star this property answer text <p>The Secretary of State for Environment Food &amp; Rural Affairs is responsible for determining the maximum penalties for offences under the Animal Welfare Act 2006. Any proposals to change the maximum penalties would require the approval of the Cabinet’s Social Reform (Home Affairs) sub-Committee. The Government keeps maximum penalties under review. This includes sentencing trends, and whether there is any evidence that the courts may be finding their sentencing powers inadequate. The last review was conducted in the context of the Government’s response to the House of Commons EFRA Committee report on animal welfare published on 2 February 2017 on EFRA website. Government noted in its response that the Sentencing Council has reviewed the magistrates’ court sentencing guidelines, including those in relation to animal cruelty cases. In their revised guideline, published on their website, the Sentencing Council aims to ensure that the most serious cases of animal cruelty receive appropriate severe sentences, within the available maximum penalty.</p><p> </p>

star this property answer text <p>The Rural Payments Agency (RPA) does not hold information on Basic Payment Scheme (BPS) payments at a council level.</p><p> </p><p>As at close of business on 3 July, 99.7% of farmers in Cumbria have received their full BPS 2016 payment. There are 14 farmers still to receive their payment. Of these 7 are held subject to the completion of probate; 3 are complete but waiting on information from the Scottish Government; and 4 are still to complete processing.</p><p> </p><p>The RPA continues to focus on the completion of the remainder and dealing with any queries on BPS 2016 claims raised by farmers.</p> more like this

SAWS was closed in 2013 when transitional restrictions on nationals of Bulgaria and Romania were lifted, enabling free movement of all EU workers. star this property answer text <p>The Department for Environment, Food and Rural Affairs is responsible for measures relating to the environment, agriculture, fisheries, food, animal and plant health and the management of natural hazards such as flooding. A number of these dossiers are currently under discussion in the EU, including:</p><ul><li><p><a href="http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=COM:2013:0892:FIN" target="_blank">Proposal for a Directive of the European Parliament and of the Council on the cloning of animals of the bovine, porcine, ovine, caprine and equine species kept and reproduced for farming purposes</a> (COM(2013) 892 final);</p></li></ul><ul><li><p><a href="http://eur-lex.europa.eu/legal-content/EN/TXT/?qid=1432023305446&amp;uri=CELEX:52014AE0933" target="_blank">Proposal for a Council Directive on the placing on the market of food from clones</a> (COM (2013) 893 final);</p></li><li><p>Proposed repeal of the Environment Reporting Directive 91/692/EEC;</p></li><li><p>Waste (proposed revision of four directives: 2008/98/EC, 1999/31/EC, 94/62/EC and 2000/53/EC); and</p></li><li><p>Proposed amending Directive 2011/65/EU on the Restriction on the Use of Certain Hazardous Substances Directive in electrical and electronic equipment .</p></li></ul><p> </p><p>The Department provides Explanatory Memoranda to Parliament on any proposals defined by the terms of reference of the parliamentary EU scrutiny committees, which can be found online at <a href="http://europeanmemoranda.cabinetoffice.gov.uk/search/findby-topic" target="_blank">http://europeanmemoranda.cabinetoffice.gov.uk/search/findby-topic</a>. Each proposal from the EU on any dossier (along with reports etc.) is deposited in the Library of the House accompanied by an Explanatory Memorandum and so these documents, available online, show the full range of areas currently under discussion in the EU.</p><p> </p><p>Until Exit negotiations are concluded, the UK remains a full member of the European Union and all the rights and obligations of EU membership remain in force.
