An assessment of the impact of all border, immigration and citizenship (BIC) fees was published as an associated document to the Immigration and Nationality Fees (Regulation) 2018. In response to a recommendation from the Independent Chief Inspector of Borders and Immigration the Department will consider publication of fee-related Policy Equality Statements on a case by case basis going forward.</p><p>Statistics on the UK’s resident population and on births by nationality of parent are a matter for the Office for National Statistics.</p><p>The Home Office stateless leave policy is designed to assist those who are unable to return to their country of former habitual residence because they are stateless and no longer have a right of residence there. This also reflects our obligations under the UN Stateless Conventions by providing a means for stateless persons in the UK to access their basic human rights and is part of our efforts to address wider global issues facing stateless persons. Leave to remain applications to stay in the UK as a stateless person are free of charge.</p><p>There are citizenship routes for children who are born in the UK: if their parent becomes British or settled, or if they live in the UK for the first ten years of their life. The primary aim of that Act was to restrict citizenship to those with a close and continuing connection with the UK. Since 1983 a child born in the UK will only be a British citizen if either parent is a British citizen or settled in the UK. Any individual may be deprived of their British citizenship if the Secretary of State is satisfied that it would be conducive to the public good and all such decisions are taken personally by the Home Secretary.</p><p>Decisions to deprive can be made on conducive grounds where individuals pose a threat to national security, have been involved in war crimes, serious and organised crime, or demonstrated unacceptable behaviours such as extremism, fomenting hatred, or glorifying terrorist violence.</p><p>Decisions to deprive are compatible with the UK’s international obligations under the UN Convention on the Reduction of Statelessness. The threshold for such decisions is high and the power is used sparingly. Section 40(3) allows the Secretary of State to deprive a person who has obtained citizenship by naturalisation or registration, where the Secretary of State is satisfied that citizenship was obtained by means of fraud, false representation or concealment of material fact</p><p>Three reports have been published to date in 2015, 2017 and 2018, which provide figures for section 40(2) deprivations, those where the Home Office has deemed that to deprive individuals of their citizenship is conducive to the public good. A person who is of the first generation born outside the United Kingdom to a British citizen would usually be a British citizen by descent. There is no difference in the quality of citizenship between those who are British citizens by descent and those who acquire it by birth, registration or naturalisation in the UK. All have the same rights and access to services in the UK or consular services while overseas.</p><p>A person who is a British citizen by descent cannot usually pass on that citizenship to a child born overseas unless they were in Crown service at the time of the child’s birth. 	answer	answer is ministerial correction date of answer 07/09/2018 answer text <p>Under section 40 of the British Nationality Act 1981, as amended in 2006 and 2014, the Secretary of State is empowered to deprive, by order, any person of any form of British nationality if satisfied that:</p><ul><li>such deprivation is conducive to the public good (section 40(2))</li><li>the individual has acted in a manner seriously prejudicial to the vital interests of the UK ( section 4A));</li></ul><p>Under Section 40(3) of the British Nationality Act, the Secretary of State may by order deprive a person of a citizenship status which results from his registration or naturalisation if the Secretary of State is satisfied that citizenship was obtained by means of fraud, false representation or concealment of a material fact</p><p>When seeking to deprive on the basis that to do so is conducive to the public good, the law requires that this action proceed only if the individual concerned would not be left stateless, unless action is taken under the specific provisions in 4A,. In that case, deprivation will only occur if the person is able, under the laws of another country, to obtain another citizenship. The principle of that Convention is that statelessness should be avoided. It seeks to prevent statelessness by prohibiting the withdrawal of citizenship from the nationals of a state when doing so would result in them becoming stateless. British nationality legislation reflects this position and therefore only makes provision for British Protected Person status to be lost automatically where a person has another nationality.
