unstar this property answer text <p>The Department carefully considers all recommendations made by the Parliamentary and Health Service Ombudsman (PHSO). This case is no different, and following the publication of the report, we took swift action to apologise unreservedly to Ms U for the failures made in her case and paid her the recommended consolatory payment plus interest on the arrears that were paid in 2017 as recommended in the PHSO report.</p><p> </p><p>With regards to the other systemic recommendations on compensation made in the report the Department does not consider these to be a reasonable or proportionate course of action to take. We have ensured people have been rightly reimbursed arrears of Employment and Support Allowance owed as part of the special exercise, making 118,000 benefit arrears payments in full.</p><p> </p><p>Where an individual feels their circumstances are exceptional and they may be eligible for a Special Payment, they can contact the Department and set out their reasons. All requests received will be considered on a case-by-case basis.</p>

unstar this property answer text <p>For clarity, and following checks with the Table Office, it appears question UIN 155401 referenced in part (b) of the question was answered on 3 July 2018.</p><p> </p><p>The relevant Parliamentary Questions were corrected with a letter to the Member for Kensington which was issued on 3 May 2019 and a copy placed in the House Library.</p><p> </p><p>It was decided to make the correction this way because of the time that had elapsed since the original answers were given, and to provide a correction to all of the answers at once to avoid potential confusion. They cannot now be amended on the Parliament Q&amp;A System because we are now in a different Parliamentary session.</p> more like this

unstar this property answer text <p>The following companies were involved alongside DWP in the design and maintenance of (i) Employment and Support Allowance, (ii) the transition from Incapacity Benefit to the Employment and Support Allowance and (iii) National Insurance credits for Employment and Support.</p><p> </p><p>The Employment and Support allowance (ESA) service was initially designed by Electronic Data Systems (EDS) who later became Hewlett Packard Enterprise Systems (HPES) in August 2008, working with DWP to implement it.</p><p> </p><p>HPES continued to maintain and support ESA until 2016 when the Government company BPDTS Ltd (Benefits and Pensions Digital Technology Services) was established to provide digital technology services to the DWP. The Company’s employees were public servants who provided a full range of digital technology services to DWP. BPDTS was formally classified as a non-departmental public body. BPDTS colleagues were subsequently transferred into DWP in 2021.</p><p> </p><p>The ESA benefit is now developed and maintained by an in-house DWP team.</p>

unstar this property answer text <p>The Department, in conjunction with the assessment provider (the Centre for Health &amp; Disability Assessments (CHDA)), regularly reviews the guidance provided to Health Care Professionals (HCPs) conducting Work Capability Assessments. The guidance in place for HCPs, in relation to a request for a home visit, states that they can consider evidence from the claimant’s GP or from other health professionals involved in their care.</p><p> </p><p>In addition, DWP has been working with CHDA to identify potential new approaches to determining home visit eligibility with the aim of reducing the need to request evidence from claimants in the future.</p> more like this

These can be found <a href="https://www.gov.uk/government/statistics/income-related-benefits-estimates-of-take-up-financial-year-2018-to-2019" target="_blank">here.</a> Figures for 2018/19 were affected by no new claims for income-related ESA and IS from December 2018 as a result of Universal Credit rollout. No figures have been published for ESA/IS since 2018/19 due to the roll out of Universal Credit.</p><p> </p><p>No estimates of the volume of entitled non-recipients of New Style (contributory) ESA have been made.</p> more like this

It is not possible to submit a new claim for income-related ESA.</p><p> </p><p>As part of our proposal to improve the design of the benefits system, the UK Government is committed to maintaining a contributory health and disability benefit.
