The Treasury Solicitor represents most, but not all, government departments in litigation. For example, Her Majesty’s Revenue and Customs normally conducts its own litigation. That is why this Government has taken action on both releases on temporary licence (ROTL) and absconds from prison.</p><p> </p><p>We commissioned a fundamental review of ROTL policy and practice last year and, in March, announced a package of measures to ensure that the public was properly protected. We have brought forward some of those measures so that they take effect immediately; particularly with more serious offenders, where the review concluded that an enhanced risk assessment approach should be taken.</p><p> </p><p>Absconds have reached record lows under this Government but each incident is taken seriously. Immediate changes have already been ordered to tighten up the system as a matter of urgency. Prisoners will no longer be transferred to open conditions or allowed out on temporary release if they have previously absconded.</p><p><ins class="ministerial">My officials are currently working to provide the information requested. HEE is responsible for ensuring a secure workforce supply for the future balancing need against demand, taking into account factors such as the age profile of the existing workforce, the impact of technology, and new drugs.</p><p> </p><p>The Department has recognised the need to increase the general practitioner (GP) workforce and between September 2010 and September 2013, the number of full time equivalent GPs has risen by 1,051. Additionally, the Department has included in the HEE mandate a requirement that “HEE will ensure that 50% of trainees completing foundation level training enter GP training programmes by 2016”.</p><p> </p><p>Further work is being undertaken by HEE to improve applications and fill rate in to GP training to support the mandate target of 3,250 appointments into GP training by 2016 in England. This includes a review of the GP recruitment process, developing a pre-GP year to give exposure to prospective GP applicants of the specialty and careers advice for foundation doctors and medical students.</p><p> </p><p>In recognition of the contribution the GP workforce makes in the NHS, HEE will also undertake additional work on GP recruitment and retention, return to practice and reducing attrition rates, all of which will play a part in increasing the GP workforce.</p><p> </p><p>The following table indicates the number of posts commissioned and filled and the fill rate for GP training in England for the last five years. NHS England sets out how it will achieve the objectives in the Mandate in its 2014-15 – 2016-17 business plan. The Government will hold NHS England to account for its achievement.</p><p> </p><p><em>Everyone Counts: Planning for Patients 2014/15 to 2018/19</em>sets out a framework within which commissioners will need to work with providers and partners in local government to develop five year plans to secure the continuity of sustainable high quality care for all. Building on <em>Everyone Counts</em>, NHS England is beginning a programme of work to consider how to improve quality of and access to health care for people with learning disabilities. Within the framework there is specific reference to <em>Transforming Care: A national response to Winterbourne View Hospital. </em>This is a non-negotiable item that NHS England expects to be part of every relationship between commissioners and providers. The Recruiting Partnering Project remains within the overall agreed cost of £1.360 <ins class="ministerial">billion. </ins><del class="ministerial">million.</del><br /><br />My right hon. Friend the Secretary of State for Defence (Philip Hammond) set out on 14 January 2014 the cost of Capita providing a new Information Technology platform as part of the Recruiting Partnering Project (Official Report: column 716). At the time, these costs were expected to be around £47.7 million directly linked to the change of hosting provision. Since this statement, these costs have reduced to around £42.9 million. <br /><br />As previously stated by the Secretary of State on 14 January, there has been an additional cost of around £1 million per month to run the Capita system. The Government has revised the national curriculum and set more rigorous and challenging content in English and mathematics to match the highest performing countries around the world. The new programmes of study for English and maths will challenge pupils to realise their potential in an increasingly competitive global market.</p><p> </p><p>The new maths GCSE will have more content, be more challenging and – alongside English - will be double weighted in school performance tables. The Department has recently allocated £11 million to fund <del class="ministerial">over</del> 32 new maths hubs to support a more challenging maths GCSE to improve the quality of maths education. This initiative, which includes a teacher exchange programme with Shanghai, will enable every school and college in England, from early years to the post-16 sector, to access locally-tailored support in all areas of maths teaching and learning.</p><p> </p><p>The new national curriculum for English places a greater emphasis on reading and requires pupils to study a range of books, poems and plays.</p><p>The national curriculum for English will give teachers greater flexibility and freedom which will help to raise standards and expectations for all pupils. It has been significantly slimmed down and will free up teachers to use their professional judgement to design curricula that meet the needs of their pupils.</p><p> </p><p>The new English language GCSE will place greater demands on pupils and has more emphasis on those skills demanded by employers. 	answer	answer is ministerial correction date of answer 07/07/2014 answer text <p>The number of offenders (including young people) cautioned, for offences of rape, sexual assault, robbery and burglary, by months in England and Wales from 2010 to 2013 (latest available) can be viewed in the table. There were no cautions administered for murder.</p><p><del class="ministerial">Simple cautions (previously police cautions) are a non-statutory disposal available to the police to dispose of any offence committed by an adult and designed for dealing with low level, mainly first time offending. The Government does not believe that cautions are appropriate for serious offences. We issued new guidelines on 14 November 2014 following a detailed review of how cautions were being used by police forces, and are strengthening the law to prevent cautions being used for serious offences.