	answer	answer is ministerial correction date of answer 13/05/2014 answer text <p>Allegations of benefit fraud are investigated by the Department for Work and Pensions (DWP). Administrative penalties are financial penalties, which can be offered as an alternative to prosecution, where there has been no previous fraud penalty of any form. These are issued by the DWP and Local Authorities. Cautions are issued by the Police.</p><p>The records held by the Crown Prosecution Service (CPS) identify the number of offences in which a prosecution commenced and, reached a first hearing in magistrates' courts, rather than the number of defendants prosecuted and convicted or their gender.</p><p>No central records of the prosecution outcomes of offences are held by the CPS. To obtain details of the number of people prosecuted for and convicted of offences of benefit fraud, which can be charged under various sections of the Social Security Administration Act 1992, Section 35 of the Tax Credits Act 2002 or the Fraud Act 2006, including their gender, would require a manual exercise of reviewing individual case files to be undertaken at a disproportionate cost.</p><p>Furthermore, cases of benefit fraud are also prosecuted by Local Authorities so any data the CPS can glean from a manual exercise would not provide a complete record.</p><p> </p> answering member constituency North East Hertfordshire answering member printed Oliver Heald question first answered 13/05/2014 12:00:00 answering member 69 label Biography information for Sir Oliver Heald

This guidance is published on the CPS website at: <a href="http://www.cps.gov.uk/legal/d_to_g/domestic_violence_aide-memoire/#a25" target="_blank">http://www.cps.gov.uk/legal/d_to_g/domestic_violence_aide-memoire/#a25</a></p><p>Witness summonses can be effective in ensuring complainants attend court when they would not otherwise do so. They can also support victims who are concerned about how a voluntary decision to attend court might be perceived by ‘removing' the pressure of making that decision for them. 	answer	answer is ministerial correction date of answer 01/12/2014 answer text <p>On 6 October 2014 the Crown Prosecution Service (CPS) accepted guilty pleas to one count of making an explosive substance, three counts of possessing a prohibited firearm and one count of putting a person in fear of violence by harassment. The pleas were accepted on the basis that if Harry Street’s mental health ever deteriorated to the same extent it had in 1978 he was undoubtedly capable of deploying the weapons.</p><p>The decision not to proceed with the four remaining counts was taken in accordance with the Code for Crown Prosecutors which provides: “Prosecutors should only accept the defendant’s plea if they think the court is able to pass a sentence that matches the seriousness of the offending”. In view of the evidence before the court, it was clear to the CPS that the sentence imposed by the court would be a restricted hospital order under section 37 and section 41 of the Mental Health Act 1983 whether he was convicted of all counts, or those which were accepted as pleas.</p><p>In making a restricted hospital order, the Learned Judge fully supported the approach taken by the CPS.
