unstar this property answer text <p>Resolution 2318 concerns the protection of freedom of religion or belief in the workplace. Domestic anti-discrimination provisions covering religion or belief are contained in the Equality Act 2010. Anyone who feels that they have suffered discrimination because of religion or belief can contact either ACAS, for issues related to the workplace, or the Equality Advisory and Support Service (EASS) for non-employment matters. Both services provide free advice to members of the public.</p><p>ACAS and the EASS refer appropriate cases to the Equality and Human Rights Commission (EHRC), which is the country’s national equality and enforcement body.</p><p>Both the EHRC and ACAS have published guidance for employers and employees about religion or belief and the workplace.</p><p> </p> more like this

Employers who discriminate against such employees rightly run the risk of claims for disability discrimination against them being taken to employment tribunals, which have power to award unlimited damages (including compensation for injured feelings) in addition to any award made in relation to employment law claims (such as loss of earnings).</p><p>Employment tribunal judgments, including those involving disability discrimination, are publicly available at <a href="https://www.gov.uk/employment-tribunal-decisions" target="_blank">https://www.gov.uk/employment-tribunal-decisions</a>. Guidance for employers to help them avoid claims for disability discrimination against them are available from Acas and from the Equality and Human Rights Commission (EHRC).</p><p>In 2019 the EHRC published two pieces of guidance; a guide to help employees including disabled staff challenge discrimination at work, and a guide to help employers understand their responsibilities to provide disabled staff with additional support and workplace adjustments.</p><p> </p>

unstar this property answer text <p>Section 124 (3)(b) of the Equality Act 2010 was repealed in the Deregulation Act 2015. Following consultation in 2013, the Government decided that wider recommendations by tribunals, which were not mandatory on employers, did not serve any useful purpose, yet created a perception of burden and unfairness for business - the estimated cost of making wider recommendations to employers who did implement them was about £2000.</p><p /> <p>Tribunals already had and continue to have the power to make critical observations about an employer’s processes and procedures. We have no plans to reinstate Section 124(3)(b) of the Act.</p> more like this

unstar this property answer text <p>Section 138 of the Equality Act 2010 was repealed in the Enterprise and Regulatory Reform Act 2013. The government has no plans to reinstate these provisions. Employees can still put questions to their employer or former employer concerning a claim under the Act if they wish. A Court or Tribunal may consider any relevant questions and answers as part of the evidence of the case, and may draw inferences if questions are not answered.
