unstar this property answer text <p>The Treasury Solicitor’s Department holds records relating only to those cases in which it has acted. The Treasury Solicitor represents most, but not all, government departments in litigation. For example, Her Majesty’s Revenue and Customs normally conducts its own litigation. According to records held by the Treasury Solicitor, the number of judicial reviews involving government departments in which it has acted in each of the last four years is as follows:</p><p>2010 – 8,566</p><p>2011 – 9,603</p><p>2012 – 10,274</p><p>2013 – 16,449</p><p>Information relating to how many of those reviews were upheld in whole or in part in each year is not held centrally and could not be created without incurring disproportionate cost.</p><p><del class="ministerial">The Administrative Court Office does not collate the information requested centrally and determining the number of reviews and how many such reviews were upheld in whole or in part would incur a disproportionate cost.</del></p><p><ins class="ministerial">The information requested in respect of the Administrative Court Office is published online at <a href="https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/267408/additional-court-tables-2012.xls" target="_blank">https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/267408/additional-court-tables-2012.xls</a> . The figures are based on the number of civil penalties issued to individual employers during each of the last five complete financial years. This includes public and private limited <br />companies, sole traders, partnerships and franchises. <br /><br />The government is committed to taking effective action against employers of illegal workers. Illegal working drives illegal immigration which leads to exploitation of workers and is also linked to non payment of the national <br />minimum wage, harmful working conditions and tax evasion. Illegal working also undercuts legitimate businesses and adversely impacts on the employment of people who are lawfully resident in the UK.<br /><br />The government has therefore taken measures to strengthen our approach to rogue employers. In 2014, we doubled the maximum civil penalty that can be levied against an employer to £20,000 per illegal worker and we used the Immigration Act 2014 to make it easier to enforce unpaid penalties in the courts. unstar this property answer text <p><ins class="ministerial"></ins><ins class="ministerial"></ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">This Government has taken action to end the cautions culture and to make sure serious offenders do not receive penalties seen as soft options. The use of cautions is at its lowest point for thirty years.</ins></p><p><ins class="ministerial">We are changing the law to ban simple cautions for all of the indictable only offences - the most serious criminal offences which must be tried in the Crown Court, including rape, manslaughter and robbery. We are also banning simple cautions for possession of a knife or offensive weapon, supplying Class A drugs and a range of sexual offences against children. </ins></p><p><ins class="ministerial">Further, we announced proposals in November 2014 for a new out of court disposal framework that would see an end to cautions and warnings and would require offenders to take actions to comply with their disposals. Elements of this new framework are being piloted in Staffordshire, West Yorkshire and Leicestershire before a decision is taken on whether to implement the new framework across England and Wales. </ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">The Ministry of Justice issues guidance on the process to be followed by the police when they are administering simple cautions for adult offenders. The latest guidance, issued in November 2013 following the Simple Cautions Review, states that the use of a simple caution for indictable-only offences, such as rape, should only be given following authorisation by a senior police officer of at least the rank of Superintendent and the Crown Prosecution Service. These will be cases where there are exceptional circumstances which would mean that it is not in the public interest to prosecute.</ins></p><p><ins class="ministerial"> Latest information on cautions issued by offence type is publicly available online at the Ministry of Justice’s statistics portal. The Ministry of Justice issues guidance on the process to be followed by the police and the CPS when they are administering simple cautions for adult offenders. This guidance states that the use of a simple caution for indictable only offences should only be given following authorisation by the CPS. These will be cases where there were exceptional circumstances which would mean that it was not in the public interest to prosecute.</del></p><p> </p><p><del class="ministerial">Since 2007 the overall number of simple cautions issued has halved. The cautioning rate, that is, the number of offenders cautioned as a percentage of offenders who were either cautioned or convicted, in 2013 was 20 per cent; which has declined from a peak of 31 per cent in 2007.</del></p>
