unstar this property answer text <p>Age discrimination in the provision of services is generally unlawful under the Equality Act 2010. There are, however, situations where a service provider can show that differential treatment between, for example, adults aged under and over 75 is a proportionate means of achieving a legitimate aim, which the 2010 Act permits.</p><p>Whilst the Government does not comment on particular cases, it is for individuals to consider whether they wish to take action where they feel they are being unlawfully treated on age grounds. Where a company cannot show that their leasing age policy is a proportionate means of achieving a legitimate aim, the individual affected can bring a claim to the County Court, or Sheriff’s Court in Scotland. The court may determine whether the “objective justification test” has been satisfied, and may award costs and compensation if the claimant wins their case.</p><p> </p> more like this

unstar this property answer text <p>The Government is currently considering the Business Case for a revised contract for Birmingham Highways Maintenance following the failure of Birmingham's original PFI deal. A decision is expected in due course.</p><p>Highways maintenance is a critical and statutory function for all Local Authorities and the government will continue to support authorities to fulfil this function.</p><p>Commissioners have oversight of strategic financial decision-making at the Council and they will want to be satisfied that the contract achieves value for money for Birmingham residents. They are providing advice and challenge to the council, and are able to make decisions directly, if necessary.</p> more like this

unstar this property answer text <p>The most recent Prisoner Escort and Custody Services (PECS) procurement process, which covers securely moving both adults and children, commenced in August 2020 and runs for ten years. This contract covers a range of services including secure transportation between prisons, police stations and other named places of detention and courts as well as transportation of prisoners between prison establishments and includes transition moves from the youth to adult estate.</p><p> </p><p>The Criminal Justice Act 1991 (as amended) and section 12 and Schedule 2 of the Criminal Justice and Public Order Act 1994 as amended by the 2007 offender management act, covers staffing requirements for moving children. All suppliers must demonstrate their technical and professional ability to deliver services, including compliance with the Equality Act 2010, as well as a sound economic and financial standing during any procurement process.</p><p> </p><p>Requirements for the supplier to implement behavioural management policies are included within the PECS contract outlines and cover Human rights, where use of restraint may be applicable and a requirement that any use is reported. There is an expectation that mechanical restraints would not be routinely used for children unless a risk assessment confirms they are necessary.</p><p> </p><p>The PECS suppliers are required to adhere to Prison Service Instructions covering the use of restraint, and their Standard Operating Procedures, training and supervision will be structured around these policy documents. Further to this the PECS contract requires suppliers to have a programme of development and refresher training for their staff which includes training for dealing with young people. Suppliers are also required to review any use of force and ensure that any appropriate lessons are learned, shared and implemented.</p>

unstar this property answer text <p>Defra has not made an assessment of the Preferred Fiber and Materials Report by The Textiles Exchange. One of Defra’s delivery partners, WRAP (Waste and Resources Action Programme), manages Textiles 2030, which commits signatories, who represent 62% of the fashion industry, to meet ambitious targets to reduce water and carbon consumption. WRAP has also done research on sustainable clothing design and produced guidance on fibre and fabric selection.</p><p> </p><p>In July, Defra announced proposals for keeping textiles in use for longer and minimising textile waste. These proposals, which will be subject to consultation in 2024, include a requirement for non-domestic settings such as businesses to separate their textile waste from other types of waste so that it can be collected for reuse or recycling. This separately collected textile waste should not enter landfill or be incinerated. Defra is also proposing that certain retailers provide in store facilities so that customers can return their pre-loved textiles for recycling or reuse.</p>

unstar this property answer text <p>HIV Prevention England (HPE) is the national HIV prevention programme for England and is funded at £3.5 million by the Department. The programme aims to support communities who are disproportionately affected by HIV, including gay, bisexual and men who have sex with men and Black African heterosexual men and women. The Department has appointed Terrence Higgins Trust, a national charity who provide services related to sexual heath and HIV, to deliver the programme from 2021 to 2024. HPE delivers a nationally co-ordinated programme of HIV prevention work, including public campaigns such as National HIV Testing Week, that is designed to complement locally commissioned prevention activities in areas of high HIV prevalence. HPE also aims to improve knowledge and understating of HIV transmission and reducing stigma within affected communities.</p><p>HPE works with a wide range of models and their network of influencers and develops its strategies based on comprehensive data, audience insight and knowledge from local partners within England which ensure a wide range of patient’s voices and experiences are represented.</p>

unstar this property answer text <p>The Equality Act’s definition of disability automatically covers people with HIV when they are in or seeking employment or seeking to access services, whether in the public or private sectors.</p><p> </p><p>As well as providing protection from discrimination, the Act requires employers and service providers to make reasonable adjustments for people living with HIV. For example, an employer would be expected to allow such an employee reasonable time off work to visit hospital in connection with their condition. Employers and service providers who fail to meet their legal obligations can face legal action, should the disabled person opt for this.</p><p> </p><p>In addition, the public sector equality duty (section 149 of the Act - 'PSED') requires public authorities, in the exercise of their functions, to have due regard to the need to:</p><ul><li><p>eliminate unlawful discrimination, harassment, victimisation and any other unlawful conduct prohibited by the Act;</p></li><li><p>advance equality of opportunity between people who share and people who do not share a relevant protected characteristic; and</p></li><li><p>foster good relations between people who share and people who do not share a relevant protected characteristic.</p></li></ul><p> </p><p>A raft of guidance and codes of practice are available to help employers and service providers comply with their legal obligations under the Act. People with HIV who think they have experienced discrimination may contact the Equality Advisory and Support Service (EASS), the government helpline established to provide free bespoke advice and in-depth support to individuals with discrimination concerns. The EASS can be contacted via their website - <a href="http://www.equalityadvisoryservice.com/" target="_blank">http://www.equalityadvisoryservice.com/</a>, by telephone on 0808 8000082 or text phone on 0808 8000084. The EASS has the ability to intervene on an individual’s behalf with a service provider to help resolve an issue. The EASS can also advise people who wish to take their complaint further on their options.</p><p> </p>

unstar this property answer text <p>The Crown Dependencies are responsible for their own contingency planning and emergency response but the UK stands ready to assist them in responding to emergencies where they request additional support.</p><p> </p><p>UK officials were in contact with emergency planners in the Channel Islands during Storm Ciarán but none of the Islands requested any support from the UK.</p> more like this
