star this property answer text <p /> <p>On 12 March 2014 the Justice Secretary informed the House that G4S had agreed to repay £108.9m owed to Government on the company’s electronic monitoring contract and on two contracts for facilities management in the courts. This followed the Justice Secretary’s announcement on 19 December 2013 that Serco had agreed to repay £70.5m owed on the company’s electronic monitoring and prisoner escort contracts.</p><p> </p><p>The sums in question also included provision for the direct costs to Government arising from these matters.</p><p><strong> </strong></p><p>Both companies have repaid all money requested in accordance with the settlement agreements.</p><p> </p><p>We are not aware of any outstanding debts owed to this Department by the companies. We are managing all MoJ contracts robustly and would take swift action to recover any debt owed should we become aware of such an issue.</p> more like this

star this property answer text <p /> <p>Any crime committed in prison is liable to be reported to the police depending on the aggravating and mitigating factors present and many offences committed in prison are already investigated by the police. The recently announced protocol on appropriate handling of crimes in prison sets out those crimes within prisons, including violent crimes, which must be reported by establishments to the police for consideration for investigation. It will be published before the end of the financial year following final consultation. The NOMS Unions are supportive of the protocol.</p><p> </p><p>Potential costs arising from any increase in the number of serious crimes that will now be dealt with by way of the Criminal Justice System rather than the prison disciplinary system will depend on a number of factors and the costs are expected to be covered through prioritising within existing Police and Departmental budgets for handling crime.</p><p> </p><p>The aim of the protocol is to strengthen existing policy and requirements on the reporting of crime. It is not intended to remove the internal prison adjudication system which can still be a cost effective means of dealing with minor crime in prison. We do not anticipate large numbers of additional crimes being processed through the courts as a result of this protocol. Rather, the protocol will be used to ensure that in those instances where a serious assault or other serious crime occurs there is greater consistency across prison, police and CPS areas in how it is dealt with so that this type of crime can be targeted. The protocol is subject to annual evaluation and review by the signatories.</p><p> </p><p>Tackling violence in prisons is a major priority of this Government and appropriate steps are being taken to manage increased levels of violence within a complex and challenging prison population. We will be issuing new guidance on managing violence early next year. The impact of the overall package of violence management measures will be monitored closely in the coming year. Consultation on all aspects of the revised violence management policy is ongoing. Trade Unions will be included in this consultation.</p>

They are provided for by the Prison and Young Offender Institution Rules which require adjudications to be conducted lawfully, fairly and justly, and for prisoners and young people (aged 15-17) to have a full opportunity to hear what is alleged against them and to present their case. These cases may merit a punishment of additional days to a prisoner’s time spent in custody if the prisoner or young person is found guilty. Only Independent Adjudicators can make an award of additional days as a punishment.</p><p> </p><p>A range of safeguarding measures are in place to make sure that a prisoner or young person is physically and mentally fit to face an adjudication hearing and any subsequent punishment. Adjudication outcomes are regularly monitored to make sure that no prisoner or young person is charged or punished for any reason other than their disciplinary behaviour.</p><p> </p><p>Information on the number of adjudications by type of adjudicators (Governors or Independent Adjudicators) and on the number of adjudications by a prisoner’s mental health diagnosis is not held centrally.</p><p> star this property answer text <p /> <p>I refer to my reply of 24 November. The aim of the joint protocol between NOMS, the police and the CPS is to strengthen, rather than replace, existing policy and requirements on the reporting of crime committed in prison. It is not anticipated that a large number of additional crimes will be processed through the court as a result of the protocol. Rather, the protocol will be used to prioritise referrals of crime to the police to ensure that the Criminal Justice System can target those crimes causing most problems in prison, those committed by persistent or violent criminals or those who are part of organised crime groups.</p><p> </p><p>As stated previously, the potential costs arising from the increased number of serious crimes that will now be dealt with by way of the Criminal Justice System rather than the prison disciplinary system will depend on a number of factors and it is the expectation that any additional costs will be covered through prioritising within existing Police and Departmental budgets for handling crime.</p>

star this property answer text <p /> <p>Police, prisons and CPS work closely together at the local level to ensure that there is an effective criminal justice response to crimes in prison. The recently announced protocol on the appropriate handling of crime in prison is designed to ensure that there is greater consistency in approach across different regions.</p><p> </p><p>It is not possible to identify from centrally held data, the number of prisoners proceeded against since 2010 in respect of a serious crime committed whilst in custody. This information could only be obtained at disproportionate cost by asking individual prisons to liaise with police forces and examine their records for the period in question.</p> more like this

star this property answer text <p /> <p>Prisoners are segregated as a last resort and for the shortest time necessary for reasons of good order and discipline or for their own protection. While segregated, prisoners are subject to a number of mandatory safeguards designed to ensure their safety and well being. Prisoners will be returned to normal location as soon as it is safe to do so.</p><p> </p><p>Figures recording the number of prisoners who have been placed in segregation are not held centrally and could only be provided at disproportionate cost by collating the information from records held locally at each prison.</p> more like this
