star this property answer text <p>Some parts of Section 36 of the Equality Act 2010 were commenced following Royal Assent to that Act. In March 2018, the Government announced its intention to commence the remaining parts of Section 36 in its response to the Women and Equalities Select Committee report on disability and the built environment. A commencement date will be announced in due course, after further work to identify and assess any additional burdens on local authorities.</p> more like this

The announcement made clear that further work on identifying and assessing any additional burdens on local authorities is first required before a commencement date can be given. We hope to make an announcement on timing of commencement of Section 36 of the Equality Act 2010 as soon as possible. more like this

star this property answer text <p>The enforcement powers of the Equality and Human Rights Commission are set out in sections 20 to 32 of the Equality Act 2006, as amended by the Enterprise and Regulatory Reform Act 2013. The Commission can investigate an unlawful act (section 20); issue an unlawful act notice (section 21); apply to a court for an action plan from a person served with an unlawful act notice (section 22); seek an injunction where necessary (section 24); provide legal assistance to an individual who is or may become party to legal proceedings (section 28); initiate or intervene in judicial review proceedings (section 30); and issue a compliance notice where it thinks that a public authority has failed to comply with the public sector equality duty (section 32).</p><p> </p> more like this

star this property answer text <p>The current definition of ‘long term’ conditions under the Equality Act 2010 allows the courts flexibility when applying the law in individual cases. We recognise that there are concerns that the protections offered by the Act can be hard to access for people with fluctuating conditions. The robustness of the definition is one of the issues we are exploring in our consideration of extending protections from discrimination in the workplace for those with mental health disorders.</p> more like this

star this property answer text <p>The Government’s contribution to the five-year review of the Equality Act 2010 is a substantive memorandum intended to facilitate post-legislative scrutiny of the Act, which we aim to publish as a Command paper shortly.</p><p>The memorandum will provide Parliament with a factual account of developments since the Act received Royal Assent five years ago. This will include a summary of why the Act was introduced, a breakdown of which elements have or have not come into force, a list of associated secondary legislation, a summary of key case law and a preliminary assessment outlining whether the Act is achieving its stated aims.
