	answer	answer is ministerial correction date of answer 21/11/2014 answer text The Government’s reasons for proposing a three-year transition period for implementing s74 Enterprise and Regulatory Reform Act 2013 are set out in its recent consultation which concluded on 27 October 2014 (https://www.gov.uk/government/consultations/transitional-provisions-for-the-repeal-of-section-52-of-the-cdpa). This does not represent an extended transition period but the Government’s provisional judgement as to the shortest reasonable period, taking into account the needs of both right owners and those using the current law to trade lawfully. The Government is considering the evidence it received and will make its decision on transitional provisions in the light of this. Current items made under the aegis of s52 of the Copyright, Designs and Patents Act 1988 would not be considered counterfeits. A residential lease itself is not considered a service, as it is an “interest in land”, and, as such, chapter 4 of the Consumer Rights Bill does not apply. Chapter 2 of Part 1 of the Consumer Rights Bill applies to contracts between a trader and a consumer, for the trader to supply goods to a consumer. However, the operational management of each contract continues to rest with the respective project SRO (Senior Responsible Owner) or team, and there may often be valid reasons for any subsequent contract changes. Prior to September 2012, the costs of prisoners’ tuition were met from public funds in an arrangement that broadly mirrored the Grant arrangements for other part-time HE students. From September 2012, prisoners have been required to take out, and then repay, Tuition Fee loans in the same way as other learners.</p><p> </p><p>The OU’s additional costs for delivering in custody are met through a Grant from the Department. Table 1 below shows a breakdown of grant payments in each of the last 10 years.</p><p> </p><p>The costs of providing prison university education are found from a variety of sources and gathering the data could only be undertaken at disproportionate cost.</p><p> </p><p>Table 2 gives a breakdown of the number of prisoners studying towards an Open University degree whilst in prison in each of the last 10 years. There may be a very small number of prisoners, each year, who will have commenced HE with Universities other than the OU whilst on Release on Temporary Licence.
