star this property answer text <p>The requested information can be found in the attachment.</p><p>Data for 2022/23 is a year-to-date figure reflective of the work reported between April 2022 to October 2022, inclusive. Please note that the Legal Aid Agency (LAA) commissions and monitors legal aid services by ‘Procurement Area’ or ‘Access Point’ rather than by local authority. Procurement areas differ for different categories of law.</p><p>The LAA frequently reviews market capacity to make sure there is adequate provision of legal aid, in all categories of law, throughout England and Wales. The LAA moves quickly, where issues arise, to secure additional provision and to ensure demand for legal aid services is met across the country. The LAA contracts with a range of legal aid providers of varying size and capacity to take on new cases. Additionally, legal advice on a range of civil matters including housing, debt, discrimination and education is available, wherever people are, through the Civil Legal Advice telephone service.</p><p>Demand for legal aid services may vary across different categories of law. In particular, there may be low demand for services in categories such as clinical negligence or welfare benefits where the scope of services funded through legal aid was reduced under the Legal Aid Sentencing and Punishment of Offenders Act 2012.</p><p>In early 2023 the LAA will be opening up a tender for new entrants who want to bid for a 2018 civil legal aid contract in all categories.</p><p> </p>

star this property answer text <p>Please see attached annex for data table contain information on how many hours of community service were not carried out in each local justice area and region in England and Wales since 2010.</p><p>Owing to data migration issues following the move to a single National Recording Platform, with Transforming Rehabilitation in 2014 and subsequent changes to Probation Delivery boundaries, it is less possible to accurately map older locations to the current Probation Regions.</p><p>The dataset covers reasons hours are not carried out including offender deaths, deportation, orders revoked, and resentenced, successful appeals and Suspended Sentence Order (SSO) activated.</p><p>This Government has announced up to £93million additional investment in Unpaid Work over the next three years. star this property answer text <p>We have increased funding for the Probation Service by an additional £155m a year to recruit staff and to deliver better and more consistent supervision of offenders in the community. The data shows that since 2018, the proportion of successfully completed community sentences has increased from 70% to 74%. Please find the full dataset requested in the accompanying table.</p><p> </p><p>Delivering public protection and cutting crime is not just about custody. There is persuasive evidence that suspended and community sentences are more effective than short custodial sentences in reducing reoffending and promoting rehabilitation. Community sentences can include a range of robust requirements to punish the offender, protect the public and deliver rehabilitation. Electronic monitoring of curfews, exclusion zones, attendance at appointments, location monitoring and alcohol bans are all available requirements which the courts can use. Courts can also impose up to 300 hours of unpaid work to make sure that offenders are visibly and publicly making reparations for their crimes. Any breach of these requirements could see them returned to court and face immediate custody.</p><p> </p><p>Please note that where there is a significant risk of harm to an individual or where the offender has breached an order of the court, the courts will retain full discretion to impose a sentence of immediate custody.</p><p> </p><p>Data sources and quality:</p><p>The figures in this table have been drawn from administrative IT systems which, as with any large-scale recording system, are subject to possible errors with data entry and processing.</p><p> </p><p>Source:</p><p>National Delius case management system.</p>

Compensation may be ordered for such amount as the court considers appropriate having regard to any evidence including any representations made by the offender or prosecutor. There is no limit on the value of a single compensation order handed down to an adult offender. However, in determining whether to make a compensation order, and the amount to be paid under such an order, the court must take into account the financial circumstances of the offender.</p>

This information for the calendar year of 2022 is due for publication in May.</p><p>Please see the accompanying tables for:</p><ul><li>Total value of compensation orders issued;</li><li>The number of defendants issued with a compensation order, by principal sentence outcome and by offence group;</li><li>The 20 largest compensation orders issued in each of the last 5 years, and the offence this was given as a sentence outcome for; and</li><li>Minimum and maximum value of compensation orders issued, by court type.</li></ul><p>Compensation is presented in these tables on an all-disposal basis; this is where compensation is recorded in the four most severe disposals. Compensation may be ordered for such amount as the court considers appropriate having regard to any evidence including any representations made by the offender or prosecutor. There is no limit on the value of a single compensation order handed down to an adult offender. However, in determining whether to make a compensation order, and the amount to be paid under such an order, the court must take into account the financial circumstances of the offender. Courts are required to strike a balance between seeking reparation and not imposing debts that are unrealistic or unenforceable.</p>
