	answer	answer is ministerial correction date of answer 24/06/2019 answer text <p>Schools have a legal duty under the Equality Act (2010) not to discriminate against disabled pupils by excluding them from school because of their disability. Any exclusion must be lawful, reasonable and fair, but within these requirements, schools need to be able to set and enforce behaviour policies that reflect their ethos and the specific challenges they face.</p><p>The law does not prevent a pupil with special educational needs (SEN) or a disability from being excluded. Schools are required to record and return information on all exclusions which includes, if applicable, the SEN of the pupil. The Department will continue to support headteachers in creating safe and orderly environments that enable teachers to teach and pupils to learn.</p><p>Schools can only exclude pupils, either permanently or for a fixed period, for disciplinary reasons and the Department supports schools in using exclusion where this is warranted. Permanent exclusion should only be used as a last resort, in response to a serious breach or persistent breaches of the school's behaviour policy, and where allowing the pupil to remain in school would seriously harm the education or welfare of the pupil or others in the school.</p><p>The Timpson Review of school exclusion considered how schools use exclusion and how this impacts on all pupils, particularly why some groups of children are more likely to be excluded from school. The review and the Government response can be found here: <a href="https://www.gov.uk/government/consultations/school-exclusions-review-call-for-evidence" target="_blank">https://www.gov.uk/government/consultations/school-exclusions-review-call-for-evidence</a>.</p><p>The Government welcomes the review and agrees with all 30 recommendations in principle. Among those receiving some form of exclusion, attainment is highest for those receiving only one fixed period exclusion during their school career and lowest for those receiving a permanent exclusion. There is a presumption against their closure. This does not mean that they can never close, but if they do, any replacement provision must be of equal quality, preserve expertise and be more accessible and convenient for parents.</p><p>Whether or not a MNS closes is a matter for local authorities, but the presumption against their closure includes a duty on local authorities to assess whether the alternative provision available is of equal or greater quality. The department is in regular contact with local authorities and the MNS sector.</p><p> </p><p>I announced on 28 February that the government would extend the supplementary funding paid to local authorities, by approximately £24 million. This enables them to fully fund MNSs for the whole of the 2019/20 academic year. Core spending power has increased from £45.1 billion in 2018-19 to £46.4 billion in 2019-20. For Sunderland, this means an increase in core spending power of £235 million in 2018-19 to £239 million in 2019-20.</p><p>In addition to this, the Autumn Budget announced a further £410 million in 2019-20 for local authorities to invest in adult and children’s social care services.</p><p>The Department for Education (DfE) made an investment of £2.4 million towards the creation of Together for Children (TfC), the company responsible for delivering children’s services in Sunderland, which has started to make an impact on improving children’s services.
