Member for York Central's Parliamentary Question 160682.</p><p> </p><p>The Legal Aid Agency does not record the number of people who receive legal aid. Instead it records the number of ‘acts of assistance'. One individual may receive a number of separate acts of assistance, and one act of assistance can help more than one person. As the categorisation of legal aid has changed over the last 20 years, acts of assistance relating to representation in court cannot be accurately compared over time. The total acts of assistance relating to civil and criminal cases from 1995 onwards were provided by way of a written response on 18 June 2013 to the hon. This is why there has been a year on year increase in the total amount of financial penalties collected over the last three years. The amount of money collected reached an all time high of £290 million at the end of 2013/14 and collections continue to rise. Administrative cancellations only take place in certain circumstances and after all attempts to collect the amount outstanding have been made. These circumstances include where the offender has died, where they have emigrated with no prospect of return, where the offender has been sent to a mental institution for 12 months or more or where the offender cannot be traced and there has been at least 12 months from the point of imposition. It should be noted that administrative cancellations can be re-instated if the prospects of recovery improve (where, for example, a new address is found).</p><p> </p><p>Legal cancellations occur after the case has been reconsidered by a judge or magistrate and further evidence has been presented. Legal cancellations can be as a result of a successful appeal, a change in financial circumstances of the offender or a committal to prison for non payment. 	answer	answer is ministerial correction date of answer 25/03/2015 answer text <p /> <p>The Ministry of Justice is mandated to encourage Small and Medium-Sized Enterprise (SME) engagement and the policy is set out by the Cabinet Office; this is a government wide agenda. SME participation is encouraged by removing barriers and making the procurement process faster and less complex. Most recently the government issued policy supporting a number of new reforms to make public procurement even more accessible to businesses, particularly SMEs. These new reforms take account of the wide consultation and engagement that the Government has undertaken with public bodies, small businesses and trade bodies over the last two years and in response to Lord Young’s recommendations to Government in his report ‘Growing Your Business’ (May 2013). These reforms are implemented in Part 4 of the new Public Contracts Regulations 2015, and have been embedded into MoJ procurement processes.</p><p>Secondly the Social Values Act must be taken into consideration. While the Senior Presiding Judge will not appoint an un-discharged bankrupt, individuals who have been discharged from bankruptcy are not automatically disqualified for appointment. 	answer	answer is ministerial correction date of answer 09/02/2016 answer text <p>The LAA does not routinely collect information on whether applicants for legal aid are victims of people charged with domestic violence.</p><p> </p><p>Prior to 2013, when people applied for legal aid they were not asked to declare whether domestic violence had occurred. Since 2013, applications for legal aid do not routinely request this information. Therefore the data requested is not available.</p><p> </p><p>People seeking protective injunctions, like non-molestation orders, remain eligible for legal aid. Legal aid also remains available in private family cases that involve domestic violence.
