star this property answer text <p> </p><p><em>Role of the Department</em></p><p>Reflecting our responsibilities for local government, housing, planning and communities across England, the work of the Department involves staff travelling to different parts of the country.</p><p>Improved procurement has reduced our average domestic hotel rate in the UK by 8% between 2009-10 and 2012-13. Moreover, domestic flights for longer journeys can avoid the need for paying for staff to stay in a hotel overnight.</p><p>Since 2011-12, the Department accepted responsibility for some new functions outside of London, including residual functions following the closure of the Government Offices for the Regions and then oversight of the European Regional Development Fund following the abolition of the Regional Development Agencies. As these business functions relate to work in areas outside of London and to the European Commission, this has therefore increased our travel spend compared to the base of 2010-11. However, this is far more than offset by the very significant savings to taxpayers of the abolition of these regional bodies.</p><p>Based on current estimates (which reflect accounting consequences from machinery of government changes) the DCLG Group is reducing its annual running costs by around 40% in real terms between 2010-11 and 2014-15. This equates to net savings of at least £532 million over this spending review period and includes savings of around £420 million from the closure of the Government Offices for the Regions.</p><p>In addition to this, I note that the Regional Development Agencies were spending in the region of £246 million a year on administration (as cited in 11 March 2009, <em>Official Report</em>, Column 592W).</p><p><em>Spending data</em></p><p>The tables below list spending on travel by financial year. star this property answer text <p> </p><p> </p><p>For offenders the period of post-release supervision on licence forms an integral part of a sentence imposed by the court. The overriding priority is to protect the public from harm and prevent re-offending.</p><p> </p><p>The recall of offenders on licence is designed to protect the public by removing an offender from the community who, by breaching his licence conditions, is considered to present an increased risk of re-offending and where the Probation Service recommends that this is the most effective response to the increased risk, in order to protect the public.</p><p> </p><p>Behaviour that can result in recall includes: the commission of further offences or charges being laid; behaviour which indicates that further offending is imminent; or breaches of licence conditions which undermine the Probation Service's ability to provide effective supervision, such as not living at the address stipulated on the licence or failing to attend probation appointments.</p><p> </p><p>Once recalled, it is the responsibility of the police to apprehend offenders, although all agencies closely co-operate to ensure that they are swiftly returned to custody.</p><p> </p><p>Data on those offenders who had committed minor breaches of licence, were warned, and not recalled to prison are not collected centrally. Those offenders whose breach of licence has resulted in a recall to prison are published quarterly in the Ministry of Justice's Offender Management Statistics Quarterly Bulletin. Therefore, the total number who remained unlawfully at large as at 31 December 2013 includes some offenders who were recalled before 2001/02.</p><p> </p><p>In over 99 per cent of cases where an offender has been recalled, the individual has successfully been returned to custody. The figures for sexual assaults in this answer are different to those provided by the then Minister for Defence Personnel, Welfare and Veterans (Andrew Robathan) on 6 July 2012 (Official Report, column 822W) in response to a question from the hon. Member for Bridgend (Mrs Moon), for sexual assault referrals in the years between 2010 and 2012 (although 2012 was only for part of the year). This is because the term sexual assault has been expanded to cover the offences of indecent assault and sexual activity with a child. In addition, the figures provided in a response given by my predecessor (Mark Francois) on 30 November 2012 (Official Report, column 555W) again to the hon. Member for Bridgend (Mrs Moon) referred only to the number of cases where the victim was a member of the Armed Forces. The figures in the tables above cover all cases handled by the SPA, whether or not the victim was a member of the Armed Forces.</p>

