This included a 5% decrease in assaults on staff and a 7% reduction in serious assault from the previous 12 months. Assaults have now fallen for the last three published quarters.</p><p>Despite the progress made, the level of violence in prisons remains too high and we continue to work hard to address this. We are giving staff the tools and training to help them reduce violence including embedding the Challenge, Support and Intervention Plan to support those at risk of violence, the roll-out of PAVA incapacitant spray and implementing key work across the prison estate. 	answer	answer is ministerial correction date of answer 19/11/2020 answer text <p>The attached table shows the number of assaults and self-harm incidents by prisoners in custody in the West Midlands and England, from January 2019 to June 2020.</p><p>Levels of self-harm fell 15% in the most recent quarter (April to June 2020) in England and Wales and violence fell by 37% over the same time period and by 19% in the 12 months to June 2020. Levels of self-harm and violence also fell in prisons in the West Midlands over the most recent quarter.</p><p>Statistics for the 12 months to June, and particularly those for the April to June quarter, relate to the exceptional period since the start of the Covid-19 pandemic and the restricted regimes prisons put in place in order to safely manage the risks of infection during the pandemic. This affects the comparability of the statistics with earlier periods.</p><p>With a small number of tragic exceptions, the decisive action we took at the beginning of the pandemic has meant tens of thousands of officers and prisoners have been kept safe in the face of perhaps the greatest challenge ever to face the service.</p><p>We are under no illusions about the impact of the measures which were put in place to protect lives and we have made prisoners’ wellbeing our priority. We’ve enabled continued family contact through more than 1,500 secure mobile phones and secure video calls and provided a range of in-cell activities to mitigate the impact of isolation. We continue to work closely with the Samaritans who are providing support for Listeners - selected prisoners trained to provide emotional support to their fellow prisoners and who continue to offer their phone service for emotional support.</p><p>More widely, we are spending £100 million to bolster prison security, clamping down on the weapons, drugs and mobile phones that fuel violence and crime behind bars. This is funding tough measures including x-ray body scanners and phone-blocking technology. 	answer	answer is ministerial correction date of answer 31/01/2024 answer text <p>We publish the number of assaults against prison staff, broken down by prison, as part of our Safety in Custody statistics, in Table 8e of the summary tables, available at the following link:</p><p><a href="https://www.gov.uk/government/statistics/safety-in-custody-quarterly-update-to-september-2023" target="_blank">Safety in custody: quarterly update to September 2023 - GOV.UK (www.gov.uk).</a></p><p>Figures up until September 2023 have been published at the above link, however figures for the whole of 2023 are not due for publication until April 2024 and cannot be released at this time.</p><p>We are committed to making prisons a safe place to work and providing prison officers with the right support, training and tools to empower them to do their jobs.</p><p>To protect staff and prisoners in very serious assaults, we are continuing to roll out PAVA – a synthetic pepper spray – for use by prison officers in the adult male estate. Staff are able to use the PAVA spray where there is serious violence or an imminent or perceived risk of it.</p><p>We have rolled out a new Body Worn Video Camera system which has increased the overall number of cameras across public sector prisons to over 13,000. This enables every operational band 3-5 officer on shift to wear a camera. They are supported by a new Policy Framework which mandates the wearing of the cameras.</p><p>The new Body Worn Video Camera system will be fully networked and accessible via current prison IT improving access to footage and the ability to share it with other agencies, with the overall aim of increasing use and transparency. Only Independent Adjudicators, who are District Judges or Deputy District Judges can make an award of additional days to a prisoner’s custodial time left to serve.</p><p> </p><p>Where an act of violence amounts to a criminal offence, prisoners should be investigated by the police and face serious sanctions. The Assaults on Emergency Workers (Offences) Act 2018 has increased sentencing powers for offences of common assault and battery committed against an emergency worker. 	answer	answer is ministerial correction date of answer 01/03/2021 answer text <p>Violence against our hardworking staff will not be tolerated and any prisoner who commits an act of violence will be held to account.</p><p>Currently, data is not held centrally on the number of convictions for crimes committed by a prisoner against prison employees. This is being reviewed with the aim to collate data from all establishments for all crimes committed in prison, whilst also creating guidance on how to appropriately refer crimes committed in prison to the police.</p><p>The ‘Crime in Prison Referral Agreement’ was created in May 2019 and sets out the agreement between Her Majesty’s Prison and Probation Service (HMPPS), National Police Chiefs’ Council (NPCC) and the Crown Prosecution Service (CPS). The aim is to ensure that acts of criminality that occur in prison are appropriately addressed within the Criminal Justice System.</p><p>In line with the Crime in Prison Referral Agreement, assaults against members of staff will be referred to the police for investigation and consideration for prosecution. Less serious assaults, where there is little or no injury, are more appropriately dealt with by the prison disciplinary system.</p><p>The courts retain the discretion to decide whether sentences should be served concurrently or consecutively, based on the facts of the case. The Sentencing Council’s Totality guideline provides courts with guidance on whether sentences should be served concurrently or consecutively. In cases which the prison governor deems the rule-breaking to be sufficiently serious an Independent Adjudicator, appointed by the Chief Magistrate, can attend a prison to award additional days to the prisoner’s custodial time left to serve. Where an act of violence amounts to a criminal offence, prisoners should will be investigated by the police and face serious sanctions.</p><p> </p><p>Information on the proportion of adjudications which resulted in no additional days being added to a prisoner's time in custody by offence is not routinely extracted from the adjudications database, as the primary purpose of the database is to report on the volume of punishments imposed. Data on staff assaults for the calendar year 2023 is subject to future publication on 25 April, in ‘Safety in custody: quarterly update to December 2023’.