We continue to carefully monitor and evaluate the use of video and technology in courts, so that we can improve services and support access to justice. The decision to deal with a hearing or part of a hearing remotely is a matter for the judiciary and the length of hearings vary significantly whether in person or remote.

We are listening to feedback from all court users including the judiciary, legal professionals, staff and other key stakeholders to understand the impact of the technology during Covid and findings of that evaluation will be available in Spring 2021.
more like this

star this property answer text
Decisions on listings are taken by the judiciary, often after detailed case management hearings that include representations from all parties. When listing a trial the judiciary consider many factors including the impact on victims, witnesses, defendants, lawyers and most importantly the overall interests of justice. All agencies work together to ensure a balance between the best use of Criminal Justice System resources and the listing of trials. The judiciary works closely with agencies to prepare for trials, in order to ensure trials are both fair and effective.

As a result of adhering to the principles of better case management (BCM), additional case management hearings are now taking place to ensure more efficient case progression. This encourages those cases that are likely to conclude without the need for a trial, to do so at an earlier stage, and in any event before the day of trial.
more like this

star this property answer text

The new package of support announced on 23 October is aimed at keeping disputes away from court, while those who end up in court will be provided with better support. The funding will be used to support a new strategic approach to increasing legal and practical support for litigants in person in the civil and family courts. This will provide direct support in some local courts, and other courts will be able to access national support via email or telephone. The service will begin in selected court centres with the aim of rolling it out across England and Wales.

This strategy has been developed in partnership with the legal and advice sectors and we are currently working with them on implementation. We hope to be in a position soon to make a decision on which courts will receive direct support as a result of the additional funding.
more like this
