star this property answer text <p>We are committed to supporting restorative justice as a way to help victims cope and, as far as possible, recover from the impact of crime. That is why, under the Code of Practice for Victims of Crime (‘the Victims’ Code’), all adult victims must be told about the option of restorative justice and how to access it. We also provide Police and Crime Commissioners with grant funding for victim support services, including restorative justice services. They are best placed to assess local need and commission services based on the needs of the population in the local area. Restorative justice services should be targeted to the most appropriate cases, where we have clear evidence for the benefits of that approach and should only take place when both the victim and the offender agree, and it is considered safe.</p><p> </p><p>HMPPS has work underway to look at how to better support MoJ funded restorative justice. This work is aimed at identifying the factors supporting quality practice and to test effective, evidence-based access to, and delivery of RJ services.  HMPPS will also work with PCC areas to improve referrals to RJ services. Once complete HMPPS will share the lessons learned more widely.</p><p> </p><p>We do not currently plan to publish a restorative justice action plan because it is not clear that this is necessary or an appropriate fit with the existing activity to improve the consistent and targeted provision of restorative justice services at a local level.</p>

star this property answer text <p>The Probation Service is responsible for producing Pre-Sentence Reports (PSRs) when they are requested by the Court. A PSR includes a sentencing recommendation based on an offender's individual circumstances and consideration of public protection concerns, alongside suitable rehabilitative and punitive requirements.</p><p>A PSR can be delivered to Courts in a range of formats including the longer written Standard Delivery Report (SDR), and the Short Format Report (SFR) which can be delivered in written or oral format.</p><p>The key principles for decisions on the format of report delivery to Court are:</p><ol><li>What information is available to the PSR author and the Court on the day of sentence. Access to information regarding risk from other agencies does inform the risk assessment and so can affect proposals to the court. Where this information is not available on the day, the impact of this needs to be assessed to determine whether a longer adjournment is needed.</li><li>Complexity of the risk assessment. The presence of factors that require additional assessment, professional discussion, and / or multiple enquiries to aid risk assessment has an important bearing on whether reports should be delivered on the day of request or adjourned for further assessment.</li></ol><p>As a general rule all report types are suitable for use across the sentencing thresholds. Guidance is available for probation staff to assist them in determining when to request for a longer adjournment to facilitate an SDR report.</p><p>The Probation Service is working on a range of initiatives to increase the number of cases in which the Courts receive written reports. These are:</p><ul><li>A pilot scheme across fifteen courts, aimed at targeting written reports at specific cohorts where a more detailed exploration of complex issues relating to trauma, maturity and the loss of liberty may be needed.</li><li>Rolling out across England and Wales a scheme to provide PSRs on committal from magistrates’ courts to the Crown Court, following a successful pilot in Bristol. The Probation Service continues to utilise a PSR before plea process, which enables PSRs to be prepared on cases ahead of the first hearing if an indication of an intended guilty plea is given.</li><li>Supporting case progression in appropriate cases with PSRs prepared in advance of first hearing at both Crown and Magistrates’ Courts.</li></ul>

While there is no specialist expertise on speech and language therapy within the group, the Review has received responses from the profession as part of a Call for Evidence. These views are being fully considered as we begin to update the Code of Practice.</p><p> </p><p>There will be further opportunities for all those with an interest in the Code of Practice to provide feedback when we consult on the updated Code of Practice.</p> more like this

star this property answer text <p>The Ministry of Justice published Experimental Statistics in October 2018, which estimated the numbers of former service personnel in the prison population. The department is due to release the next estimate in October 2019.</p><p> </p><p>This new analysis indicated that as at 30 June 2018, 2032 prisoners had declared as ‘ex-service personnel’ when they were first received into custody between January 2015 and June 2018. The attached table shows the number of ex-service personnel serving a prison sentence in all prisons in Yorkshire as at 30 June 2018.</p><p> </p><p>The Ministry of Justice is committed to ensuring that those who have served in the Armed Forces and who find themselves in the Criminal Justice System are able to access support, whether they are serving their sentence in custody or in the community.</p> more like this

star this property answer text <p>The Ministry of Justice has partnered with police forces, Police and Crime Commissioners and the Mayor’s Office for Policing and Crime in London to develop pilots of a Chance to Change (‘deferred prosecution’) model in London (North West Borough Command Unit), Surrey and West Yorkshire. Cumbria are no longer pursuing a pilot.</p><p> </p><p>Pilots are yet to fully commence, however, once they are operational we will share updates on progress within wider updates on tackling racial disparity work. Pilot areas have been asked to assess the effectiveness of their schemes. Results on effectiveness should include data on reoffending which will not be available until at least 12 months after any period considered, so will not be immediately available.</p><p> </p><p>The department has not made an assessment of the cost of each of the pilots.</p> more like this

