wage law either following a worker complaint or via proactive risk-based enforcement activity. Where HMRC find no minimum wage arrears are due, they will not take enforcement action such as issuing a Notice of Underpayment and financial penalty.</p><p> </p><p>Where HMRC find that arrears are due to workers they will generally issue a Notice of Underpayment and financial penalty. In some cases, employers may be allowed to carry out self-correction action which ensures that workers are paid the money due to them without the issue of a Notice of Underpayment. Overall, in 2018/19 HMRC found arrears in 45% of cases they closed; this “strike rate” has increased year-on year since the introduction of the National Living Wage in 2016.</p><p> </p><p>This information will be covered in more detail in BEIS’ Minimum Wage Enforcement and Compliance report, which we will publish in due course.</p> more like this

answer text <p>The Government remains committed to enforcing the National Minimum Wage (NMW). We have more than doubled HMRC’s budget for NMW compliance and enforcement since 2015 to £27.4 million for 2019/20.</p><p> </p><p>The Director of Labour Market Enforcement recommended evaluation of the National Minimum Wage Naming Scheme in his 2018/19 Strategy. The Director’s consultation revealed mixed views from stakeholders about naming; some were strongly supportive, whilst others proposed ideas for increasing its effectiveness as a deterrent to underpayment of the minimum wage.</p><p> </p><p>The Government decided to pause the naming of non-compliant employers while we determine what changes are needed to make sure the scheme continues to have resonance and acts as a tool to drive compliance.</p> more like this

answer text <p>The Government is clear that all employers are responsible for paying their staff correctly. Anyone entitled to the Minimum Wage should receive it. We have more than doubled the budget for minimum wage compliance and enforcement since 2015; it is now at a record high of £27.4 million.</p><p> </p><p>Last year was a record year for NMW enforcement. Across the 2018/19 financial year HMRC identified a record £24.4 million in minimum wage arrears, for over 220,000 workers. HMRC completed almost 3,000 investigations; issuing £17 million in financial penalties to over 1,000 non-compliant employers.</p><p> </p><p>Since 2007, 14 employers have been successfully prosecuted for underpaying the Minimum Wage. HMRC issued 7 Labour Market Enforcement Undertakings in the 2018/19 financial year.</p><p> </p><p>This information will be covered in more detail in BEIS’ Minimum Wage Enforcement and Compliance report, which we will publish in due course.</p> more like this