</p><p>Changes were made to the recording of assaults in April 2017 that affects the reporting of hospitalisation. This change means that a comparable time series for this question can only be provided from 2018 onwards.</p><p>Staff must be able to expect a safe and decent work environment. We will not tolerate any violence against prison officers, and prisoners who are violent towards staff will face the full consequences of their actions.</p><p>We are committed to making prisons a safe place to work and providing prison officers with the right support, training and tools to empower them to do their jobs.</p><p>To protect staff and prisoners in very serious assaults, we have rolled out PAVA – a synthetic pepper spray – for use by prison officers in the adult male estate. Staff are able to use the PAVA spray where there is serious violence or an imminent or perceived risk of it.</p><p>We have rolled out a new Body Worn Video Camera system which has increased the overall number of cameras across public sector prisons to over 13,000. This enables every operational band 3-5 officer on shift to wear a camera. We take improper use of force seriously and have policies in place to address it, should it occur.</p><p> </p><p>The HMPPS Operational Policy Sub-board is responsible for the governance of operational policy, including that which details how staff misconduct and discipline is to be investigated.</p><p> </p><p>The policy states that if evidence of a possible criminal offence comes to light during an internal investigation, or if an allegation of a criminal offence is made against a member of staff, the lead investigator should liaise with the manager who commissioned the investigation regarding the necessity for referral to the police.</p><p> </p><p>The crime can also be reported to the police by prisoners themselves, a fact of which they are made aware. Annex H of the Prisoner Complaints Policy Framework, re-issued on 3 November 2020 prescribes the text of the information leaflet provided to prisoners. We have invested in 5,600 Body Worn Video Cameras (BWVC) across the prison estate which has been rolled out alongside training in staff interaction with prisoners, to support better relationships. We have also begun implementation for a national rollout of PAVA, a synthetic pepper spray, which will provide prison officers with additional safety equipment to reduce the risk of serious injury.</p><p> </p><p>Staff will be able to use the PAVA spray where there is serious violence or an imminent or perceived risk of it and there is an immediate necessity to create a safe and protective environment. Only prisons who have rolled out the key worker scheme – which is vital in building relationships between offenders and staff – will receive PAVA.</p><p> </p><p>Alongside the rollout of PAVA will be the introduction of a new Personal Safety package; (S.P.E.A.R.). This is to ensure that PAVA is introduced as part of a wider package of skills for staff to resolve and deescalate incidents. The training is based on using the body’s natural flinch reaction when faced with danger and focuses on pre-contact cues to give staff greater awareness of their surroundings. We have recruited over 4,700 more prison officers since October 2016 and we now have the greatest number in post since early 2012. The Challenge, Support and Intervention Plan case management process for prisoners at risk of violence has been mandated for all prisons to help staff to manage violent prisoners and those identified as posing a raised risk of being violent.</p><p> </p><p>We have announced an extra £100 million for security, on top of £70 million we were already spending to make prisons safer, more secure and decent. This is part of the Government’s new £2.75bn investment to modernise and maintain our prisons, create 10,000 additional places, and step up security to stop the flow of drugs and mobile phones. We do not hold data on staffing levels in private prisons.</p><p>There were 32,669 assaults in prisons in England and Wales in 2019, of which 26,821 were in public prisons (82% of total assaults) and 5,848 were in private prisons (18% of total assaults).</p><p>There were 9,995 assaults on staff in prisons in England and Wales in 2019, of which 8,579 were in public prisons (86% of all assaults on staff) and 1,416 were in private prisons (14% of all assaults on staff).</p><p>Please note that Birmingham changed from a private prison to a public prison in July 2019. The figures for Birmingham have not been split between the public prisons total and the private prisons total, all assaults in Birmingham for 2019 were recorded as being in private prisons.</p><p>We closely monitor the level of violence in both public and privately managed prisons. 	answer	answer is ministerial correction date of answer 22/09/2020 answer text <p>The number of recorded cases of violence against prison staff is published as part of the Safety in Custody statistics, the figures for each of the last ten years are provided below:</p><p>2010 - 2,848</p><p>2011 - 3,132</p><p>2012 - 2,987</p><p>2013 - 3,266</p><p>2014 - 3,640</p><p>2015 - 4,963</p><p>2016 - 6,844</p><p>2017 - 8,417</p><p>2018 - 10,203</p><p>2019 - 10,033</p><p>Figures for the first quarter of 2020, up until the end of March, show there were 2,290 incidents of violence against prison staff, a decrease of 4% from the previous quarter.</p><p>Violence against our hardworking prison officers is unacceptable, and we work closely with the police and Crown Prosecution Service to bring the perpetrators to justice. Additionally, our new Assaults on Emergency Workers Act means that those who attack them can expect an additional 12 months behind bars.</p><p>We are also giving officers PAVA pepper spray and body-worn cameras to make their jobs safer, as well as access to post incident care teams, occupational health support and counselling for those who need it. More widely, we are spending £100 million to bolster prison security, clamping down on the weapons, drugs and mobile phones that fuel violence and crime behind bars. 	answer	answer is ministerial correction date of answer 06/08/2020 answer text <p>The prisoner discipline system upholds justice in prisons and ensures incidents of prison rule-breaking have consequences. Only Independent Adjudicators, who are District Judges or Deputy District Judges, can make an award of additional days to a prisoner’s custodial time left to serve.</p><p>Where an act of violence amounts to a criminal offence, prisoners should be investigated by the police and face serious sanctions. The Assaults on Emergency Workers (Offences) Act 2018 has increased sentencing powers for offences of common assault and battery committed against an emergency worker.