star this property answer text <p>We recognise the sacrifices made by all who have served in the Armed Forces. For those few who come into contact with the Criminal Justice System, it is important their needs are assessed and support offered.</p><p> </p><p>NHS England’s Liaison and Diversion services assess vulnerable individuals, including identifying former service personnel at first point of contact with the Criminal Justice System, for example at police stations and courts across England. Individuals may be diverted away from the Criminal Justice System, or into appropriate community orders.</p><p> </p><p>Information on previous military service is also asked at first contact with probation, typically in court, and during screening on entry to custody. Prisoners can declare their previous service at any point in their sentence. Prisons will typically have a member of staff operating as a Veterans in Custody Support Officer, and work with military charities, to encourage this to happen.</p> more like this

star this property answer text <p>In March 2023 this government published the independent Domestic Homicide Sentencing Review and announced that we will be changing the law so that sentencing reflects the severity of these crimes. We will introduce statutory aggravating factors to increase sentences for murderers with a history of controlling or coercive behaviour against the victim, and for murders involving ‘overkill’ which is the use of excessive or gratuitous violence beyond that necessary to kill. Building on our ban of the ‘rough sex defence’ in the Domestic Abuse Act 2021, we also want to see longer sentences for perpetrators of so-called rough sex manslaughter and have requested that the Sentencing Council update their guidelines so that the courts can impose a higher sentence in these circumstances.</p><p> </p><p>The Review makes a number of other recommendations which we are carefully considering, and our full response will be published before summer recess.</p><p> </p><p>The Home Office commission the 'Quantitative Analysis of Domestic Homicide Reviews’ (DHR) reports by QE Assessments Ltd to share learning and insights from the DHR process. The cases reviewed in the QE Assessments report are likely to also feature in the cases reviewed by Clare Wade KC in the Domestic Homicide Sentencing Review.</p>

We believe that setting the age at 10 provides flexibility in dealing with young offenders and allows for early intervention in a child’s life with the aim of preventing subsequent offending. That is why there are a range of options available to the police to resolve offences and put in place interventions to prevent further offending. Furthermore, the particular needs of a child will be identified through assessment by the local multi-agency youth offending team who can refer them on to other services for further investigation and support.</p> more like this

star this property answer text <p>We take seriously the findings of the HM Inspectorate of Probation report on the work undertaken by Community Rehabilitation Companies (CRCs) in relation to domestic abuse. We will publish a detailed action plan in November to address the recommendations made by the Inspectorate, and we require CRCs to develop their own robust action plans in response to specific recommendations. These plans will be closely monitored by the department’s contract management assurance and governance process.</p><p> </p><p>Our reforms to probation mean we are now monitoring around 40,000 offenders who would previously have been released with no supervision at all. However, we have been clear that CRCs need to improve across a range of areas. In September we concluded a public consultation on proposals to end current CRC contracts early and introduce new arrangements for delivering probation services. As part of these changes we are considering how to ensure probation plays its full part in tackling domestic abuse and protecting victims.</p>

star this property answer text <p>My Department has not previously made an assessment of adopting the system of foetal alcohol spectrum disorder courts used in Manitoba.</p><p> </p><p>Courts already make special arrangements for defendants with learning disabilities by adapting the trial process to address their specific communication and other needs. We take this approach for defendants with a variety of special needs; it is generally preferable to specialised courts which create inflexibility in the system, slow down court processes and can negatively impact other court users facing different challenges and vulnerabilities. We are working with NHS England and others to ensure that needs are identified early in the criminal justice process and offenders have access to the right treatment and support once they have been through the courts.</p> more like this

star this property answer text <p>MoJ is committed to working in collaboration with the Department of Health and Social Care (DHSC), NHS England (NHSE), Public Health England (PHE) and HM Prison and Probation Service (HMPPS) to deliver safe, decent, effective healthcare for offenders.</p><p> </p><p>Over 4,000 new prison staff are now in post, enabling us to implement initiatives like the key worker role, which allows staff to dedicate time to support individual prisoners. These initiatives and others mean that we will be able to better support individuals with mental health needs in prison.</p><p> </p><p>We have also agreed a Community Sentence Treatment Requirement (CSTR) protocol to support the greater use of community sentences with treatment requirements, including Mental Health Treatment Requirements helping to improve access to treatment for offenders who need it and divert vulnerable offenders away from custody where appropriate. The protocol is currently being piloted at five sites and last month we announced the extension of the programme to include Greater Manchester and London.</p><p> </p><p>The context of how health and justice partners work together to improve mental health provision, and indeed other health issues that that might impact on an individual’s ability to engage with rehabilitation, in both custody and the community, will be set out further in the joint MoJ/ DHSC Health and Justice Plan, which was announced on 20<sup>th</sup> June.</p>

