Each non-conviction (or ‘unsuccessful’) outcome is allocated a reason, indicating the principal reason the defendant was not convicted. 	answer	answer is ministerial correction date of answer 30/09/2015 answer text <p>The decision to prosecute Gurpal Virdi for misconduct in public office and indecent assault was made in accordance with the Full Code Test as set out in the Code for Crown Prosecutors. The case was handled by a specialist unit within the Crown Prosecution Service (CPS), prosecuted by Treasury Counsel and supervised at very senior levels of the CPS.</p><p>There was detailed legal argument and a defence application to dismiss the case before trial. The application failed. At trial no defence submission was made to the trial judge that the matter should not be left to the jury. Mr Virdi was subsequently acquitted by the jury after a full trial.</p><p>I understand that the CPS has already written to my Hon. Friend with a more detailed explanation of the decision making in this case and I am satisfied that the CPS have handled the prosecution appropriately. However, I am happy to meet my Hon. While ‘equality impact assessments’ (EIAs) may be produced, there is no legal requirement for duty assessments to be recorded in a specific format.</p><p>The Government Legal Department (GLD) is the Attorney General’s Office’s (AGO) HR shared service provider and is therefore responsible for EIAs at the AGO. In the last five years, GLD has completed four EIAs when making substantive changes to HR policies and procedures (two EIAs in 2021 and two in 2023).</p><p>The AGO has completed no EIAs relating to policy changes. The Panel consisted of community stakeholders, academics and police. Discussion focused on a deep-dive into the handling of disability hate crime cases. As a result, the CPS will this month circulate a bulletin to all prosecutors. This will highlight key findings, lessons and top tips arising from the review. In addition, operational guidance has been refreshed and will be launched this month. It will provide prosecutors with an updated appreciation of how disability hate crime occurs, based on the lived experience of disabled people.</p><p> </p><p>Building on this review, a refreshed communications approach is aiming to raise awareness of hate crime and in particular the confidence to report.
