The EU commission carried out several consultations during the development of this policy, and published an Impact Assessment covering the EU implementing legislation on 15 December 2017. 	answer	answer is ministerial correction date of answer 12/04/2019 answer text <p>The Tobacco Products (Traceability and Security Features) Regulations 2019 include sanctions for non-compliance with the track and trace scheme. This includes the power to seize non-compliant tobacco products and deactivate an Economic Operator’s ID Code.</p><p> </p><p>From 20 May 2019, businesses will be unable to legally buy or sell tobacco products without a valid ID Code. These sanctions will help protect legitimate business from rogue operators selling illicit tobacco products.</p><p> </p><p>HMRC recognises that businesses will need time to become familiar with the new arrangements. During the 12-month sell through period, HMRC will support businesses to understand their obligations, and engage with other enforcement agencies, including Border Force and Trading Standards, to ensure effective and proportionate enforcement of the regulations.</p><p> </p><p>De La Rue (the UK’s appointed ID issuer) published details of the registration process and general guidance on 25 March 2019. The registration process will open on 23 April for manufacturers and large retailers, and on 30 April for all other businesses. 	answer	answer is ministerial correction date of answer 24/05/2018 answer text <p>The joint HMRC/Border Force strategy to tackle illicit tobacco (‘Tackling Illicit Tobacco: From leaf to light’) published on 24 March 2015 reinforced the government’s commitment to tackle illicit tobacco at all points in the supply chain. This was further demonstrated by increased investment in resources to fight this fraud announced at Summer Budget 2015 and Budget 2016.</p><p> </p><p>Effective action requires collaboration across government and HMRC and Border Force work closely with other enforcement agencies, including Trading Standards and the police to target those involved in the fraud. In the last two years alone, over 2.8 billion illicit cigarettes and over 660 tonnes of hand-rolling tobacco have been seized resulting in approximately 700 prosecutions.</p><p> </p><p>HMRC has also reviewed the impact of sanctions and is currently developing options, with particular focus on the approach taken to repeat offenders.</p><p> </p><p>In accordance with international commitments, HMRC is also developing a new track and trace system for tobacco products. 	answer	answer is ministerial correction date of answer 01/05/2018 answer text <p>Until the UK leaves the EU, we continue to be bound by the requirements of its Directives, which includes implementing a track and trace system for all tobacco products. For cigarettes and hand-rolling tobacco, this must be in place by May 2019 and for other tobacco products, by May 2024.</p><p> </p><p>In February 2018, the UK government announced plans to introduce a new category of tobacco product for heated tobacco products, such as IQOS. However, these products and e-cigarettes are not captured under the planned EU system to be in place by May 2019.</p><p> </p><p>It is not possible to comment on post exit scenarios until our future relationship with the EU has been agreed. The tender documentation specified that bids must comply with the EU Tobacco Products Directive and Implementing Regulations. This will enable traceability from the point of manufacture or importation to the first retail outlet, and ensures independence from the tobacco industry. Details of the successful bidder will be announced as soon as the contractual arrangements are finalised.</p><p> </p><p>The track and trace system is not a revenue collection system, however when used alongside existing controls it will help enforcement officers identify non duty paid tobacco products and take action against those responsible.</p><p> </p><p>The implementing legislation for the EU Directive specifies strict and comprehensive criteria by which independence from the tobacco industry is determined. This criteria has been, and will continue to be met at all times. While HMRC has no plans to publish representations made by the tobacco industry as they may contain taxpayer or commercially sensitive information, details of meetings between HMRC officials and the tobacco industry are published on gov.uk. On 27 June 2018, the UK ratified the Framework Convention on Tobacco Control Protocol, an important international agreement that promotes a framework of regulation and cooperation to tackle the illicit trade.</p><p> </p><p>The government remains fully committed to the Protocol and to working with other Parties, including the EU Commission, to ensure its global implementation. HM Revenue &amp; Customs (HMRC) will continue to take an active role supporting the FCTC Secretariat’s work programme, sharing expertise and supporting other Parties work towards implementation.</p><p> </p><p>Parliament passed legislation to implement all compulsory elements of the Protocol prior to the UK’s ratification. A track and trace system, as required by Article 8 of the Protocol, is being introduced under requirements of the Tobacco Products Directive 2014/40.</p><p> </p><p>In addition, HMRC continues to maintain its worldwide network of Fiscal Crime Liaison Officers (FCLOs), who work with overseas authorities to tackle tobacco smuggling. It is a key condition of securing this contract that the system proposed meets all the requirements of both the EU Tobacco Products Directive and WHO FCTC Protocol to Eliminate the Illicit Trade in Tobacco Products.</p><p> </p><p>The government has no plans to introduce tax stamps for tobacco products.
