star this property answer text <p>Remotely piloted aircraft may or may not carry arms, depending on their function. The use of force in armed conflict, regardless of the method of delivery, is governed by International Humanitarian Law (IHL). IHL regulates both the choice of weapons and the means and methods of warfare. Guidance to our armed forces on the interpretation and application of IHL is found in Joint Service Publication 383 The United Kingdom Manual of the Law of Armed Conflict; and Joint Doctrine Publication 0-30.2 Unmanned Aircraft Systems sets out UK Defence doctrine for the use of such systems, including the legal framework and moral and ethical issues.</p> more like this

The assessments were concluded by 22 May 2020. No records have been kept of how many hours were allocated to this process. star this property answer text <p>The UK supports the work of the Group of Eminent International and Regional Experts of Yemen and takes account of its reporting as part of the export licencing process. The Group's report of 9 September 2020 does not clearly define its interpretation of a pattern of incidents with regard to allegations of violations of international humanitarian law involving fixed-wing aircraft in Yemen. The UK's revised methodology does not adopt a prescriptive approach in considering whether there are indications of patterns of non-compliance but considers, for example, whether there are similarities in the factual nature of incidents, the reasons/explanations for the incidents and the timescale in which they have occurred.</p> more like this

star this property answer text <p>The Bill introduces an absolute limit of six years for claims for personal injury or death arising from overseas military operations. It remains the case that the time limit can be calculated from either the date of the incident, or from the date of knowledge. A claimant's date of knowledge is the date on which they first had knowledge that their injury was significant and attributable to a negligent act or omission by an identifiable defendant. Outside of the time limit, the courts will not be able to allow claims.</p><p> </p><p> </p><p>This measure will not prevent Service personnel and veterans, or their families, from bringing claims against the MOD in connection with overseas operations within a reasonable timeframe, which most have done historically anyway. As set out in the Impact Assessment for the Bill, published on 17 September, we estimate the vast majority (94 per cent) of relevant claims by Service personnel and veterans are already brought within six years. We expect that a proportion of the claims brought after six years in the past would be brought sooner in the future to avoid being caught by the new absolute time limit for claims.</p><p> </p><p>We won't comment on individual cases that may have been outside of the time limit, had this Bill been in effect. However, to help minimise the risk that individuals run out of time to make a claim, we will ensure that everyone in the Armed Forces Community who might be impacted by these new measures is fully aware of this legislation and the time available for them to make a claim.</p><p> </p>