For instance, the Assessment, Care in Custody and Teamwork (ACCT) case management process for prisoners at risk of self-harm or suicide already includes an enhanced case management process for use where prisoners pose a risk of harm to others, as well as to themselves.</p><p> </p><p>We continue to develop our work with this link in mind. The Prison Safety Programme includes a range of measures designed to address both violence and suicide and self-harm in our prisons. A study of individuals engaged in ‘dual harm’ (both to themselves and to others) is taking place in a number of prisons, and the early findings have been used to inform the programme.</p><p> </p> more like this

star this property answer text <p>All pregnant women in custody have an individual care and management plan that is communicated to all staff and all pregnant women are seen by a mid-wife at least fortnightly or as required. Healthcare in prisons is provided by trained medics and nurses, but we have also made training on dealing with pregnant women available to all prison officers and new guidance will make clear that pregnant women should have access to 24-hour midwifery advice.</p><p> </p><p>We know it is extremely rare for a woman to give birth in prison - because every step is taken to get them to hospital - but those unique cases are invariably down to the unpredictability of labour.</p><p> </p><p>Our new Female Offenders Strategy made clear that we want fewer women serving short sentences in custody and more remaining in the community, making use of women’s centres to address needs such as substance misuse and mental health problems.</p> more like this

We will explore what barriers prevent people from making a complaint based on submissions to the Call for Evidence and meetings with our stakeholders.</p><p> </p><p>Our response will also consider the case for further regulation. County Court Bailiffs, who are employees of Her Majesty’s Courts and Tribunal Service (HMCTS), and Approved Enforcement Agencies who enforce criminal orders, were not within scope of the review of enforcement agents. We will liaise with trade unions if any proposals that may arise from our consideration of the responses from the Call for Evidence directly impact on Court staff.</p><p> </p><p>HMCTS are in the process of procuring a new set of contracts for Approved Enforcement Agencies (AEA) to enable the collection of criminal orders. The tender went live on 1 July 2019. We anticipate awarding contracts in December 2019, with services to commence in May 2020.</p>

star this property answer text <p>We publish the number of assaults against prison staff, as part of our Safety in Custody statistics, in Table 8e of the summary tables, available at the following link: <a href="https://www.gov.uk/government/statistics/safety-in-custody-quarterly-update-to-september-2023" target="_blank">Safety in custody: quarterly update to September 2023 - GOV.UK (www.gov.uk).</a></p><p>Totals for those occurring in privately-operated prisons can be seen at row 160, with the grand total in row 162. While staff assault rates remain below pre-pandemic levels, we continue to ensure all our hardworking staff are protected and will never tolerate violence against our hardworking prison officers. Prisoners who are violent towards staff will face the full consequences of their actions and will be dealt with swiftly and effectively, which includes further time behind bars.</p><p>We are providing staff in the adult male estate with a personal safety package which includes SPEAR personal safety training, in order to protect staff and prisoners from instances of serious violence. We also continue to provide targeted support to prisons on CSIP (Challenge, Support and Intervention Plan) implementation where needed. CSIP provides a framework for managing violence that is centred around the prisoner and their specific needs to help them manage and move away from violent behaviours.</p><p> </p>

star this property answer text <p>People who are sentenced by a court to imprisonment after conviction may be assessed by a psychiatrist in prison if it is thought that their mental disorder is of a nature or degree that requires treatment in hospital. Section 47 of the Mental Health Act 1983 is considered when transferring prisoners. Proposed changes are being made to the way in which inpatient secure beds are commissioned with the aim of improving timely allocation. Time scales are monitored by NHS England and include an expectation of 14-day prison transfers. The transfer time starts on completion of the first medical assessment and stops once the prisoner has been admitted to hospital.</p><p> </p><p>HMP Northumberland has a professional and supportive Mental Health team engaged in supporting men with both mental health and complex needs. The Mental Health team, delivered by Tees, Esk and Wear Valley NHS Trust are actively engaged with men who are subject to Assessment, Care in Custody and Teamwork (ACCT) procedures and those who reside within the Separation and Care (SCU), as well as other men across the site, with a variety of needs.</p><p> </p><p>Through The Gate (TTG) services have created an opportunity for early identification of individuals who may have complex mental health needs and gives a framework for cooperation and joined up working, as well as release planning. A new complex Case Manager has been appointed by G4S (Healthcare provider) with whom the mental health team at HMP Northumberland will work closely with to co-ordinate needs, and ensure the support for individuals is comprehensive.</p>

