star this property answer text <p>Determining which clinical commissioning group (CCG) is responsible for an individual’s care is relevant to broader National Health Service provision as well as to Continuing Healthcare. In 2013, NHS England published guidance on this subject: ‘Who Pays? Determining responsibility for payments to providers’. This includes guidance on transferring funding between CCGs in the event that an individual moves home. The guidance is available at the following link:</p><p><a href="https://www.england.nhs.uk/wp-content/uploads/2014/05/who-pays.pdf" target="_blank">https://www.england.nhs.uk/wp-content/uploads/2014/05/who-pays.pdf</a></p><p>The NHS England guidance sets out that the key element for determining responsibility is identifying the ‘usual residence’ of the individual concerned. This is based either on where the individual is registered with a general practitioner (GP) or, if they are not registered with a GP, the place where the individual is living.</p><p>Both this guidance and the National Framework for NHS Continuing Healthcare and NHS-funded nursing care emphasise the importance of ensuring continuity of care when a patient moves.</p><p>If there is a dispute between CCGs then CCGs should agree interim measures until the dispute is resolved through their own local dispute resolution process. If the dispute cannot be resolved in this way, then the matter should be forwarded to NHS England.</p><p><strong> </strong></p>

star this property answer text <p>Under the National Framework for Continuing Healthcare and NHS Funded Nursing Care (October 2018), a clinical commissioning group (CCG) must accept and immediately action a Fast Track Pathway Tool where the Tool has been properly completed.</p><p> </p><p>The National Framework states that CCGs should have processes in place to enable Fast Track care packages to be commissioned quickly and it is not appropriate for individuals to experience delay in the delivery of their care package while concerns over the use of the Fast Track Pathway Tool are resolved.</p><p> </p><p>NHS England is responsible for holding CCGs to account if they are not following the National Framework.</p> more like this

star this property answer text <p>The statistical information regarding individual clinical commissioning groups (CCGs) and the eligibility of Fast Track applications is attached.</p><p> </p><p>In the last 12 months, all completed assessments for the Continuing Healthcare Fast Track Pathway have resulted in the individual being found eligible. This is because, under the National Framework for Continuing Healthcare and NHS-funded Nursing Care, the completed Fast Track Pathway Tool, with clear reasons why the individual fulfils the criteria and which clearly evidences that an individual is both rapidly deteriorating and may be entering terminal phase, is in itself sufficient to establish eligibility.</p><p> </p><p>However, some Fast Track Pathway referrals do not meet this criteria. The National Framework for Continuing Healthcare and NHS-funded Nursing Care specifies that ‘exceptionally, there may be circumstances where CCGs receive a completed Tool which appears to show that the individual’s condition is not related to the above criteria at all.’ In these instances, NHS England advises that the referral be recorded as ‘discounted before assessment’. This category also includes other scenarios, for instance those cases where the individual passes away.</p><p> </p><p>Data regarding this group has only been collected since the second quarter of 2018-19. During the six months for which we have data since then, 1,838 referrals have been recorded as ‘discounted before assessment’. During this period, 45,484 referrals for the Fast Track Pathway were assessed as eligible.</p>

CCGs are responsible for setting their own time periods for each ‘stage’ of the process including notice periods to families and timeline expectations from third parties regarding requests for information.</p> more like this

star this property answer text <p>The Department is currently working to update the National Framework for NHS Continuing Healthcare (CHC) and National Health Service-funded nursing care. This has included a structured engagement process with partners in NHS England and local government, as well as interested stakeholders, service users and charities on proposed changes to the National Framework. The CHC Alliance were included in this engagement process and raised this particular issue.</p><p> </p><p>The update to the National Framework is intended to provide greater clarity for clinical commissioning groups and local authorities on a number of elements of the CHC process. The updated National Framework will be published shortly.</p> more like this
