star this property answer text <p>The Government aims for full implementation of the Liberty Protection Safeguards (LPS), as set out in the Mental Capacity (Amendment) Act 2019, for April 2022.</p><p>The Department is drafting a Code of Practice and secondary legislation for the implementation of LPS. Both will be subject to public consultation in spring 2021. Subject to the outcome of the consultation, the Government plans to lay the Code and regulations before Parliament in the autumn of that year.</p><p>The Department is also working with stakeholders from across the local government, health and social care sectors to develop workforce plans to ensure that implementation is a success.</p> more like this

star this property answer text <p>The Government recognises that access to breaks provides important support for people with care needs and their carers during the COVID-19 pandemic. We have provided approximately £1.8 billion in specific funding for adult social care. This includes the £1.35 billion Infection Control Fund, which has been used towards supporting day centres to re-open safely.</p><p>In addition, we have also supported the provision of respite within caring ‘bubbles’ ensuring that the COVID-19 restrictions allowed household mixing when providing care and respite for other carers. We have also provided over £2 billion this year to the Better Care Fund which local authorities can access to fund social care services in their areas including respite services.</p><p>No assessment has been made of providing an extra £50 is personal budgets to help carers access breaks from their caring. Local authorities are responsible for assessing individual’s eligibility for support as set out in the Care Act 2014. Carers have legal rights to an assessment of, and support for, their needs where eligible. Following the assessment, the local authority will decide if the carer is eligible for support. Support could be provided by the local authority, or in the form of a direct payment or personal budget.</p>

star this property answer text <p>The Building the Right Support Delivery Board is responsible for monitoring the commitments made in the Action Plan. In 2022/23, we are providing an additional £90 million to develop community support and for discharge for those with a learning disability and autistic people, including £21 million for the Community Discharge Grant.</p><p> </p><p>NHS England provides guidance, support and investment to local areas to commission community services for those with a learning disability and autistic people in line with Building the Right Support and the national service model. NHS England continues to work with other organisations to ensure appropriate plans are in place for this investment. The Building the Right Support Delivery Board has established a task and finish group to review how national oversight of National Health Service and local authority spending related to Building the Right Support can be improved.</p> more like this

star this property answer text <p>The Secretary of State for Health and Social Care regularly discusses a range of issues with Cabinet colleagues. The Building the Right Support Action Plan, published 14 July 2022, includes actions to reduce the number of those with a learning disability and autistic people in inpatient care under Part III of the Mental Health Act 1983 and to improve support for people at all stages of the criminal justice system. The Ministry of Justice is working with NHS England to understand the role of liaison and diversion services in the initial stages of the criminal justice pathway.</p><p> </p><p>Under the proposed Mental Health Act reforms, commissioners will have a duty to ensure there is an understanding of the risk of crisis of individuals in the area and there are sufficient community-based services for those with a learning disability and autistic people at risk of admission under Part II of the Act.</p> more like this

star this property answer text <p>The ‘Building the Right Support Action Plan’, published 14 July 2022, sets out actions to reduce reliance on inpatient care by strengthening community support. The NHS Long Term Plan committed to ensuring children and young people with a learning disability and autistic children with the most complex needs will have a designated keyworker by 2023/24. The keyworker programme was developed and tested in 13 pilot sites and the service is now operational in 26 integrated care boards. By March 2023, there will be a keyworker service in all areas.</p> more like this
