Those granted EUSS status will be able to provide a share code, through which NHS trusts can establish their immigration status. EU citizens and non-EU family members will still need to meet the ordinarily residence test to be eligible for free healthcare. Primary medical care is free of charge to all overseas visitors. If they receive and pay for relevant services and then later make a late application which is granted, they will not be refunded for the earlier treatment.</p><p>Where the Home Office accepts a late application to the EUSS and grant a person status under that scheme, the person is non-chargeable from the date on which the late application was made. Settled/pre-settled status is an immigration status related to the European Union Settlement Scheme, securing an individual’s rights under the Withdrawal Agreement to reside in the United Kingdom beyond 2020.</p><p>Access to free NHS secondary care is entirely based on being ‘ordinarily resident’ in the UK. Being ordinarily resident means, broadly, living in the UK on a lawful and properly settled basis for the time being, with non-EEA nationals who are subject to immigration control also required to have an immigration status of ‘indefinite leave to remain’. answer	answer is ministerial correction date of answer 29/06/2020 answer text <p>It is correct European Economic Area and Swiss citizens do not require Home Office confirmation of settled or pre-settled status granted under the EU Settlement Scheme to access National Health Service care.</p><p> </p><p>Individuals may wish to rely on the fact they have been granted status under the Scheme as part of demonstrating their ordinary residence in the UK. The online View and Prove service therefore offers this as an option, should users wish to share their status for this purpose. It is entirely optional.</p><p> </p><p>EEA and Swiss citizens continue to be able to use their passport or national identity card to evidence their right to access services and this will not change until 30 June 2021.</p><p> </p><p>From 2021, when the new immigration system is introduced, EEA or Swiss patients will be required to demonstrate they are ordinarily resident in the UK, as is already presently the case for non-EEA nationals who are not the family member of an EEA citizen. Being ordinarily resident broadly means living here on a lawful and properly-settled basis for the time being.</p><p>It is not currently necessary for an EU citizen to demonstrate that they have status under the EU Settlement Scheme in order to access the NHS. The European Settlement Scheme secures the residency rights for EU citizens who have been residing in the UK prior to the day we leave the EU. A clinician’s role is to provide the relevant healthcare for patients and make decisions on their treatment based on their clinical needs. answer	answer is ministerial correction date of answer 05/09/2019 answer text <p>The Government has made clear in a ‘no deal’ scenario, the rights of European Union citizens, including Spanish and Portuguese citizens, in the United Kingdom on exit day will be protected. This includes being able to access National Health Service care without charge on the basis that they are ordinarily resident in the UK, and the NHS will apply the same eligibility tests as it does now. It should be noted that EU citizens already living in the UK on exit day have up until 31 December 2020 to apply for Settled Status, but their access to healthcare will remain the same regardless of whether they apply for Settled Status before then.</p><p>The Government has proposed to all EU Member States that when we leave, we should maintain the existing healthcare arrangements including the European Healthcare Insurance Card (EHIC) Scheme until 31 December 2020, with the aim of minimising disruption to healthcare provision for UK nationals and EU citizens. This is subject to agreement by individual EU Member States.</p><p>For those Spanish and Portuguese citizens visiting the UK after exit day, if agreed under bilateral agreements with Spain and Portugal, visitors will be able to use their EHIC as they do now. The Chancellor announced on 1 August that he has made an additional £2.1 billion available to prepare for EU Exit which includes the creation of an Operational Contingency Fund, to meet the costs of ‘no deal’ operations. answer	answer is ministerial correction date of answer 05/09/2019 answer text <p>In the event that the United Kingdom leaves the European Union without a deal on 31 October 2019, the Department has advised National Health Service providers that they should continue to establish eligibility for healthcare in the same manner as they do now, including for those EU citizens who have secured Settled Status.</p><p>The Government has made clear that the rights of EU citizens in the UK on exit day will be protected, and this includes being able to access NHS care without charge on the basis that they are ordinarily resident in the UK. EU citizens already living in the UK on exit day have up until 31 December 2020 to apply for Settled Status, but their access to healthcare will remain the same regardless of whether they apply for Settled Status up to then.</p><p>No additional funding has been allocated to trusts to carry out eligibility checks for EU citizens. The Chancellor announced on 1 August that he has made an additional £2.1 billion available to prepare for EU Exit which includes the creation of an Operational Contingency Fund, to meet the costs of ‘no deal’ operations. The Department has already updated operational guidance and websites with the latest information for both EU citizens who wish to access NHS healthcare upon exiting the EU to EU citizens who are NHS staff. All EHIC activity correctly reported by NHS secondary providers, so that the UK is able to make appropriate reimbursement claims from other member states, allows them to access an additional 25% funding;</p><p> </p><p>- The revision of the NHS (Charges to Overseas Visitors) Regulations which came into force on 6 April 2015, reducing the number of exemption from charge categories and realigning the Regulations to the principle that the NHS is a residency-based healthcare system; and</p><p> </p><p>- Support and engagement with NHS providers through meetings with senior trust employees and the launch of a cost recovery support team to provide bespoke assistance to trusts to improve their processes for identifying chargeable patients and recovering funds owed, including those from Europe.</p><p> </p><p>The Department is currently consulting on the extension of charging overseas visitors and migrants using the NHS in England. Part of the consultation proposes to amend the residence definition for EEA nationals, by which they qualify for free NHS treatment in England.
