	answer	answer is ministerial correction date of answer 21/11/2018 answer text <p>As set out on the 26 June at the Justice Select Committee and in the 2017 manifesto, we remain committed to building up to 10,000 modern and decent prison places to replace old, expensive and unsuitable accommodation. We will deliver this through a combination of both new prisons and the reconfiguration of existing establishments, to enable governors to achieve better outcomes.</p><p> </p><p>While our ambition remains the same, the way that we will deliver this programme has changed meaning that a direct comparison to the £1.3 billion figure is not appropriate. As the Chancellor set out in the budget on 30 October, we now intend to build the first two prisons through public capital at Wellingborough, which is due to open in 2021 and Glen Parva, which we expect to open in 2022 and we continue to explore funding options for the remaining prison places. Funding for advocacy at inquests may also be available via the Exceptional Case Funding scheme, subject to means and legal criteria.</p><p> </p><p>In January last year, we changed the regulations around inquest funding, the effect of which meant the firm, KRW, representing the majority of the families seeking representation, could apply for funding in this case. Legal aid was provided to KRW, effective in the vast majority of those cases from February 2017.</p><p> </p><p>However, all firms seeking to undertake publicly-funded cases must be accredited. In this case, it was discovered that KRW had not obtained the accreditation, required as a condition of the firm being granted a legal aid contract. The changes in funding in real terms were as follows:</p><p> </p><ul><li>In the year beginning 2010: 165 million</li><li>In the year beginning 2011: 133 million</li><li>In the year beginning 2012: 118 million</li><li>In the year beginning 2013: 99 million</li><li>In the year beginning 2014: 98 million</li><li>In the year beginning 2015: 80 million</li><li>In the year beginning 2016: 74 million</li><li>In the year beginning 2017: 73 million</li><li>In the year beginning 2018: 72 million</li></ul><p> </p><p>These reductions were made in the context of wider savings made across the department. The MoJ is committed to ensuring there is sufficient funding for Youth Offending Teams whilst also ensuring public money is managed appropriately.</p><p> </p><p>YOTs continue to carry out vital work to support young people through the justice system and prevent them from entering it in the first place. 	answer	answer is ministerial correction date of answer 28/11/2018 answer text <p>There are no current plans to commence Section 151 of the Criminal Justice Act 2003, which allows courts, in certain circumstances, to use community orders for repeat offenders who would normally receive fines.</p><p>Section 143(2) of that Act requires courts to treat previous convictions as an aggravating factor when sentencing. The Sentencing Council’s guideline on theft offences came into force in 2016. This guideline allows for the imposition of community sentences for shop theft in a wide range of circumstances. Charges for services provided by GPs are set through the contractual relationship between GPs and the NHS.</p><p> </p><p>This practice is unacceptable. GPs are charging people at their most vulnerable and we are working with the Department of Health and Social Care to identify what more we could do to help victims of domestic abuse access the help they need. This important issue has been put forward as part of the GP contract negotiations for 2019-20. 	answer	answer is ministerial correction date of answer 21/11/2018 answer text <p>The information requested is extracted from the most recent data available and is detailed in the table attached.</p><p> </p><p>Prisoners are released when they have a statutory entitlement to be released once they have reached their automatic release date, or are released on a discretionary basis by the Parole Board, the Secretary of State or through early release on Home Detention Curfew (HDC) by prison governors.</p><p> </p><p>If the automatic release date – which for the majority of prisoners is the half-way point in their sentence – falls on a weekend or Bank holiday, the law (Section 23(3) Criminal Justice Act 1961) requires the release to be brought forward to the first preceding working day. To defer the release date would mean holding the person unlawfully.</p><p> </p><p>The exception is where the sentence is 5 days or less. 	answer	answer is ministerial correction date of answer 27/11/2018 answer text <p>In 2016/17, there were 206 incidents where Spice was found in South Yorkshire prisons, and in 2017/18, there were 154 incidents. Data for finds of psychoactive substances in the months since March 2018 will be available on GOV.UK in July 2019, as part of the Annual HMPPS Digest. The number of drug finds reflects not only the number of attempts to convey illicit substances into our prisons but also our success in finding these drugs.</p><p> </p><p>Psychoactive substances are a game changer for prison safety, and this statistic reinforces the scale of the challenge. We are addressing this head on, and have invested £7 million in modern technology, including phone blocking technology and improved searching techniques. The Ministry of Justice recognises that there are delays in the system and is in the process of recruiting extra judicial office holders to help deal with this. In the Social Security and Child Support (SSCS) jurisdiction, which is the part of the tribunal system which deals with personal independence payment appeals, 225 new medical members have already been appointed and 119 disability-qualified members have recently been recruited. The SSCS jurisdiction will also benefit from the fact that 250 fee-paid judges and 100 salaried judges are being recruited across tribunals more widely. In addition, we have recently launched a new digital service to enable speedier processing of appeals and provide a better service for all parties to the proceedings.