</del></p><p> </p><p>The Ministry of Justice issues guidance on the process to be followed by the police and the CPS when they are administering simple cautions for adult offenders. This guidance states that the use of a simple caution for indictable only offences, such as rape, should only be given following authorisation by the CPS. These will be cases where there were exceptional circumstances which would mean that it was not in the public interest to prosecute.</p><p> </p><p>The overall number of simple cautions issued has halved since 2007. The cautioning rate, that is, the number of offenders cautioned as a percentage of offenders who were either cautioned or convicted, in 2013 was 20 per cent; this has declined from a peak of 31 per cent in 2007.</p><p>The Government is clear that serious offences should always be brought to court and to ensure that there is increased public confidence in the justice system last year announced limits on the use of simple cautions. As announced by the then Minister for Personnel, Welfare and Veterans (Andrew Robathan) on 12 December 2011 (Official Report, column 63WS), these arrangements have been discontinued. Properties which were formerly categorised as OSRs are being phased out on a rolling basis as personnel retire or move on to other posts. However, senior officers remain entitled to Service Family Accommodation (Type 1 or Type 2). In addition, the Department is undertaking an ongoing review into domestic assistance policy to ensure that the level of support provided to senior entitled officers is appropriate and driven by a clear business need. Under a life sentence, and an indeterminate sentence for public protection (IPP), the court determines the minimum period to be served in prison for the purposes of punishment and deterrence. Prisoners serving these indeterminate sentences have no automatic right to be released. If released they are subject to recall for the rest of their life or, in the case of an offender serving an IPP, for at least 10 years. Public protection is the priority and the release of indeterminate sentence prisoners once they have served their minimum term is entirely a matter for the Parole Board.</p><p>Progression to open conditions is never automatic and only follows a satisfactory assessment of risk, generally involving the independent Parole Board in the case of prisoners serving indeterminate sentences.</p><p>The Parole Board may recommend such prisoners for open conditions if, for example: they have successfully completed any offending behaviour programmes identified in their sentence plan as essential to the risk reduction process; their behaviour in custody is such that it is considered that a move is appropriate; and their risks are manageable in open conditions.</p><p>Once allocated to open prison, prisoners continue to be monitored and are returned to closed prison immediately if there are any concerns about their suitability for low security conditions.</p><p> </p><p>Open prisons have been used since 1936, because they are the most effective means of ensuring that prisoners are suitably risk-assessed before they are released into the community under appropriate licence conditions. When a prisoner moves to the less rigid structure of open conditions an assessment can be made in a relatively safe environment of how the prisoner will adapt to increasing responsibility. The latest guidance, issued in November 2013 following the Simple Cautions Review, states that the use of a simple caution for indictable-only offences, such as rape, should only be given following authorisation by a senior police officer of at least the rank of Superintendent and the Crown Prosecution Service. Everyone who is entitled to the minimum wage should receive it.</p><p> </p><p>The Government has collaborated with care sector representative bodies to improve understanding of compliance risks and design controls within payroll systems that prevent workers being underpaid the minimum wage, in order to improve compliance.</p><p> </p><p>Guidance on Gov.uk has been updated to make it as clear as possible that travel time and rest breaks between assignments must be paid at least the national minimum wage (NMW).</p><p> </p><p>In addition, the Government will continue to work with the sector to ensure that understanding improves. This will include the Department of Health’s statutory guidance as part of the overall guidance on market shaping and commissioning the final version of which will be published in Autumn 2014.</p><p> </p><p>We have considered the National Audit Office report and note that their estimates come from a self-reported survey of care workers. Examination of surveys of individuals (such as the Labour Force Survey) find that some people tend to report longer working hours and a lower hourly rate compared to those reported by employers who pay the minimum wage.</p><p> </p><p>The current best estimate of non-compliance is derived from the Annual Survey of Hours and Earnings (ASHE)[1]. The Low Pay Commission[2] published the proportion of jobs held by those aged 22 and over, paid below the NMW by sector. Figures show that non-compliance is relatively low in social care (0.8%) compared with other sectors. This is generally in line with non-compliance in the whole economy.</p><p> </p><p> </p><p>This estimate, as well as all estimates of non-compliance, has some limitations. 	answer	answer is ministerial correction date of answer 18/11/2014 answer text <p>There were a total of 70 adult prisons which had one or more directly employed Muslim chaplain on 30 June 2014, representing 65% of all adult establishments. 14 establishments in the youth secure estate had one or more directly employed Muslim Chaplain on 30 June 2014, representing 93% of the establishments. This information includes both public and private sector establishments.</p><p> </p><p>Access to Muslim Chaplains is more widespread than it appears from these figures. There are <del class="ministerial">393 imams employed across the prison estate, and the majority of establishments have access to Muslim Chaplains even if they don’t have a directly employed Muslim Chaplain attached to the establishment.</del><ins class="ministerial">100 imams employed across the prison estate and additionally over 100 Muslim Chaplains appointed on a sessional basis. All prisons have multi faith chaplaincy teams to provide and enable religious and pastoral care. These teams invariably include at least one Muslim Chaplain to provide for the religious needs of the Muslim prisoners. There are however one or two prisons where it has not yet been possible to appoint a Muslim Chaplain and the Muslim Adviser is working to appoint these.