We are seeking to ensure that practitioners who work with children and young people in settings with a known high prevalence of speech, language and communication needs are trained in recognising and responding appropriately to communication needs, and ensuring access to speech and language therapy as required.</p><p>Over the past three years MoJ and the YJB have supported a national project, led by the Department for Education, to deliver special educational needs and disability (SEND) awareness training to the youth justice workforce. The Youth Justice SEND Bubble programme offered free training to Youth Justice System professionals, supporting them to effectively identify and meet children’s special educational and disability needs and allowing them to work towards more effective engagement and positive long-term outcomes.</p> more like this

Details of each Urgent Notification and the Lord Chancellor’s response and action plan can be found on <a href="https://www.gov.uk/government/collections/urgent-notification-process" target="_blank">gov.uk.</a></p><p>The Chief Inspector of Prisons, Charlie Taylor, alerted the Lord Chancellor of his concerns at HMP Woodhill on 1 September 2023. In line with the protocol between HM Inspectorate of Prisons and the Ministry of Justice, the Lord Chancellor responded to Charlie Taylor on 29 September 2023, setting out his response and action plan. We have commenced work on all 45 actions in the initial action plan, 10 are now complete and we continue to work on the remaining 35.</p> more like this

star this property answer text <p>We have strengthened our policy so that no transgender woman convicted of either a sexual or violent offence, or who retains male genitalia, can be held in the general women’s estate, other than in truly exceptional circumstances, which must be signed off by a minister.</p><p>A total of 100 transgender prisoners had a sexual offence as a principal offence and were housed in prison establishments across England and Wales on 31 March 2023.</p><p> </p><p>If a question is posed for information and the total figure amounts to five people or fewer, the MoJ must consider whether this would be likely to lead to the identification of individuals and whether disclosure of this information would be in breach of our statutory obligations under the UK General Data Protection Regulation and/or the Data Protection Act 2018. We believe that the release of some of this information would be likely to lead to identification of the individuals concerned.</p><p> </p><p>For this reason, it is not possible to provide a split by legal gender (i.e., counts and percentages by legal gender male or legal gender female) or to provide a split by geography (i.e., counts and percentages in England and Wales).</p><p> </p>

star this property answer text <p>Staff and prisoners have been trained together as peace promoters and they run mediation sessions to ease conflicts between groups. These have been working to support all prisoners being able to attend communal worship. Additionally, potential conflicts between groups or individuals are discussed at a weekly Violence Reduction meeting to manage these risks moving forward. This co-ordinated, partnership approach has resulted in the successful offer of Friday Prayers to all Muslim prisoners at HMP Woodhill since 9 February.</p> more like this

star this property answer text <p>His Majesty’s Prison &amp; Probation Service is providing support to the staff at HMYOI Wetherby who care for girls in the Keppel Unit. The Youth Custody Service is looking to develop a gender-specific operating model for HMYOI Wetherby, and gender-responsive guidance for the wider youth secure estate. We will continue to place girls into the Keppel Unit when it best suits their needs.</p><p> </p><p>For the longer term, we are examining future placement options of girls who receive a custodial sentence, together with the operational support and training needed for the care of girls in the youth estate.</p> more like this

star this property answer text <p>The Youth Custody Service Placement Team endeavours to place every child who is sentenced to custody safely, appropriately, and swiftly. Each child’s placement is determined by the Placement Team following a thorough review of all evidence presented by the child’s Youth Offending Team. If all relevant information is available, the decision on placement can be taken quickly, but factors outside the team’s control – for example, if the child’s case is heard towards the end of the court day – can lead to late arrival in custody.</p><p>Some placements are at a significant distance from the court, though the effect of this is mitigated, as far as possible, by children being moved direct to the placement location. Additionally, there may be delays in escorting the child to the placement – stoppages caused by road traffic accidents, for example – which can be outside the control of the escort providers. We have robust contract management processes in place to ensure the performance of Prison Service Escort Contractors.</p>

