	answer	answer is ministerial correction date of answer 14/02/2019 answer text <table><tbody><tr><td><p>Under the proposed new reconsideration mechanism, announced on 4 February 2019, the criteria will be the same as judicial review – that is, whether the Parole Board’s decision was legally or procedurally flawed in some way. It will fall to a Parole Board judicial member, unconnected to the original decision, to determine that if decision should be reconsidered, having regard to the evidence presented. To determine whether to make an application to the Parole Board following representations from a victim, a dedicated team in my department will examine the case, including all the evidence and the procedures that were followed, in order to identify whether there may be an arguable case to make an application. They will look for any indications of whether the Board may have gone beyond or outside its powers, if the Rules were adhered to, whether the correct procedures were followed and where the panel’s decision could appear irrational in light of all the evidence before it. A Parole Board judge will then make the decision on reconsideration and whether the criteria have been met. When a challenge is made to the merits of a decision, and the Parole Board does not think a new referral is needed, the Board will take a neutral stance in the judicial review. If the challenge is given permission to proceed, the High Court will then review the decision on its own merits. The Secretary of State announced on 4 February 2019 that, following a public consultation, the Government intends to create a reconsideration mechanism to allow for Parole Board decisions in certain circumstances to be looked at again if they appear to be fundamentally flawed. A prisoner will be able to apply for their case to be reconsidered if they think the decision was unlawful. These publications confirmed our intention to introduce a new reconsideration mechanism that will enable parole decisions to be challenged without the need to resort to costly and time-consuming judicial review proceedings. Victims will be able to ask officials in Her Majesty’s Prison &amp; Probation Service to consider challenging a decision on their behalf. Before it can be implemented, provision must be made in the Parole Board Rules by secondary legislation to establish the legal power needed for decisions to be reconsidered. It will also be necessary to put in place the resources needed to operate the new mechanism and the associated guidance, training, documentation and electronic systems. We’ve improved induction processes to ease transition into the job, provide care and support for our staff and offer additional training. These measures are part of the work we are doing directly with Governors to address local issues and ensure experienced staff and new recruits remain in the service.</p><p>HMPPS heavily invests in a comprehensive range of Employee Assistance Programme (EAP) interventions which help staff feel valued and supported. In April 2019, the new prison education contracts commence. The services these contracts deliver have been chosen by prison governors to ensure that the learning available to prisoners is both relevant for their own development needs and linked to labour market information, supporting employment outcomes. The new contracts, and increased local and national management of the education providers, will provide better and more immediate information on the quality of the service being delivered and provide better levers for governors to manage underperformance.</p><p>In addition to these main contracts, our prison education Dynamic Purchasing System allows prison governors to commission specific, short-term education provision to meet niche and other learning needs their prisoners have, or to commission training to address employers’ bespoke training requirements. Private providers continue to play an important role in the prison estate. The ability for G4S to take back control of the prison will not happen until we are assured that it would be safe to do so and that the issues which gave rise to the step-in have been remedied and are not likely to reoccur. The decision to return the prison to G4S control will be determined by their capacity to safely manage the prison and maintain a trajectory of improvement across a range of issues. We have therefore taken the decision to extend the step-in until the summer, when the position will be reviewed. It causes cost and disruption to businesses, as well as damage to communities and consumers. We encourage all victims, including shop workers, to report these crimes to the police so that they can be recorded and dealt with accordingly.</p><p> </p><p>Out of Court Disposals are one important tool available in addressing shop theft – they allow the police to deal quickly and proportionately with low-level offending. Where an Out of Court Disposal is appropriate, we encourage the use of disposals which have a condition attached (be that rehabilitative, reparative, punitive or restrictive). We encourage all victims, including shop workers, to report these crimes to the police so that they can be recorded and dealt with accordingly.</p><p> </p><p>A report by the Centre for Social Justice issued last year concluded that people addicted to heroin and crack cocaine account for 70% of shop thefts. We are committed to ensuring the most vulnerable offenders, including those with drug addictions, are able to access support at the right time. This includes diverting offenders away from custody where appropriate.</p><p> </p><p>Out of Court Disposals are one important tool available in addressing shop theft – they allow the police to deal quickly and proportionately with low-level offending. Where an Out of Court Disposal is appropriate, we encourage the use of disposals which have a condition attached (be that rehabilitative, reparative, punitive or restrictive).