star this property answer text <p>The Law Officers' Departments have been actively reducing their estate running costs since 2010 in line with Government policy and have already made significant savings.</p><p>The Crown Prosecution Service (CPS) estate rationalisation programme began in 2009 and is set to be completed in 2016, with most of the leases on empty property having expired by then. This programme has already led to a reduction in expenditure and increased efficiency. The Crown Prosecution Service (CPS) has paid £320,178.38 in property business rates in the current financial year on the properties which are currently recorded as vacant on the ePIMS database as at 14 March 2014. The costs figure has been produced by DTZ who are CPS' managing agents and has not yet been audited.</p><p>The Treasury Solicitor's Department owns a lease on a building which has some vacant space. This building attracts full business rates in the current financial year. This lease is due to expire in 2016. The estimated business rates for the vacant proportion of the property for 2013/14 are £59 372.71</p><p>The remaining Law Officers' Departments do not have any vacant properties.</p><p> </p>

star this property answer text <p> </p><p> </p><p>The maximum penalty for speeding is a fine of up to £1,000 and for speeding on a motorway, £2,500. The courts also have the power to disqualify the offender from driving and must in any event endorse the offender's licence by between three and six penalty points. Alternatively, if the police decide that the nature of the offence was less serious, they may offer the motorist the opportunity to receive a fixed penalty notice instead of prosecution. If a fixed penalty is issued, the driver may instead chose to plead innocence or mitigating factors in court, and if convicted, any sentence will be decided within the maximum penalty limit and in line with sentencing guidelines.</p><p> </p><p>The number of persons receiving endorsements only on their driving licence for speeding offences at all courts in England and Wales by police force area from 2008 to 2012 (latest data available) can be viewed in the attached table.</p><p> </p><p>Please note that court proceedings statistics for the year 2013 are planned to be published by the Ministry of Justice in May 2014.</p>

star this property answer text <p> </p><p> </p><p>HM Prison The Verne started taking immigration detainees as scheduled from 24 March 2014. The National Offender Management Service (NOMS) will retain The Verne as a prison in the short term. Its designation as a prison will be reviewed later this year, with the intention of completing the re-designation to an immigration removal centre by the end of September 2014.</p><p> </p><p>While The Verne retains its designation as a prison it will be governed by Prison Rules rather than Detention Centre Rules. As The Verne is not governed by Detention Centre Rules, Rule 35 of those rules is not applicable.</p><p> </p><p>Detainees held at The Verne will be treated in the same way as other detainees held within the prison estate. As such they will not have access to mobile telephones or the internet, nor will they be able to receive telephone calls. They will, however, be able to make telephone calls and will have access to both social and legal visits.</p><p> </p><p>There is a dedicated Home Office Immigration Enforcement Team on site who will see detainees routinely on induction and upon request. In addition, independent immigration advice will be provided by Migrant Help.</p>

star this property answer text <p>On 13 March we announced that we would mitigate the impact in academic year 2014/15 of the reduction in funding for 18-year-olds that we announced at the spending round in June 2013.</p><p>Without this mitigation, the reduction in funding for 18-year-olds would have led to a reduction of around 2% of total funding for 16- to 18-year-olds in the East Midlands and 3% in Lincoln.</p><p>The mitigation policy that we have just announced is to ensure that no institution will lose more than 2% of its 16- to 18-year-old funding in academic year 2014/15 as a result of the reduction in funding for 18-year-olds, and Lincoln College (the only further education college in Lincoln) will benefit from this mitigation. This will give schools and colleges more time to adapt to the change, including for those students who are already on courses.</p> more like this

star this property answer text <p>In December 2013 the Department for Education announced an additional £2.35 billion in basic need funding to support local authorities to create the additional places that will be needed by September 2017, in addition to the £5 billion already committed for the period 2011-15. We have also allocated £820 million in targeted basic need funding to fund an additional 74,000 high-quality places in the areas that face the most demand.</p><p>The Department allocates funding for new school places based on information provided by local authorities through an annual survey of the current capacity of schools in the area, and forecasts of future pupil numbers.</p><p>Local authorities are legally responsible for ensuring that there are sufficient school places. The Local Government Association's report shows how effective many local authorities have been in creating new places and the Department will continue to support local authorities in doing this.</p><p>One of the recommendations of the Local Government Association's report was for longer-term allocations. The Department wants to give local authorities as long as possible to plan their school places. This should not extend beyond a period where we have confidence in the underlying data and should allow the Department to allocate funding to reflect changes in projected population and in the number of places needed. The Department believes that three-year rolling allocations strike the right balance between these two objectives.</p>

