	answer	answer is ministerial correction date of answer 07/07/2014 answer text <p>The number of offenders (including young people) cautioned, for offences of rape, sexual assault, robbery and burglary, by months in England and Wales from 2010 to 2013 (latest available) can be viewed in the table. There were no cautions administered for murder.</p><p><del class="ministerial">Simple cautions (previously police cautions) are a non-statutory disposal available to the police to dispose of any offence committed by an adult and designed for dealing with low level, mainly first time offending. The Government does not believe that cautions are appropriate for serious offences. We issued new guidelines on 14 November 2014 following a detailed review of how cautions were being used by police forces, and are strengthening the law to prevent cautions being used for serious offences.</del></p><p> </p><p>The Ministry of Justice issues guidance on the process to be followed by the police and the CPS when they are administering simple cautions for adult offenders. This guidance states that the use of a simple caution for indictable only offences, such as rape, should only be given following authorisation by the CPS. These will be cases where there were exceptional circumstances which would mean that it was not in the public interest to prosecute.</p><p> </p><p>The overall number of simple cautions issued has halved since 2007. The cautioning rate, that is, the number of offenders cautioned as a percentage of offenders who were either cautioned or convicted, in 2013 was 20 per cent; this has declined from a peak of 31 per cent in 2007.</p><p>The Government is clear that serious offences should always be brought to court and to ensure that there is increased public confidence in the justice system last year announced limits on the use of simple cautions. That is why this Government has taken action on both releases on temporary licence (ROTL) and absconds from prison.</p><p> </p><p>We commissioned a fundamental review of ROTL policy and practice last year and, in March, announced a package of measures to ensure that the public was properly protected. We have brought forward some of those measures so that they take effect immediately; particularly with more serious offenders, where the review concluded that an enhanced risk assessment approach should be taken.</p><p> </p><p>Absconds have reached record lows under this Government but each incident is taken seriously. Immediate changes have already been ordered to tighten up the system as a matter of urgency. Prisoners will no longer be transferred to open conditions or allowed out on temporary release if they have previously absconded.</p><p><ins class="ministerial">My officials are currently working to provide the information requested. There are therefore no plans to recover payments made from legal aid to Public Interest Lawyers following their statement on 20 March.</p><p> </p><p>On 20 March, at the Al-Sweady Inquiry into the most serious allegations against British soldiers in the Iraq War, lawyers representing Iraqi families withdrew their claim that the troops had killed unarmed civilians they had captured and brought back to an army base.</p><p> </p><p>The inquiry continues and the statement on 20 March does not mean that the inquiry has been abandoned.</p><p> </p><p>Legal aid was provided for an action prior to the Inquiry. Legal aid was provided to Iraqi applicants to seek an independent and effective investigation into deaths and torture or inhumane and degrading treatment in relation to the incident at checkpoint Danny Boy in Iraq in May 2004. As a result of these proceedings, the Secretary of State for Defence decided to hold the Al-Sweady Inquiry. This action was therefore successful in its aim.</p><p> </p><p>The Inquiry is not yet complete and the Chairman's report is not due to be published until later in the year. 	answer	answer is ministerial correction date of answer 07/04/2014 answer text <p> </p><p> </p><p>HM Prison The Verne started taking immigration detainees as scheduled from 24 March 2014. The National Offender Management Service (NOMS) will retain The Verne as a prison in the short term. Its designation as a prison will be reviewed later this year, with the intention of completing the re-designation to an immigration removal centre by the end of September 2014.</p><p> </p><p>While The Verne retains its designation as a prison it will be governed by Prison Rules rather than Detention Centre Rules. As The Verne is not governed by Detention Centre Rules, Rule 35 of those rules is not applicable.</p><p> </p><p>Detainees held at The Verne will be treated in the same way as other detainees held within the prison estate. As such they will not have access to mobile telephones or the internet, nor will they be able to receive telephone calls. They will, however, be able to make telephone calls and will have access to both social and legal visits.</p><p> </p><p>There is a dedicated Home Office Immigration Enforcement Team on site who will see detainees routinely on induction and upon request.