star this property answer text <p>The dedicated social workers located in HM Young Offender Institutions support staff to meet their safeguarding and looked-after child responsibilities, and facilitate good working relationships between establishments and local authorities. Additionally, the recently revised ‘Working Together to Safeguard Children’ guidance includes direction for local authorities when a child becomes looked-after as a result of being remanded to youth detention accommodation.</p><p>The Youth Custody Service (YCS) is developing further guidance on how professionals in establishments and the community should work together to facilitate a looked-after child’s contact with their social worker and how to resolve issues where these arise. This will be available to staff by May 2024. The YCS will also be creating opportunities for staff to come together and share good practice in this area.</p><p>The YCS has recently improved processes to collate and analyse data, both on community professionals visiting children in custody, and on the social care status of children and young people in its care. The higher-quality data will help inform future work to improve care for looked-after children.</p><p>Work is in progress to improve data quality in the Youth Justice Application Framework and Asset Plus framework, including the looked-after child field.</p>

star this property answer text <p>The Youth Custody Service (YCS) is dedicating the resources needed to achieve consistent delivery of custody support plans (CuSP) to children and young people in the secure estate, enabling staff to spend the time they need with children to improve relationships, with in-depth support sessions, working on progression, goals and behaviour.</p><p>The YCS is delivering training to all Band 3 and 4 operational staff to ensure they are appropriately skilled to implement and review CuSP. A CuSP officer is being allocated to each child entering custody during the induction process, to provide consistent adult support through the child’s custody journey.</p><p>The YCS is also improving oversight of CuSP through monthly management meetings, which will communicate information on emerging risks, and ensure accountability for delivery, through scrutiny of data.</p><p>In accordance with the YCS’s improvement plan (the “CuSP ladder”), HMYOI Wetherby plans to increase delivery of CuSP across the year, and will ensure that CuSP sessions are held following significant events.</p>

star this property answer text <p>Education managers created a reading strategy which commenced in November 2023 and is in use across the prison, making sure reading for purpose and reading for pleasure are adequately planned and delivered in all lessons, including those for children receiving outreach tuition.</p><p> </p><p>The Head of Education, Skills &amp; Work at HMYOI Wetherby, who is part of the Senior Management Team, will work with the education provider to effect improvements in the quality of English teaching. Attention will be given to ensuring that teachers, when planning learning, pay full regard to children’s starting points, so as to be able to maintain their interest and engagement. All functional skills staff will be required to attend collaborative planning workshops, to improve planning for learning, create clear assessment checkpoints and markers for assessing progress, and develop a sequenced curriculum for delivering English lessons. The Education provider will ensure their staff are teaching to good or outstanding grades through observations of teaching and learning, providing continual professional development and support to any staff who do not reach the required minimum standards. This will be monitored through contract management processes.</p>

HM Inspectorate’s latest report notes that children and 18-year-olds received good support from resettlement practitioners (RPs) and the social workers who worked with them, and Home Detention Curfew (HDC), transitions, parole and early release processes were managed well.</p><p>The Head of Resettlement at HMYOI Wetherby will lead improvement in the quality and consistency of risk-assessment work by RPs, by undertaking the following actions:</p><ul><li>senior leaders and first line managers will highlight any knowledge gaps, to share good practice and identify learning for a training needs analysis</li><li>developing and delivering an appropriate catalogue of training in relation to young people over the age of 18 who are transitioning to the adult estate, as well as Prisoner Offender Management training, for all RPs</li><li>improving RP knowledge and understanding of the intervention catalogue, through awareness sessions, delivered quarterly by treatment managers; and</li><li>ensuring resettlement targets are shared with all children via their in-room launchpads, so that they are aware of their objectives, and that objectives are recorded on electronic case notes.</li></ul>

star this property answer text <p>HM Inspectorate’s report explains that the key reason for differences in length of time out of room, was whether children could mix with other children. The Youth Custody Service (YCS) will aim to reduce the length of time for which children at HMYOI Wetherby are separated, and improve the regime provided for them, by introducing new guidance which will make for a consistent approach to carrying out Rule 49 (Removal from association) reviews. A psychologist will provide timely short-term assessments of risk and need, to support efficient reintegration at the earliest opportunity.</p><p>The YCS will seek to ensure that reintegration planning commences at the point of separation, and includes input from all key areas, to ensure the child is provided with a purposeful regime including education, gymnasium, wing-based activities and psychology.</p><p>We will improve the education provision for all children, and the charity Kinetic Youth will be involved in enhancing provision for separated children.</p>