star this property answer text <p> </p><p>In December 2013 the Home Office published guidance for local authorities which sets out the range of legislative tools they can use to tackle the 'head shops' <br>where legal highs are often sold. This was developed in collaboration with the Department for Communities and Local Government, the Local Government Association and the Trading Standards Institute. The guidance covers offences head shops may be committing under the Misuse of Drugs Act 1971, the Intoxicating Substances (Supply) Act 1985, and various consumer protection regulations.<br><br>The Home Office also provides local authorities and their trading standards officers with technical and financial support with drug testing through the Forensic Early Warning System. This supports local authorities in their action against the sale of legal highs by helping them to identify the contents of legal high products. To date, we have brought well over 250 substances under control through the use of ‘generic' legislation and temporary class drug orders. We also work closely with law enforcement to tackle this reckless trade. Concerted action, started in November 2013, has so far resulted in over 40 arrests and seizures of new psychoactive substances, including 9 kilograms by Kent Police. <br><br>Last summer we also ran a targeted communications campaign to raise awareness of the risks in taking new psychoactive substances amongst young people; providing information on these substances through our FRANK online service. <br><br>However, we accept that more can be done, hence my announcement on 12 December 2013 of a review by an expert panel to look at how the UK's response to new psychoactive substances can be enhanced beyond the existing measures. The expert panel includes a senior policy advisor from the Local Government Association to inform the work of the panel from a local government perspective. The panel is due to report its recommendations by the end of spring 2014.</p><p> </p>

star this property answer text <p> </p><p>The Community Right to Build allows local communities to undertake small-scale, site-specific, community-led developments. It may only be used by community organisations in which local people in the relevant neighbourhood area have a majority of the voting rights and have the majority on the board of directors or governing body of the organisation, and, include different people from at least 10 different addresses within the area. This means the Community Right to Build cannot be used by property developers, including wind turbine developers, to gain planning permission for their development proposal - unless that development is something that the community wishes to see and which the community initiates.</p><p>Proposals that require an Environmental Impact Assessment or are likely to have significant effects on a site protected under the Habitats Regulations are not eligible to use the Community Right to Build. Where proposals are eligible they will be tested by an independent examiner to see that they are appropriate in the light of national planning policy and generally conform with the strategic policies of the Local Plan for the area and any neighbourhood plans that are in force.</p><p>The National Planning Policy Framework is very clear that local councils should design their policies to ensure the adverse impacts of renewable energy developments are addressed satisfactorily. To help implement the environmental balance expected by the Framework, we issued new planning practice guidance for renewable and low carbon energy last July. The guidance makes clear that the need for renewable energy does not automatically override environmental protections and the planning concerns of local communities.</p><p> </p>

star this property answer text <p>The practice of the automatic roll-over of contracts does not breach any licence condition and therefore there are currently no sanctions available to Government or the independent regulator (Ofgem).</p><p> </p><p>Last year Ofgem carried out a review of the practice of automatic renewal contract arrangements in the non-domestic retail energy market. As a result of the review, Ofgem is currently consulting on proposals to improve end of contract arrangements. The proposals do not include a ban on automatic rollovers because Ofgem considers that such a ban could reduce competition from independent suppliers, which gives small businesses a greater choice to choose a deal that suits their business needs. The focus is on improving protections for non-domestic consumers by improving the clarity of information provided by energy supply companies. star this property answer text <p> </p><p> </p><p>The Criminal Injuries Compensation Authority (CICA) divides its case work between six teams, each of which handles applications from a particular region of Great Britain. When the need arises they also create cross-regional special exercise teams to carry out projects. All of these teams work from a single office. Northern Ireland has a separate Criminal Injuries Compensation Scheme, which CICA does not administer. The six regional teams are numbered as follows:</p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p>1. Scotland and Wales</p><p>2. North-West England</p><p>3. CICA may move staff between regions throughout the year to fill temporary staff vacancies or address variances in the number of cases each region is handling.
