unstar this property answer text
The Government-funded Criminal Injuries Compensation Scheme 2012 (the Scheme) exists to compensate for serious physical or psychological injury attributable to being a direct victim of a crime of violence. As the Scheme is publicly funded, strict eligibility criteria apply.

There are already special arrangements in place for people applying for compensation for an injury sustained in childhood, and in all cases where a claim is made outside of the applicable time limit they can be considered in exceptional circumstances.

We recently held a public consultation on potential reforms to change the length of time people have to submit a claim to the Criminal Injuries Compensation Authority. We asked for views on increasing the time limits for child victims of sexual abuse, as well as other violent crimes, and on increasing them for all applicants. We will make decisions about whether to amend the time limits as soon as possible in 2024 as part of our comprehensive review of the Scheme.

This includes testing a new approach to help prisoners with an opiate dependency achieve abstinence, through abstinence-focused Drug Recovery Wings. Seven of these are now open across the estate. Alongside this, we are increasing the number of Incentivised Substance-Free Living units, where prisoners commit to remaining free of illicit drugs with regular drug testing and incentives. We have more than doubled the number of these from 25 last summer to 60 now, aiming to reach up to 100 by March 2025.
more like this

unstar this property answer text
Sentencing in individual cases is a matter for the independent judiciary.

The courts have a statutory duty to follow any relevant sentencing guidelines, issued by the independent Sentencing Council for England and Wales. The Council has issued a range of offence-specific and overarching guidelines to help judges and magistrates decide appropriate sentences for criminal offences. The guidelines set out factors which courts should consider when deciding on a sentence and are designed to help increase consistency and transparency in sentencing.

The Ministry of Justice (MoJ) recently published an evaluation of the impact of remote hearings on the Crown Court, though this did not consider sentencing [The impact of remote hearings on the Crown Court (publishing.service.gov.uk)]. Remote hearings were found to be slightly shorter than matched in-person hearings. However, using remote plea hearings did not impact the total case duration or the number of total hearings in a case. The report found no meaningful differences in plea rates or trial outcomes when remote plea hearings are used.

unstar this property answer text
PAVA is intended to protect staff and prisoners in very serious assaults. Safe implementation of PAVA use is accompanied by clear and explicit guidance ensuring staff are confident as to when PAVA spray should be used. Staff can use the PAVA spray where there is serious violence or an imminent or perceived risk of it, and there is an immediate need to create a safe and protective environment.

During the pilot in 4 prisons in 2018 an Equality Impact Assessment was produced in line with HMPPS’s public sector equality duty. The national rollout of PAVA will be evaluated, the scope of which has been expanded to look at Use of Force as a whole to provide insight and learning and inform our practice. We are taking steps to better understand potential causes of disproportionality and identify appropriate actions to address them, applying the explain or reform principle where appropriate.
more like this
