The SFO investigates and prosecutes only the most serious or complex fraud, bribery and corruption cases.</del></p><p><del class="ministerial">The decision to commence an investigation is that of the Director alone. Government cannot interfere with the operational independence of investigative or prosecutorial agencies. star this property answer text <p>In the Action Plan for anti-money laundering and counter-terrorist finance, published on 21 April, the Government sought the views of respondents on whether unexplained wealth orders (UWOs) should be implemented in the UK, as part of the wider consultation on a range of proposals for tackling these crimes. UWOs would be used to require an individual to explain to the court the origin of his or her assets. This can provide critical information on which law enforcement agencies can build their case.</p><p>The Action Plan also sought the views of respondents on whether a new forfeiture power should be created to enable the forfeiture of any assets for which a satisfactory explanation cannot be given to the court. The consultation closed on 2 June, and the Government is currently considering the responses, and engaging with public and private stakeholders to gather wider views. The response to the consultation will be published in due course.</p> more like this

star this property answer text <p>Unexplained Wealth Orders (UWO) were placed in statute by the Criminal Finances Act which was passed on 27 April 2017. It is a powerful tool that will help tackle serious crime and international corruption. Agencies with civil recovery powers, such as the NCA and the Serious Fraud Office, can apply to the High Court for a UWO where the agency thinks that an individual holds property, and there are reasonable grounds to suspect that the known sources of the individual’s lawfully obtained income would be insufficient to enable the individual to obtain that property.</p><p>If the person provides information in response to a UWO, the enforcement authority can then decide whether to investigate further, take recovery action or take no further action. If the person does not comply with a UWO, the property identified in the order is presumed to be recoverable under any subsequent civil recovery proceedings.</p><p>However, there are a number of dependencies which must be implemented before this measure can be commenced. Work has begun on drafting new court rules and providing law enforcement agencies with guidance and training on how to use this measure. A statutory code of practice is also being drafted, and will undergo a public consultation prior to it being laid under the affirmative procedure. To ensure that law enforcement are able to confidently and robustly use UWOs, we will seek to commence UWOs once all these dependencies are in place.</p>

star this property answer text <p>Unexplained wealth orders (UWOs) can be used to compel individuals to explain the sources of their wealth where it is suspected that their lawful income would be insufficient to obtain specified property, if they are a non-EEA politically exposed person, or suspected of being involved in serious crime. This is a powerful new weapon for tackling illicit finances and corruption.</p><p>Since the legislation came into force on 31 January 2018, the first UWOs have already been issued by the courts to investigate assets totalling £22 million. In addition to the UWOs, the courts granted interim freezing orders (IFOs), meaning that the assets cannot be sold, transferred or dissipated while subject to the IFO.</p> more like this
